  1. I'm pretty sure a gift is the same as a sale. Person-to-person requires an FFL in the receiver's state.
  2. With an army of paper pushers they could know what you bought through an FFL. They can't know if you still have it or not as private sales don't require a paper trail. They'd also not know what you bought from private sales. If the fed or a state did a registration requirement, there would be penalties for non compliance. They couldn't find the one you burie...."sold" but you couldn't do much with it. Similar to having a known stolen or banned gun today.

  6.   Yes techincally you're breaking the law when the school kids are shooting at a school-sanctioned event at a gun range. Nobody but a total moron police officer would make an arrest. Nobody but a total moron DA would prosecute. Nobody but a total moron judge would hear that case.   If you live in a place with gun-hating bed-wetting the-sky-is-falling morons on the police force, in the DA's office,and on the bench, then maybe it could happen. One call to the local TV station's "investigative reporter" would generate so much bad press for all authorities involved in that chain that none of them would want to risk it. Then a call to Matt Drudge to get that story on the top of the national talking points and it gets even worse for them.       On second thought....that might be a good way to get that law changed. Any volunteers? :hiding:
  7. The affectation doctrine gives them that power. Even intrastate commerce that effects interstate commerce can be regulated by the fed. If I buy a Glock from a TN resident that affects interstate commerce because I now won't buy one from a seller in Utah.
  8. It's not forcing commerce, it's regulating commerce. Buyer and seller freely engage in the deal. The Fed would just be regulating it. That's not unusual.
  9. It's as enforceable as 21 to buy liquor. Nothing really stops it except the possibility of it coming back to bite the seller and bite hard. How many of us would really risk federal felony charges to avoid an FFL transfer and to save a few bucks on an otherwise legal sale?

JayC, I think you're referring to being allowed to have a weapon on school property for school santioned events IF you're involved in the event as a participant or instructor.   I believe that razorback2003 is referring to the parts of TCA 39-17-1309 that I quoted above in post#5. It expressly states that grounds being used by a school are considered school property for the purposes of 1309. So if Central High is having a baseball practice at a city park that is not otherwise off-limits, it's off-limits while the practice is ongoing.   It's a two-way street there. You can have weapons on "school property" if you're involved in a school sanctioned event. You can't have weapons in an otherwise OK location if a school is operating there.   By the letter of the law, I'd say a shooting range being used by a school's shooting team would be off limits to anyone who is not a student or an instructor. The same could be said about a Wendy's when a school bus unloads some field-trippers.   In reality, that's asinine and everyone knows it.
  11. The good ones don't see it that way. They see it as another revenue stream (albeit usually a small one) and the opportunity to get a future gun sale, a present accesory/ammo sale, and good word of mouth.

  15. After reading back through that a little more closely, am I understanding 39-17-1309 correctly as follows?   (B ) is saying any weapon is off limits if carried with the intent to go armed. (C ) is specific to firearms but leaves out the intent to go armed. The exception for non-student adults and vehicles is only for paragraph (c ).   If I followed that correctly, how does having a loaded handgun in the car while you're also in the car not violate (B )? I very much intend to go armed when carrying a handgun, unless I'm not understanding what the legal distinction of that phrase means.

  21. I don't think there is one on that side of town. CHMR is a private club with no membership requirements beyond showing up and paying $60/year. You can shoot handguns on their 15, 25, 50, and 100 yard lanes. You can place as many targets as you want on a 4x8 sheet of plywood. It's in Spring Hill. Gallatin Gun Club is a private club with limited (and currently closed) membership which hosts IDPA events regularly. Those events are open to the public.
