Yes... "(1) A person who uses force as permitted in s. 776.012 is justified in using such force and is immune from criminal prosecution and civil action for the use of such force, unless the person against whom force was used is a law enforcement officer, as defined in s. 943.10(14), who was acting in the performance of his or her official duties and the officer identified himself or herself in accordance with any applicable law or the person using force knew or reasonably should have known that the person was a law enforcement officer. As used in this subsection, the term “criminal prosecution†includes arresting, detaining in custody, and charging or prosecuting the defendant." If a person is found to have been justified (either never charged in the first place and/or found not guilty because he was justified) in the use of deadly force than he has no civil liability either; pretty much the same as Tennessee.

Exactly. It's unlikely we'll ever hear all the REAL evidence of this incident unless it goes to trial (and I'm not sure it will get that far) but from what has come out, there seems to at least be cause to consider that little Travon was the aggressor here and Zimmerman responded. I'm not saying Zimmerman did everything right here, far from it...but that doesn't translate to being charged with, much less found guilty of murder.

Sad news and a great loss to firearm enthusiasts - the older I get the more often I seem to find painful reminders that life is fleeting and precious and that none of us know when we'll face our own end. -
I've head a number of people knowledgeable about such things indicate that you should use factory ammunition for your defensive weapon. Of course, you use what you have at the time but at least in weapons you carry/have available for defense it's best to use factory ammo. I believe it has something to do with how hot the load is - with a re-load, a prosecution could argue that your load was hotter than necessary and infer intent on your part to kill rather than to "stop the threat".

So, since I'm over 45 I no longer have the right to keep and bear arms? We do have a "formal" state militia that answers to the Military Department of Tennessee; the Tennessee State Guard which operates, in general, under U.S. Army guidelines, ranks, etc. Unfortunately, there is no telling what a future supreme court could decide as it all depends on who is appointed to the court - we've got justices now who think the U.S. Constitution is out of date and out of touch and that the court should make decisions based on "world" laws and court decisions.

It doesn't take an advanced degree to figure out that when a bunch of people open carry and walk into a restaurant; there is a pretty decent chance that some anti-gun nut or worse, some uneducated but perhaps well-meaning sheep is going to overact and likely call the police. People who OC can complain about that all they want but it won't change the very predictable outcome. If people chose to OC that's fine but there is no reason to be surprised that it can cause a problem...as was said before, there are more people around who don't like guns (or at least don't like seeing people carrying guns) than there are those who understand why it's not just ok and not just a "right" but that armed, law-abiding citizens is a good thing. Yeah...the police probably overacted just as whoever called the police in the first place did...I'm not justifying the reaction; simply saying that it shouldn't be a surprise to anyone. -

I can't comment about specific titles of threads but there are dozens if not hundreds of threads just like this one - and adding a poll doesn't alter the angst that this subject brings forth. Talking about OC and CC on this forum is about as contentious (and as beaten to death) a subject as any that ever gets discussed in this forum. -

"They can only hold you if there is probably cause that you have or are about to commit a crime". Tha's fine but all they have to do is "decide" that they have suspicion and they have all the cause they need to detain you until they've identified who you are. While such a "decision" may not carry the day in court, you'll go through some substantial hassle before you get to the courtroom...personally, I don't like sitting in a jail cell just to make a point that likely didn't need to be made in the first place. Refusing to give ID or at least truthfully identify yourself seems like an easy way to escalate a non-problem into an unnecessary confrontation. -

It does seem that many of the stores posted in this forum aren't gun related and are often, although not always, more related to politics in general than firearms. If a forum just for firearm related news stories is desired then this one needs more attention or perhaps what is needed is this one moderated to "firearms related" only and a more "general" sub-forum created for other stories??? -

Unless I'm misinformed, a police office has the right to ask for ID and while you have the right to not give it, they then have the right to detain you (for up to 72 hours I think) until they DO know who you are and I don't believe they need probably cause of anything other than wanting to identify who you are - if I've got that wrong then someone please correct me. My point here is that regardless of the "open carry" issue, I see little to no benefit in refusing to supply your ID when asked by a LEO; unless of course your purpose is to create an incident (and one you are likely to lose). -

Wow...didn't take long did it! One would think that when his own home state AND his own home district absolutely REJECT Ron Paul, some folks might get the message. Apparently not, however.

I use that system right now...it works great and the warnings will only improve as more and more people opt for it. It works in conjunction with my iPhone and my Escort Redline; all I need to add was the powercord (with the right circuitry and Bluetooth capability). I saw a LOT of LEOs this weekend traveling to/from Ohio, all in all about 1,200 miles driven and in most cases, I knew where they were before they ever had a chance to see me.

With today's technology, it isn't difficult at all to automatically record a vehicle's speed and location and whether it is or isn't in violation of the posted speed limit or running a red light - all from a couple of small devices installed in the vehicle with the data automatically transmitted to law enforcement for them to generate a ticket without human intervention of any kind. With the black boxes already being mandated; this would be a minor addition and we could dispense with all the cameras and such that require dollars to purchase/maintain/run. After all, if we never speed and never run a red light there wouldn't be any harm to anyone. Okay...a bit more seriously... Obviously red light and/or speed cameras are not a big deal...they don't signal the end of freedom and liberty and honestly, we shouldn't run red lights whether we get "caught" or not and I see a lot of dangerous speeding almost everyday. My problem with speed cameras is that, in many cases, speed limits are set where they are because most drivers simply aren't good drivers - only a tiny fraction of drivers ever take driver training courses beyond what is necessary to pass their test for their license (sounds familiar doesn't it?)...most have no clue what their skills actually are (or aren't) nor what their vehicles can and cannot do or how to handle an emergency situation. Soooooo....the "state's" answer, as usual, is to address the problem from the easiest standpoint - lower speed limits for all rather than require better skills of those on the road. My problem with both red light and speed cameras is that they aren't there for safety or to benefit society at all; they are there to generate revenue for whatever entity put up the equipment. Law enforcement isn't supposed to be a profit center; it's supposed to be about keeping a civilized society, civilized and in my always humble opinion, that is NOT what these red light/speed cameras do.

Loading your guns? Really? As others have said, I have at least one loaded gun in ever room of my house and usually one on me. The only "unloaded" guns in my home are the ones that are locked in my safe. Generally speaking, a unloaded gun is a dangersous gun - just look at how many people are shot with an unloaded gun each year!

So in theory, If I'm not doing anything illegal, I guess I should be okay when a government entity listens to my phone conversations, searches my vehicle, searches my house, searches me, reads my mail, tracks my internet usage, and knows my whereabouts down to the millimeter all without any court ourder or oversight.
