Gun Owners of America Political Victory Fund E-Mail Alert 8001 Forbes Pl, Suite 102 Springfield, VA 22151 http://www.goapvf.org June 30, 2010 Dear Friend of the Second Amendment, The Tennessee legislature recently overrode a veto by Governor Phil Bredesen on a bill to allow law-abiding Tennessee citizens with concealed carry permits to enter an establishment that sells alcohol. Bredesen vetoed this measure twice, which does not come as a surprise to most Second Amendment supporters in the state as the governor often speaks out of both sides of his mouth concerning firearms and self protection. Thankfully for Tennessee gun owners, Bredesen is on his way out and there is an opportunity to elect a real pro-gun leader to take his place. Gun Owners of America is proud to support Ron Ramsey for Governor in the Republican primary. Ramsey, the current Lieutenant Governor, displays a constitutional and historically accurate understanding of the Second Amendment and the threats that face it today. As a strong Tenth Amendment advocate, Ramsey believes that "We must have a Governor who can stand up to federal officials who want to erode our basic rights." In 1997, while serving in the state legislature, Ramsey carried a concealed carry bill that improved the state's right-to-carry. Ramsey's bill, which was signed into law, streamlined the application process so honest, law-abiding citizens would not have to wait up to a year to receive their permit. Ramsey's strong support of the Constitution and the Second Amendment stands in stark contrast to other candidates in the race. Bill Haslam, mayor of Knoxville since 2003, was a member of New York City Mayor Mike Bloomberg's gun-grabbing group Mayors Against Illegal Guns. As a member of the group, Bill Haslam's name was part of a 2007 letter to Senate Majority Leader Harry Reid and House Speaker Nancy Pelosi supporting a bill to prohibit the hundreds of thousands of people on the federal government's so-called terror "watch list" from purchasing firearms. Under the bill, the Attorney General is permitted to strip away the civil liberties of Americans without due process of law and without the accused even knowing the details of the suspicion. This provision was part of a larger bill that would have federalized even more gang and gun crimes, which properly belong at the state and local levels. In 2008, Haslam's name again appeared on a letter to Reid and Pelosi seeking to close the non-existent and misleadingly named "gun show loophole." This legislation would have led to the closing down of gun shows and opened the door to complete federal control of private firearms transactions. As soon as Haslam announced his bid for governor, he left Bloomberg's anti gun group with much haste. If that isn't the clearest sign of pandering and lip service, then we don't know what is. Another opponent in the race, Representative Zach Wamp, also has a problem with your freedoms. Rep. Wamp helped Sen. John McCain and liberals in Congress to put a stranglehold on free speech with the so-called Campaign Finance Reform Act (better known as the Incumbent Protection Act). When Republican opposition stymied the bill in 2001, the anti-freedom crowd circulated a "discharge petition" to force it on to the House floor. Zach Wamp joined a handful of other Republican turncoats to help pass a law that made it illegal to publish information -- such as what is contained in this letter -- within 30 days of a primary or 60 days of a general election. Rep. Wamp also voted against an amendment to the bill that would have at least protected the right of groups like GOA to widely disseminate voter guides during the "prohibited" periods. Of all the types of speech protected by the First Amendment, political speech was foremost on the minds of the Founding Fathers. Just this year, the U.S. Supreme Court recognized that fact and in Citizens United v. Federal Election Commission (a case in which Gun Owners Foundation participated) undid much of the damage caused by Wamp and his congressional allies. In this race for Governor, the choice for gun owners and sportsmen is clear. Ron Ramsey is a proven, effective and constitutionally minded leader who will stand up to all attacks on our right to keep and bear arms. Paragraph 2, Article VI of the U.S. Constitution states: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contray notwithstanding." I understand this to mean that properly approved treaties are a part of the "... Law of the Land;...". Treaties require 2/3 concurrence of the Senate present (Article II, Section 2, paragraph 2).

Nikki has been featured over the last year in a number of interviews and in the Tennessee Senate while she told the story of seeing her husband, Ben, murdered mere feet from her by a stalker. Nikki had a handgun carry permit. She did not have it with her because she and Ben were working that night in a sports bar as entertainment. Her gun was in her car as she watched her beloved repeatedly shot at point blank range by a stalker. Could she have intervened - perhaps. Hodge: TWRC wise to reconsider season cut Now that the Tennessee Wildlife Resources Commission has voted on the 2010-11 hunting seasons, part of the commission's June meeting will be devoted to . . . voting on the 2010-2011 hunting seasons. In a vote that, reportedly, had some commissioners confused, two weeks were cut out of the archery season for bears. Biologists with the Tennessee Wildlife Resources Agency had recommended a five-week archery season, but that didn't sit well with commissioners Todd Shelton and Eric Wright, who wanted the season cut to two weeks. Why the cut? Nobody really knows for sure, although Wright said something to Tennessee Wildlife Federation Executive Director Mike Butler about bears being wounded and not recovered. He made the assertion without any biological data to back it up. It also raises the question: If the commission is worried about bears wounded with arrows and not being recovered, what about deer? Should the commission revisit archery hunting as a whole? Or maybe it's just because some traditional bear hunters have some heartburn that their sport isn't quite as exclusive as it once was? Archery hunters who enjoyed the extended bear hunts last year - they bagged 162 bears in 2009 - were probably caught off guard by the amendment to the hunting season proposals because it had not been discussed until the Wednesday meeting. Wright did make a similar proposal at the commission's May meeting - which Shelton didn't attend - but it died without a second. It's not like the commission hasn't slipped hunters and fishermen in Tennessee a few mickies in the past, but Wright was appointed to the commission by Speaker Kent