A federal appeals court in Cincinnati deemed a law unconstitutional that kept a Michigan man who was committed to a mental institution from owning a gun. The three-judge panel of the Sixth U.S. Circuit Court of Appeals unanimously ruled that a federal ban on gun ownership for those who have been committed to a mental institution violated the Second Amendment rights of 73-year-old Clifford Charles Tyler. Tyler attempted to buy a gun and was denied on the grounds that he had been committed to a mental institution in 1986 after suffering emotional problems stemming from a divorce. He was only in there for a month. Tyler’s lawyer, Lucas McCarthy, hopes that the ruling would have a “significant impact on the jurisprudence in the area of gun rights.†The decision is the first by a federal appeals court to rule a federal gun law is unconstitutional since 2008. The U.S. Supreme Court’s ruling in D.C. vs. Heller struck down the Washington, D.C. ban on firearms ownership. Federal law bans gun ownership for convicted felons, people under 18, illegal immigrants, drug addicts and those ordered by a court to a mental institution. The law also syas that people must have a chance to prove that their disqualifying disabilities have ended in order to possess a firearm legally. Since 2008, states have been able to get federal grants to set up “relief from disabilities program,†which was defunded in 1992. Michigan has not set one up, which left Tyler without a way to prove that his so-called “disability†should no longer apply. “The government’s interest in keeping firearms out of the hands of the mentally ill is not sufficiently related to depriving the mentally healthy, who had a distant episode of commitment, of their constitutional rights,†wrote Judge Danny Boggs, an appointee of President Ronald Reagan, for the panel. http://www.foxnews.com/politics/2014/12/19/us-appeals-court-deems-gun-law-unconstitutional/

New York State’s tough new SAFE Act gun control law has flagged 278 gun owners who could lose their weapons because they have been deemed mentally unstable, a new report shows. Gov. Andrew Cuomo urged lawmakers to pass the SAFE Act quickly after the 2012 mass shooting at the Sandy Hook elementary school in Newtown, Conn. The Syracuse Post-Standard reported last week that since the law’s enactment, the state has collected 38,718 names in a database of individuals who have been found at-risk for owning guns by psychiatrists and other health professionals. The paper said when the database was checked against a list of pistol permit holders in the state, there were 278 matches, less than 1 percent. Monroe County had the most matches at 36, followed by Westchester, 17, Suffolk, 16 and Dutchess, 14. The paper said it obtained the county-by-county breakdown from the state in response to a public records law request. The paper reported that the state does not tally how many individuals in the database have had their permits suspended and guns confiscated. The names in the database are confidential. Judges have to sign off on the suspensions and confiscations, and someone who faces the loss of their permit and weapons can challenge the order. Cortland County Clerk Elizabeth Larkin told the Post-Standard the police confiscated the guns from a least one permit holder whose name was in the database. “We had another man who came in and voluntarily handed us his permit and gave his weapons to the police and said, ‘I don’t want them anymore,’†Larkin said. The size of the database troubles some mental health providers and patient advocates. “It’s bigger than I thought,†Harvey Rosenthal, executive director of the New York Association of Psychiatric Rehabilition Services in Albany, told the Post-Standard. “It sends a message to those who might need care that there are a lot of people who are going to be in a database.†Gun control advocates say the number of names in the database is small compared to the size of the state’s population, which is 20 million. “It only takes one individual to wreak mayhem and tragedy if they have access to a firearm,†Leah Gunn Barrett, of the group New Yorkers Against Gun Violence, said. “These are individuals who, under no circumstances, should have guns.†http://www.foxnews.com/us/2014/12/07/new-york-safe-act-flags-278-gun-owners-as-mentally-unstable/

New court decision could end California's restrictions on conceal-carry permits. Here is the information sent out tonight from IDPA headquarters: Date, Venue Change for 2015 IDPA World Shoot Because of the desire for greater accessibility for U.S. members, the bulk of our membership, we have decided that the 2015 IDPA World Shoot will be rescheduled to take place this coming September in Tulsa, Oklahoma, taking the place of the scheduled US Nationals. Originally planned for March 25-29 in Caguas, Puerto Rico, the 2015 IDPA World Shoot will now take place September 16-19 at the U.S. Shooting Academy in Tulsa, Oklahoma. When we originally planned the details for the 2015 World Shoot, IDPA’s second such international championship match, we looked to host it outside the continental U.S., selecting Puerto Rico as the destination. While Puerto Rico offers an excellent venue, and what would no doubt be a top rate competitive shooting and social event, IDPA mis-estimated the level of enthusiasm such a match outside the continental U.S. would generate among U.S. members. Our first priority is to deliver IDPA members a first-class championship event and right now the majority of our members, that would fill the match, are telling us they want that event to be held closer to home citing the still depressed economy as one of the reasons to limit travel. IDPA members that registered early for the World Shoot will be guaranteed slots at the rescheduled event in Tulsa. Additionally, IDPA has lowered the match fee from $275 to $225, which reflects the reduced costs of hosting the match in the mainland US. The Puerto Rico IDPA community continues to grow with their Caguas Challenge and the Puerto Rico Nationals match gaining popularity among major match competitors, and we are looking forward to possibly hosting an international championship in Puerto Rico in the coming years. IDPA HQ will work with Max and the Caguas club on the possibility of hosting a major match during the same time frame for those that still wish to visit this great club and location. -

I happened to stop by my local gun shop the other day and hidden in the gun case was a new S&W Model 929 9mm. This is one difficult gun to find at this time. Had a chance to shoot a few rounds today and this gun is really great to shoot. I shot 72 rounds of my IDPA 124 gr FMJ with a power factor of 128000. With the removable compensator on the gun I was able to shoot very fast with great accuracy. When I took the compensator off and put the replacement cap on the end of the barrel and the gun shot just as well. I do believe the gun is a little flatter shooting with the compensator on. I plan on shooting the gun in USPSA revolver division and the gun will be scored minor. I will give more updates later.

My last purchase from Bud's was on 7-29-14. I was not charged any sales tax.

In the past I have owned S&W model's 442 and 642. I have since sold both guns and now own a Ruger LCR .357. I like this gun much better than the s&w. To me it is much more accurate past 7yds than the Smith & Wesson's. I carry the gun with .38 special +P ammo. The .357 ammo I find too much for the gun.
