Co-worker says it's illegal to have more than 10,000$ on your person?
Patton replied to timcar86's topic in General Chat
This has gotten a little out of hand. You don't have a reason to fear riding around with a little cash in your wallet, not from the police anyway. You do not want to ride around with $100k in the trunk of a car that is not yours with no proof of where it came from and no proof of what it is for. Actually, when money like this is seized the driver more often than not cant tell the police how much is there or they completly deny the money was there. The police would be a damn fool to give $32k back to a guy that doesn't own the car he's driving that says it isn't my money and I dont know where it came from. Don't hide $32k under the spare tire either. -

No your right, I normally only search a lunging area when a crime is involved, not an infraction like traffic violations. However, the Supreme Court has ruled that an officer who is getting conflicting stories from the vehicles occupants has reasonable suspicion to believe a crime has taken place. This gives an officer more than enough for a terry search of the vehicle or to obtain a warrant. This incident occurs a lot. Also a driver telling you something that you know is false is a good for asking the driver to step out. I have seen a car outside of a drug house and the guy told me he just came from Walmart, this is another reason to suspect something isn't right. -

Once an arrest has taken place the car is subject to search. It is now called inventory of the vehicle. Same creature, different name. -

The center console, under the seat are all subject to search without consent. It actually is covered under a Terry search. "Protection of police and others can justify protective searches when police have a reasonable belief that the suspect poses a danger. Roadside encounters between police and suspects are especially hazardous, and danger may arise from the possible presence of weapons in the area surrounding a suspect. Thus, the search of the passenger compartment of an automobile, limited to those areas in which a weapon may be placed or hidden, is permissible if the police officer possesses a reasonable belief based on specific and articulable facts which, taken together with the rational inferences from those facts, reasonably warrant the officer to believe that the suspect is dangerous and the suspect may gain immediate control of weapons. If, while conducting a legitimate Terry search of an automobile's interior, the officer discovers contraband other than weapons, he cannot be required to ignore the contraband, and the Fourth Amendment does not require its suppression in such circumstances." 6.8-AR, I did leave out the fact police have consent to search upon making an arrest. It is called "search subject to apprehension". That is how telling the cop to kiss you a** over a broken tail-light or telling him you will not sign a ticket gets you a ticket to jail and your car searched whether you give consent or not. Also the police can search without consent any location in the vehicle reachable by the driver while still sitting in the drivers seat. You guys have missed the point that the money is taken from people who most of the time are claiming it is not their vehicle and the cash is hidden in that vehicle. I am not saying that I totally agree with all aspects of their practice nor do I say that I agree with Civil Asset Forfeiture Reform Act. I can tell you that it hits drug dealers where it hurts, their wallets. If you guys have that big of a problem with it get it changed. Clinton was primarily responsible for the mess. I wonder how the liberals feel about this? -

Oh, and we all have Bill Clinton to think for this whole ideal. -

On a good seizure they normally have a tip as to what to be looking for. Of course they do get lucky. One of the best drug interdiction officers I have ever heard of was lucky to find one person carrying cash on e a month. He often would find drugs several times a month with or without cash. He was shot dead a few years back. All of this is covered under the CAFRA act of 2000. Basically it states any money believed to be associated or tied to illegal activity can be seized for investigation. The person claiming interest in the money has ten days to file the appropriate paperwork. All of this is a civil matter. Being that it is a civil forfeiturer you are entitled to any and all attorney fees associated with your case if you win. You do have to show proof of where you got the money. Eg. Pay check stubs, lottery winnings, inheritance. What doesn't fly is when you claim on the side of the road that you have been saving since you were a baby and then in court you say you were given the money from a rich uncle to go to school. This is the kind of stuff they say. Normally we are talking amounts in the 100k not $10k. Also being that it is a civil forfeiture no arrest is required. -
I got extremely lucky and found one the day after Christmas at Academy for $399. I liked it but decided to stick with j frames. I sold the Shield for what I had in it to a good home. They are great shooting guns and I probably should have held onto it.

Law Enforcement does not seize money because it smells like or has traces of drugs in it. That is an urban legend. -

It is the descretion of the bank/teller, if they has a suspicion about you, the money, the account they can do it for $1. They are only required for any transaction $10,001 or over. People that are driving their own vehicle, have their money in their wallet/purse, have somewhat reasonable explanation to why they have such a large amount of money have no reason to be affraid. The people who have their money seized are a "man and wife" traveling together with id's from different states, who when interviewed seperatly tell you a different day in which they were married, the car is registered to neither one of them but it's their cousins. You interview them a little more and then the car belongs to a cousins friend who lives in FL but the car is registered to GA. You ask them for consent to search and they say, " no it isn't their car.". At this point they have essentially told you the contents of the car is not theirs. Believe it or not this is how most of them go down. I will not give away any more information as to how the warrant is gathered or how they get consent. What I can tell you is that 95% of the people that have money seized say they didn't know it was there and they do not try to claim it later. The other 5% generally have some outlandish explanation for having the cash and will get it back. Edit: I decided to not to share so much. -

