  1. EXCELLENT!!!!! One of the guys I work with does cringe every time he sees Hillary on TV and swears he can hear, "Take out the garbage!" in a shrill voice...lol

  7. I agree with what you are saying. The trouble is a larger percent of the general public and law makers see these few examples of LEO's as a rare incident and a bad seed, but see something done by a HCP holder as representation of all of us. When a legislator wants to site one or two incidents committed by the general public or the rare incident committed by a person with a HCP, I so bad want to ask them if they (legislators) would like to be judged as whole by what a few did in the TN Waltz sting.

Surveillance footage from Jan. 29 shows Hillsborough County deputy Charlette Marshall-Jones, 44, dumping Brian Sterner out of his wheelchair and searching him on the floor after he was brought in on a warrant after a traffic violation. Sterner, 32, said when he was taken into a booking room and told to stand up, Jones grew agitated when he told her that he could not. Marshall-Jones was suspended without pay, and three other deputies were placed on administrative leave pending an investigation. Marshall-Jones is charged with abuse of a disabled person, a third-degree felony, said Hillsborough County Sheriff David Gee. If convicted, she could be sent to prison for five years. Gee said Marshall-Jones was aware of the warrant for her arrest, but that he didn't know when she might turn herself in. Marshall-Jones could not be reached by phone for comment Friday night. A telephone number listed in her name has been disconnected. Sterner, who can drive a car but has not been able to walk since a 1994 wrestling accident, was arrested at his Riverview home and taken to the Orient Road Jail on a charge of fleeing and attempting to elude a police officer, according to records. He had called for charges to be filed against Marshall-Jones.

T.C.A. 39-17-1322 A person shall not be charged with or convicted of a violation under this part if the person possessed, displayed or employed a handgun in justifiable self-defense or in justifiable defense of another during the commission of a crime in which that person or the other person defended was a victim.
  10. I don't know for sure, but I would guess at some point they would go ahead and bring it up for a vote in the committee. This is the last year of this session so if it doesn't pass it would have to start over from scratch next session no matter how far along it had made it this time. Also this is just something I've heard...so take it for what that may be worth. But many of legislators are up for re-election this year. State law prohibits them from campaigning will the legislature is in session. So some think this may be a short session. When this happens, sometimes close to the end, some bills are more easily passed because of the lack of time to argue about them etc.... Not sure if could be the plan of the sponsor or not.

  13. But that's what I'm saying.... That in itself is not duress. They are offering you a job, with stipulations...you can accept it or not. As far as going to court, that goes both ways...if they fire you for not letting them search your car or for carrying on their property etc....contract or not, how many are going to get lawyer to try and get their job back? The rest I pretty much agree with you on.

  15. Not that I disagree per se, but what duress? If you mean that you won't get the job if you don't sign it, I'm not sure that would count as duress. I do agree something like not working for a competitor for 5 years etc...is rather meaningless unless they can "penalize" you in some way if you do.
  16. True! Don't know of any...and to be honest searching court cases online is something I haven't 100% figured out yet. Still sort of have my fingers crossed that the bill to specifically allow carry will pass and make all of this moot.

  18. TN AG Opinion 08-26 still says park carry is illegal. I still hope the bill passes that would allow us to carry, but probably not with that fiscal note on it.

  21. Let me ask you why this person is pushing a lawn mower in my yard in the first damn place? His, mine or otherwise. Just as I don't count on the police to protect me, I don't need a judge and/or jury to tell me that someone in my yard, with my possessions in their hands is guilty of stealing from me. I just wish I was so rich or had so many things I didn't have to worry about people taking them from me. But unless someone else is going to come over and cut my grass, I'd miss my lawn mower and more than likely would have to forgo some other purchase to get a new one.......hopefully it wouldn't be a food or medical purchase that would have to let go.
