Schools are schools 24/7. Any polling place is off-limits to 92-93% of the public simply because they don't have a HCP, so not sure how much of an argument you could have about moving a polling place from a school until it is truly a right to carry in TN. As said, I doubt polls were placed at schools to try and prevent carry at the polling place. Many states have laws against carry at a polling place no matter where they are, TN could simply do that too if they wanted.

Have you checked to see if you can chage it yourself. I can in mine, but not sure about everyone. Go to your profile page, click "Edit Profile" in upper right corner, choose "Display Name" on left pannel....for me it take me to a page that says I can change my name up to 3 times in a 30 day period.

I agree there are pros and cons for both ways. Also even though we should have situational awareness at all times anyway...if you do OC you should be even more so aware of who and what is going on around you. -

Meaning the defenses list in 39-17-1308 only apply to the charges in 39-17-1307. Carry in parks is under a different law, 39-17-1311 the defenses that apply to carry there are listed in sub-sections of that law. Camping/Hiking is not a defense listed in 39-17-1311 like it is in 39-17-1308. -

I haven't thought of it...but I think you may be right in so far that 39-17-1311 applies to parks and only the exceptions within it applies to weapons in a park and 1307/1308. -

OS beat me to it, but he sums it up fairly well. There is no mention of "brandishing" in TN law. So then it's whether your actions caused the other person to reasonably fear injury or death and that is fairly subjective. Also if you would be justified or not.

I imagine you would have said this already if it applied, but can you carry under LEOSA? If so then a loaded handgun in the park isn't an issue at all. -

The law allows non-concelead carry without a permit. The trouble is it is not clear that a holstered hangun is not "concelead in part". But if you have a permit it really wouldn't matter if it is concealed in part or not since a permit allows you to carry concealed and there is no law against open carry. -

Are you saying the shady character didn't have bad intentions and just happened to back of after seing the handgun? Perhaps.... of course if the OP had seen him sooner and/or the shady character seen the handgun sooner...there may not have even been a noticble encounter at all. As you say there are valid points to be made on both sides and therefore should be up to the person.....but that is why it gets me a bit when it's posted the OC is bad period. Sorry QuietDan...I am usually one that complains about when OC is mentioned (which I know you weren't doing per se) in a thread that it turns into a CC v OC debate....and now I have contributed to it. So I'm done with that aspect. -

When I pump gas I tend to turn around and put my back up against my truck...never really realized that till now. Have always tried to keep my head on a swivle. Glad all went well. But have to agree with Erik88, couldn't have been seeing your weapon that scared him off...we know from 1000s of post on here a visable weapon makes you a target, not a deterent. -

Sort of what I thought. Many would considered a handgun carried in a holster..as long as the holster wasn't covered and not concelaed. But based on the wording of the law, one could make a good argument that is concealed "in part". Guess that is one reason the AG didn't want to really define it. Of course all of this is really moot as long as you have a permit. -

Volphin is probably right that he was just a vagrant, but always good to know what is going on around you. On a side note (since you mentioned it) is the courthouse you go to posted? I ask since it is not illegal to carry in a courthouse..only a room where a judicial proceeding is taking place. -

Well that is partially incorrect. Looks like there is a MS AG Opinion. I guess if you have a permit whether it is concealed in whole or part doesn't really matter since you have a permit and he does clearly say that is if is not carried in concealed in whole or part it is not a violation. Of course the part saying "Exactly what constitutes concealed in whole or part is largely a question of fact which we do not determine, and would depend on the facts of each case." gives me a bit of pause. Would seem like they could say if a weapon carried in a holster where the holster was exposed constituted concealed in whole or part or not. Sounds like to me if you tried to OC in MS without a permit...you'd more than likely be charged, then it would be up to the jury. Of course as posted above, even OpenCarry.org list MS as a "licensed" open carry state. (Doesn't seem to be a way to link directly to the opinion) -

My guess is you "might" find someone that eventually says "It's not illegal" but they will strongly urge you not to. Also if another LEO was to confront you while you were OCing, telling them that so-and-so of the legal department told you it was ok/legal isn't going to mean very much to that LEO. In TN there is an AG Opinion that clearly says OC is legal.....doesn't sound like there is any such clarification in MS. -

As you said...about what you'd expect. From http://opencarry.org/ms.html Mississippi is an open carry state and the state constitution appears to guarantee this right. Further, localities are generally preempted under state law from enacting local gun control ordnances that might restrict open carry. However, Miss. Code §§ 97-37-1 & § 45-9-101 operate together to ban carriage of a handgun "concealed in whole or in part" unless the carrier is inside a motor vehicle or possesses a License to Carry a Concealed Pistol or Revolver. As the Mississippi courts have said that a handgun in a holster is concealed in part, a License to Carry a Concealed Pistol or Revolver is required to openly carry a handgun in a holster in Mississippi. If he responds back...ask him what law required it to be fully concealed. -

I just don't understand how they think the security of the parking lot has anything to do with it? It's on the way too and from that people are worried about. Hell if a place has a "secure" parking lot you'd think they would be less worried about an employee having a firearm in their car. As far as schools there bills to reword 39-17-1309 to make it more clear about leaving a firearm in a vehicle....how would an exception for schools on this bill effect that if ever passed, or the current state of 39-17-1309 for that matter. ....and don't even get me started on MTAS and CTAS. I'm not necessarily against local governments having a place to get advice if they need it, but the stuff those places put out...and cities and counties thinking they just have to follow it without question. I really think many cities/counties passed resolutions against park carry just because of MTAS/CTAS sent out without even really knowing what they were doing. It's bad the anti's get the last word...but to some degree I imagine most of the members will know how they are going to vote before they enter the room. -
No laws were passed that would prevent them from doing what they are. In fact legally they could still publish your address, they have just chosen not to after several complaints.

Different agencies don't get different info, but they may have different protocols on what info they check for in certain situations. But every agency I've ever heard on the scanner and when I dispatched, gave Handgun Carry Permit status to the officer when he ran a DL whether they asked for it or not. So the LEO may or may not have run my DL, but odds are he did...and more than likely was told I had a valid permit. -