I agree with other things you have said, but remember a citation is issued in leu of an arrest. Yes, speeding is an arrest able offense. If their probable cause for the stop was an infraction and not just a suspicious vehicle they may very well arrest you after that statement. I have known some TN Drug Task Force Agent's and when they take cash it is almost always honest to got true drug money. I will not give away how they know the origins of money but they have a very relible method. Honest people have nothing to fear. When DTF stops a vehicle and suspect's drug trafficing it's over before the driver even knows what happened. A series of questions and the agent knows what's in the car and which process of the transportation it is in. Once again no one here has any reason to fear for the safety of their money, unless your trafficing. -
I shoot lead in the factory Glock barrels but I always scrub the bore every 100 rounds and especially before loading jacketed ammo in there.

I believe that Fugates is supportive of military. Carmen's son in law is stationed at Ft Campbell.

Spank, maybe things have changed but Fall of 2009 I was treated like crap when I was in there. I was not in uniform but it's pretty obvious that I am military and/or law enforcement. Some people just know I am police from seeing me before. I was in the Clevend National Guard unit and when I told one of the local Cleveland boys about my experience he said they have asked people to leave when they asked for a military discount.

Recommendation for HCP instructor in Chattanooga
Patton replied to a topic in Handgun Carry and Self Defense
I would guess that he chose Carter's because I know that's their next available class. That is a long time to wait. I know someone that got into a class at Fugates with 3weeks notice. Even Sportsmans Supply in Hixson was only a month wait. -
Normally you can't but the Glock 29/30's may be an exception. The dust cover on the front is where troubles normally occur. Since the gen 3 29's had a dual recoil spring they may interchange.

Truthfully, I try to avoid Cleveland and Cleveland buisness' when at all possible. I have had some bad experiences in Cleveland over the years. Also keep in mind there is an additional .25% or more sales tax. Benton Shooters supply prices pre Obama and pre Sandy Hook were at the time competitive with today's prices elsewhere. I'm sure they have had an increase. I went into Fugates in Calhoun for the first time years ago and I looked at a Keltec P32 for $259. They told me Benton's Shooter Supply had the same gun for $289. I laughed and said that I didn't believe that. I went to Benton's to see for myself. The same P-32 was $299 instead. I ended up finding out about Silvers who had new Keltecs for like $265 OTD(I think this is still his price). I have found some deals and have enjoyed shopping at Fugates though. Fugates has one of the best deals around on NAA revolvers 199/Lr and 229/mag. Those NAA have went up in price drastically. I have been told by someone else that the dealers price is now more than what Fugates is selling them for.

I have actually bought some things at VOW before but I try not to go there at all. It is well known amongst law enforcement and the military that military and police are not welcome at VOW. At one time there was a little gun shop on spring place road about a mile from the bypass. I don't have a clue on the name. One of the best shops in the area is Fugates about 20 miles north on hwy 11 in Calhoun. Fugates is closed on Wed and Sundays.

There was a crap load of .40 s&w at the Ft. Oglethorpe Walmart this morning. Very little of everything else and no 9/45/223/22

Sounds like a familiar story. Supposedly I have a friend of a friend with a 44 auto mag from the 80's that he has never been able to find ammo for. Obviously these do not require moon clips, but can the round be used in 9mm that normally require a moon clip?
-
I really wish these ammo manufacturers would just produce more ammo instead of inventing new calibers.
-
I'm up to speed now. I was thinking of something else.
-
Truthfully a 357 is so much more versatile I would not bother with a 9mm revolver. If I were a police officer or security guard that for whatever reason a 9mm would be less hassle I would but that is so few of people it's almost not worth mentioning.

The Walmart in Brainerd had about a dozen boxes of 5.56 WWB but it was $13 a box today.

Someone asked about Large Patch, treat it with a fungicide in the early spring and fall. To reduce the chances add very little supplemental Nitrogen. Honestly, of all turf grass, Zoysia needs less feeding than any of them. Keep a sharp blade on the mower, water sparingly, and rinse off the morning dew with the test cycle on your irrigation box. Someone mentioned the look during the dormant season. I have had customers in the past with beautiful clean warm season lawns tell me the get more compliments about their lawn during the winter. A completely weed free dormant lawn looks great in the winter. If it is a mixed, patchy lawn it looks terrible. I still generally recommend against zoysia, especially further north than Chattanooga. I normally recommend seeding Fescue or sodding Bermudagrass. Honestly though, the brown patch and drought is so hard on Fescue in S Tn that I recommend Bermudagrass when the light conditions are appropriate.