Williams, who has been making a lot of noise about the commission's poor communication with the public and the legislature. While Wright said he was concerned about wounded bears, many believe the real reason some want the archery season cut back is because dog hunters believe the bow hunters are infringing on their turf. While it's likely some of the bears bagged with bows would have been taken down by dog hunters, all but three of the 162 were killed on private land. Coming off a record year it appears Tennessee should have enough bears to go around. TWRC Chairman Mike Chase didn't like the way the amendment was presented with no public notice. Although the amended amendment, which cut the season by two weeks instead of three, passed 6-5, Chase is going to bring the issue back up. He's going to give the hunters time to comment on the three-week season and if enough don't like the change he will have the issue put on the agenda in June. If nobody says anything, the three-week season stays in place. The way the bear issue was handled was in contrast to how the agency/commission handled a proposal for duck blind drawings at four units of the Chickamauga Wildlife Management Area. Public input was taken, public meetings were held and despite some resistance from hunters who use the WMA, the proposal was approved. Nobody can come back on the agency/commission and say they had no idea what was happening. So give the commission a thumbs-down for cutting the archery bear season without the public knowing it may be cut. Give them a thumbs-up for realizing what they did and for giving the public an opportunity to comment. Now it's up to the public to let them know what they think. In other actions: Hunters will be required to check in big-game animals on the day they are killed. Internet check-in for bears has been eliminated to aid in data collection by biologists. Two new hog hunts were created on the Cumberland Plateau to allow hunting with dogs Oct. 2-10 and Dec. 31-Jan. 3 A hog hunt with dogs also will be opened in Monroe and Polk counties Dec. 31-Jan. 3. A computerized drawing system for blinds at Chickamauga's four units - Candies Creek, Rogers Creek, Yellow Creek and Johnson Bottoms - will be implemented before the season. The same system, the application process will be announced later, will also be used at Bogota and the new Thorny Cypress Wildlife Management Area in West Tennessee. The special season fall turkey and deer hunts have been changed to non-quota hunts in many counties, including Knox.

Ken Klukowski : Elena Kagan A third instance of Elena Kagan opposing Americans’ Second Amendment right to own a gun has now become public, and is sure to become a major issue in her Supreme Court confirmation hearings. And it confirms that President Obama’s gun-control agenda is to create a Supreme Court that will “reinterpret†the Second Amendment until that amendment means nothing at all. This year, no case on the Supreme Court docket is more important than McDonald v. Chicago, where the Court is deciding whether the Second Amendment right to keep and bear arms is only a right you have against the federal government, or instead if the Second Amendment (like most of the Bill of Rights) also secures a right you can assert against state and local governments. At issue is whether Chicago’s law banning all guns—even in your own home—is constitutional. When the Supreme Court considered its last Second Amendment case, District of Columbia v. Heller in 2008, then-U.S. Solicitor General Paul Clement filed a brief in the case, and then requested and received time to argue the federal government’s position in that case as to the meaning of the Second Amendment. When the McDonald case was argued before the Court on March 2 of this year, current Solicitor General Kagan argued… Nothing. Not only did she not ask for time during oral argument, she didn’t even file a brief (which the solicitor general routinely does in important constitutional cases—and the McDonald case is monumentally important). If someone asserts that the solicitor general shouldn’t file a brief because it’s a state matter as to whether the Second Amendment is “incorporated†to the states through the Fourteenth Amendment (which is the issue in McDonald) the record speaks to the contrary. The last time the Supreme Court “incorporated†a right from the Bill of Rights to the states, in the 1969 case Benton v. Maryland, the solicitor general filed a brief, and then (just like Heller in 2008) got divided argument time to express the government’s views in front of the Court. Why wouldn’t Kagan file a brief expressing the view of over 75% of Americans that the Second Amendment is an individual right, one that every American citizen has against all levels of government? Aside from her shocking decision not to file a brief in McDonald, we’ve learned that Elena Kagan was part of the Clinton White House’s gun-control efforts, where a Clinton staffer said, “We are taking the law and bending it as far as we can to capture a whole new class of guns.†Then it became public that when the Supreme Court was asked in 1987 to decide if the D.C. gun ban was unconstitutional (the same law that the Court eventually struck down in Heller), Kagan wrote to Justice Marshall on the Court that she was “not sympathetic†toward the argument that the Second Amendment doesn’t allow D.C. to completely ban all guns. Three anti-gun decisions. Three strikes, and you’re out. The bottom line is that Barack Obama supports the Chicago gun ban, a position he publicly repeated as recently as June 26, 2008 (the day the Heller decision was released). President Obama believes that there’s nothing unconstitutional about the city—or even the whole state—where you live completely banning you from having any firearms for hunting or self-defense, even in your own home. As my coauthor Ken Blackwell and I discuss in our new bestselling book, The Blueprint: Obama’s Plan to Subvert the Constitution and Build an Imperial Presidency, President Obama’s gun-control agenda is to create a Supreme Court that will repeatedly rule that whatever gun-control laws come before it are okay. No matter how severe the anti-gun measure is, the Court will say, “This is constitutional.†President Obama—the most anti-gun president is American history—has nominated for our highest court a close personal friend of his. And now we see that Obama has every reason to believe that his close personal friend shares his radical view on the Second Amendment, one that will work against the constitutional rights of 90 million American gun owners. Elena Kagan’s confirmation hearings this summer could get very interesting. America’s gun owners have a way of making their voices heard.
