I hate the throw a monkey wrench into the discussion, but more police are using window tint as an excuse, um, reason, to make a stop to initiate a friendly discussion about alcohol, drugs and weapons. Just so you know, if they find anything else, their report reads something to the effect, that they stopped the vehicle for window tint and gave the driver a verbal warning. I've seen this is more DUI arrests of late.

The question asked was whether he'd be arrested if he carried his Kel-Tec. I think the General didn't answer it because he couldn't give an answer. As a paid criminal defense attorney, even if he paid me, I wouldn't be able to truthfully answer that question, either. A charge they knew wasn't a good one? An interesting statement. The General believes that the definitions in Tennessee statutes make it arguably a short barreled rifle. I disagree, but I see the argument. They shoot a rifle caliber cartridge, they accept rifle magazines. Does that make them a rifle? No, but arguing to Judges who don't know firearms, such as the General Sessions Judge nor the Criminal Court Judge in this case, I could easily make a convincing argument. Also, initially, the police didn't know to whom the gun belonged. It was in a central location within easy reach of all the people in the car. Mr. Sales claimed it, as well as the Bulldog revolver found in the back seat with the other non HCP holders but denied possession of the cocaine also found there. I would submit to you, under those circumstances, I'm not sure I would have accepted it solely on Mr. Sales' word, despite his HCP. As to whether it could happen to any of us, well you could be correct. I know both of the attorneys who represented Mr. Sales and was asked my opinion by both based upon the facts they presented to me. I'm not sure I would have handled the case exactly as they did, but I'm not critical of them either. The system, even flawed, worked. The charges against Mr. Sales were dismissed just as they should have been. I'll never suggest to you that either life or the criminal justice system is fair, neither are. My experience as an attorney tell me that guns, felons and drugs don't make a great mix if you are trying to convince the police that you are an honest law abiding citizen simply exercising your rights. I guess another way to look at it is if you do stupid things, bad things can result even if you are within your rights. As to your last statement, ultimately, only you can decide that. -

I don't know about the Rabbi, but Mr. Embody called the DA to, in essence, ask if he would be arrested in Sumner County if he carried the 16 in H'ville. The General indicated that he couldn't offer him legal advice. -

Thanks, Mike, Mr. Embody writes an interesting post. I understand Mr. Embody called General Lamberth about this case and, basically, seeking legal advice. The General gave me a bit more information on Mr. Sales' case. Apparently, there were two weapons in the vehicle together with the four occupants. Tha Kel-Tec was in the center console and there was a Bulldog revolver in the backseat. Mr. Sales claimed both of these weapons as his. Interestingly, there was also cocaine in the vehicle. The passenger in the front passenger seat was a multiple violent convicted felon who was within reach of the Kel-Tec. He had an outstanding warrant and was also charged with being in possession of the Kel-Tec. He made bond and disappeared. All of the occupants of the car admitted to being members of the same gang and all had gang tattoos. Mr. Sales denied any knowledge of cocaine, which was claimed by one of the rear seat passengers. Mr. Sales claimed the weapons and the other passenger denied knowledge of them. Ultimately, the case was dismissed against Mr. Sales. For all of us who support our God-given right, enshrined in the Second Amendment, I'm not sure this is a case to fight. If you keep your pistol of this type within the reach of a multiple convicted felon with outstanding warrants in a car with cocaine, you might be arrested even if you have a permit. I remember my mother used to say something about dogs and fleas. -

Yes, it can handle +P. I love mine. I have no question about it being safe cocked and locked. I have an RKBA pocket holster and have no concerns about accidentally releasing the safety. Great little gun.

They just went up from $20 to $25, but, frankly, for me it's worth it because I walk by there everyday. Very convenient.

Sig factory magazines are always very high but, yes, Colt magazines do work. I've got a couple of Sig and a couple of Colt and they are virtually identical. I have one of SIGs factory extended magazine and absolutely love it. It allows a more natural grip for me which makes shooting the 238 a dream.

I highly recommend Blue Line. I've bought a gun there and they've transferred several others for me. Joey, the owner of Joey's Carpets and Charlie Wilson, his son-in-law and Gallatin PD, are the owners. Very friendly and easy to work with, located right on the Square. Initially, there inventory was a bit small, but I was there yesterday, transferring my newest, they had a good selection of handguns and long guns as well. Small ammunition and accessory selection, but they'll be happy to get you whatever you might want. They just got a new bunch of Sigs in so that's a plus.

No, but if you are carting around multiple felons, it might give the police a reason to provide a higher level of scrutiny. -

My recollection, again, I didn't go back and look it up, was that it was a traffic stop. As I recall it was in the vicinity of the Streets of Indian Lake where they'd had some gang issues in the recent past. Here was a car from Nashville, with four young men of color and if they gave the H'ville PD an excuse for stopping them they were going to be stopped. My guess is that the stop was probably a pretext, but a perfectly legal pretext. When the car was stopped, they naturally asked the passengers for ID as well, and, again, as I recall, one of them had an outstanding warrant. Guess what? That means everybody's going to get more scrutiny than they might otherwise. I don't know but my guess is when the officer saw the pistol, even though the driver had his HCP, he concluded that these guys might be up to no good. Was the arrest illegal? Maybe. I honestly don't know. I remember when the case was still in Sessions, I read through the warrant and I would have been equally happy to argue either side. I did opine to the DA at the time that as long as the ATF considered it a pistol, I thought it was a pistol, but he really didn't care what I thought. the then Chief of Police of H'ville, since retired, wanted the case pressed or it would probably have been resolved in General Sessions. As to your induction trip, I wouldn't violate any traffic laws, particularly if you're going to be carrying an AR style pistol. -

Maybe you've not realized this yet, but sometimes life's not fair. There is a colorable argument that these pistols don't meet Tennessee's definition for a handgun, but meet's the federal one. Then the question is whether federal preemption under the Supremacy Clause means their definition rules. I think it does, but until there's a case that says so, there still exists a gray area which arguably makes such arrests, at least for now, legal. If you carry one of these AR type pistols, you ought to be prepared for law enforcement scrutiny at a higher level than if you were carrying a more traditional sidearm. -

Officers arrest or file warrants and the DA's aren't involved unless the officer calls one for advice while at the scene. That happens but only rarely unless it is a serious felony. Once the charge is laid its reviewed by a magistrate who sets bond in the case of an arrest or approves (read that as rubber stamps) the officers charge. From there it goes to the Clerk's office for filing. The DA's rarely see the file before the Court date. I expect that so long as your not cruising around in H'ville with an out of county plate with a car full of gangbangers, you're relatively safe. -
I've had two, one ex-Rusty, both function flawlessly. I sold Rusty's simply because I didn't need two. I've got about 800 rounds through the one I kept without a bit of trouble, I carry it almost everyday in my pocket as back up to my 220. I've found it very accurate for a pocket pistol, easy to shoot and very reliable. I love mine.

Actually, the police arrested him and it went to court before the DA even knew about it. I think the police decided to err on the side of caution, frankly. If you are driving around H'ville with this pistol and a car full of gangbangers from NashVegas, well, the H'ville PD thinks you might be up to no good. I'm not saying that I agree with them, but I understand. This pistol isn't the normal sort they come across so they arrested and let the Court sort it out. I know it's in my self interest, but sometimes that is the way it works. They followed the dictum, arrest them all and we'll sort it out in court. How else are criminal defense lawyers like me going to make a living so I can buy more Sigs? -
I don't think it's Civil War. I've studied the Civil War for years and never seen anything like it. It looks to me to be older than that. It looks like the device on an officer's hat from the Mexican War or the Seminole War.
