This piece of tyranny is up for consideration in the US Senate now. Our Senior Senator is a co-sponsor of the Bill. It will allow the President to appoint an additional 200+ important positions to everything from Homeland security to Dept. of Education and Agriculture without "Advise and Consent" of the Senate. One has to wonder what was promised to Alexander to get him to co-author this tripe with Schumer? S. 679: To Remove ?Advise and Consent? A "similarly situated person of reasonable sensibilities" is anybody that is on that web site that you posted to, you must be aware that anyone with a computer MIGHT access said site. A decent lawyer can make a fortune off this tripe! -

From Article 1 Section 19 of the Tennessee Declaration of Rights " The free communication of thoughts and opinions, is one of the invaluable rights of man, and every citizen may freely speak, write, and print on any subject, being responsible for the abuse of that liberty." First, the "new" Public Chapter was unnecessary, the older version of TCA dealt with intentional Harassment, this new Public Chapter lays out the possibility that by posting a thought, image or picture, the individual doing so MIGHT cause distress, puts that individual at risk of being charged under the new law. Any individual who post a picture of a fish his grand child caught, a brace of birds taken on a hunt, a deer harvested, anywhere on the Internet, knowing that PETA has access to the Internet, can and (most likely will) be charged under this law, as any person should know that such posting would cause emotional distress to a PETA adherent. A text description of the actions required to achieve the possibility of such a picture might just as well be grounds for charges under this Act as well.Conviction under the Chapter might be difficult to achieve, but the threat (nuisance value) of reaction to what should be a Right is problematic. Will owners and operators of web sites be found complicit in such harassment? Should they police their forums as they are facilitating the display of an image in a manner in which there is a reasonable expectation that the image will be viewed by the victim? I would challenge you kickstand, to lay out any benefit this new change to the harassment clause of the TCA will bring? -

Not ignoring anything. If I post something, or any one else does for that matter, something on a web page, and a politically connected individual takes umbrage, then I am put to the task of defending a position. Were Politicians honest, and had they the best interest of the People at heart, this would be of less concern. This can, and will be turned against Liberty if allowed to stand unaltered. -

Here are the changes to TCA 39-17-1308: Per these, not just pictures, but text as well can be construed to be offensive, these being the operative words: "Electronic communications service" means any transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic, photoelectronic or photooptical system;". Now, the local DA can be led by someone on a web site to push charges for nearly anything. It is over reaching in it's breadth. And from some of the lawyers I have spoken with, flies in the face of the Constitution. -

I have, it is not good. Methods of communication referenced in subdivision (a) (1) are: text messaging, facsimile transmissions, electronic mail or Internet services. The Local DA takes a shine to you being in the Cross Bar Motel, and you post a picture or text on the net, you can spend a lot of money to stay out of jail. -

I agree, and in the end game, each, be it Nation or individual, has to make a choice, for or against Israel. -
I agree Fallguy, this off election year was set to show the world that Tennessee Republicans had no connection to the Firearms advocates. The State of Tennessee Republican party, connected as it is to the Nation Party through Alexander and ex Governor Winfield Dunn strove mightily this session to distance itself from 2nd Amendment advocates, and tried to show Big Business that they had their interest at heart. That Conservative grassroots endeavors was the least of the Republicans focus was meant to position itself as far to the Moderate position as possible. They can now point to the year as giving the Constitutional Conservatives the cold shoulder, in a year where it was not important to seek their support. They will remind us, we lost no ground, and we should be happy with that. Their perception is, that the redneck working stiff has a short memory span, and if next year they can trot out support of an issue or two that panders to the interest of the great unwashed, they can garner support for their elections again, then so be it. They fully lined up behind every issue that was fostered by Corporate sponsorship, and surely the dimwitted gun owners will take a full year of non support as OK as long as the year we pull the tabs in the ballot box, they at least promise to support our issues. As long as we are willing to suffer another few years of them working on the issue they purport to champion, and we are willing to send our dollars to their efforts, then everything is fine. I have discussed this with real supporters of our issues, and they are as mystified and disenfranchised as am I. Their numbers are few, as Legislators who really take our interest as important. The ones who understand the reality of politics tell me till the numbers of calls, letters, visits and dollars increase on behalf of our cause, we are beating our chest to no avail. Attention and money talks and BS walks.

As long as you don't mind walking in to do that hunting, fishing and bird watching. As soon as it gets the Wilderness Area designation, all vehicular traffic, even bicycles are prohibited. Also, no logging of any type, rotational or any kind will be allowed, meaning climax forest that supports very little wildlife. Still researching, but it appears that unless you like to hike and carry everything in and out, you are precluded from entering. -

Does adding "Wilderness Designation" to 20,000 acres of Cherokee National Forrest limit the ability of the average Citizen to utilize the area? Will it add to the ability of hunters to enjoy their Constitutional Right to hunt in that area of Tennessee, or will it restrict it? Is it pandering to U.N. Agenda 21?

How long before they start mandating a certain number of purchases WITHOUT selling them back off as a crime? Say he had bought the 210 firearms since 1995, but had sold none, with the new powers vested in the BATFE under the Patriot Act, they will have access to the sales records. How many guns constitute too many in the current administration's eyes? -

I want to see the real data. Were they manufactured in the U.S. and shipped to a third country under auspices of a U.S. Government give away to those third party countries, then sold to Mexican cartels by those third parties? I suspect that once the truth comes out, this is not Joe Six Pack making a few bucks selling AR 15's a couple at a time.

Try it again, no idea what happened. And Sgt., I think it has more to do with driving the economy off the cliff, and spreading the misery than trying to keep the fat cats flush, but that is just me.

From the Bill: (a) A person commits an offense who intentionally: (4) Communicates with another person or transmits or displays an image in a manner in which there is a reasonable expectation that the image will be viewed by the victim by [by telephone, in writing or by electronic communication] without legitimate purpose: (A) (i) With the malicious intent to frighten, intimidate or cause emotional distress; or (ii) In a manner the defendant knows, or reasonably should know, would frighten, intimidate or cause emotional distress to a similarly situated person of reasonable sensibilities; and ( As the result of the communication, the person is frightened, intimidated or emotionally distressed. -
Simply amplification of the class structure in TN. SOME citizens get more privileges than others. Helps if you have the ear of the Legislature, us 'ol common citizens need to pony up the money via taxes and hush, they have OUR best interest at heart.
