Under 39-11-611. Self-defense. [2] [C] [c] Any person using force intended or likely to cause death or serious bodily injury within a residence, business, dwelling or vehicle is presumed to have held a reasonable belief of imminent death or serious bodily injury to self, family, a member of the household or a person visiting as an invited guest, when that force is used against another person, who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence, business, dwelling or vehicle, and the person using defensive force knew or had reason to believe that an unlawful and forcible entry occurred. Better make sure they are not Law Enforcement: [d] (4) The person against whom force is used is a law enforcement officer, as defined in § 39-11-106, who enters or attempts to enter a dwelling, business, residence, or vehicle in the performance of the officer's official duties, and the officer identified the officer in accordance with any applicable law, or the person using force knew or reasonably should have known that the person entering or attempting to enter was a law enforcement officer. More complicated than one might imagine. -

There is no comparison to the quality of cleaning, the process removes all dirt, powder residue, and especially the primer residue, which I think is the best advantage. Brass is as clean on the inside as outside. As far as longevity of the brass, I have 100 pcs .25 -.307 Ackley Improved wildcat brass that I have run hot for 16 loadings so far, (I also anneal ever 4 firings, which I think makes a difference as well) without having to trash any, and am at 12 loadings on Winchester brass for my H-bar that is specific to that weapon, out of 200 pcs I believe I have lost 2 or 3 to neck splits only.

If you want to see someone else hold the Speaker's position there is a method of achieving that. Of the triumvirate that is the Leadership of the House, Harwell, McCormick and Maggart, only Maggart has opposition in the primary, (no candidate will oppose Harwell in her Democratic district, she leans too far to the Moderate/Left for that to occur). Lt. Col. Courtney Rogers is viable, and I believe, far superior in character to the current Caucus Chair. If that seat is taken away from Harwell's Lieutenant, (Maggart), it will change the metric of the House. House freshmen were browbeat last year to vote for Harwell as Speaker, if we can show that there is State wide initiative to change the view at the top, then the Conservatives have a chance of seizing the reigns and turning the Legislature away from the Alexander direction that Haslam and Harwell are pushing. -

Seeing what happened in Indiana this year with then sitting Senator Dick Lugar defeated by a true Conservative fostered by various grass roots organizations. That power lays in the hands of Tennesseans as well, and there are a few instances where we can make huge differences in our body politic, IF we join together and work towards the common goal of taking away the reigns of power from the Moderate/Liberal establishment controlled legislature. A truism for the ages "Money is the mother's milk of politics", as stated by Jesse Unruh, (Speaker of the California Assembly from 1961 to 1968), and not just of politics, but politicians as well, defines the game. Right now, "Big Business" is controlling just about everything coming out of Nashville, because they are paying for it. But, all they can do is finance the mailers and commercials, they can not vote. Should the rabble decide to engage with their pitiful $10.00 and $20.00 donations, their time and energies, we could in fact, change the metric with which our State government is controlled, if we but heeded the first two Sections of our Tennessee Constitution: § 1. Powers of people That all power is inherent in the people, and all free governments are founded on their authority, and instituted for their peace, safety, and happiness; for the advancement of those ends they have at all times, an unalienable and indefeasible right to alter, reform, or abolish the government in such manner as they may think proper. § 2. Doctrine of non-resistance That government being instituted for the common benefit, the doctrine of non-resistance against arbitrary power and oppression is absurd, slavish, and destructive of the good and happiness of mankind. What controls our current legislature IS power, the lust for and wielding of it, and it occurs at our pleasure, for we are the true arbiters of it. -

That not only means the Federal branch of government, but the State as well. I personally believe that we can have a more telling effect, via Local and State governments for our daily lives, than we can regarding the Federal branch. There are races right here in Tennessee that will bear immediately on the Freedoms we enjoy, (or not), by changing out the Moderates/Liberals that currently have a stranglehold on the legislature. -

It boils down to money, if the gun owners donated enough cash to those who seek power in the legislature, they could have their way, but to this point, the gun owners of this State are not invested enough to sway decisions. Tennessee operates on the Golden Rule of politics, he who throws the Gold at the legislature Rules. -

Uh, doesn't PruneYard Shopping Center v. Robins, set a president refuting that assertion? In this Supreme Court case, the prevailing opinion says that if a State has protections which exceed the Constitution of the Union, then those Rights are protected. In this specific case, California's Constitutional protection of free speech rights prevented owners of a private shopping center from prohibiting the circulation of petitions on the owner's property. Despite the fact that individuals circulating petitions may have physically invaded the owner's property, the Supreme Court held that California's requirement that property owners recognize state-protected rights of free expression and petition clearly did not amount to an unconstitutional infringement of appellants' property rights under the Takings Clause, as the invasion was not permanent, and in fact did not impede the Owner's ability to use the property for its intended purpose, citing that the Owners having failed to demonstrate that the "right to exclude others" is so essential to the use or economic value of their property, and permits individuals reasonably to exercise free speech and petition rights on the property of a privately owned shopping center to which the public is invited. This decision was cited in both the Federal Tenth District Court of Appeals re the "Parking Lot Bill" in Oklahoma, as well as by the Federal Seventh District Court of Appeals in Florida re the same type of challenge in a similar suit against a similar law. Just as our Liberal Attorney General opined in the Judiciary Committee in this years dust up in the legislature, found that the Employee Safe Commute bill in its original broad form was Constitutional. He found that the General Police Powers of the State, if in fact they have raised the bar above our Union Constitution with respect to firearms issues, have merit, should the State decide to supersede Federal constraints. -
The gay marriage thing is the most giant of all straw men. It reeks of furthering government control of every facet of life. Concerns about "benefits" simply buys into the Nanny State mentality. If one is concerned about gifting on personal property in a manner consistent with one's wishes, perfect a will. This whole discussion is achieving the aim of the administration, obfuscation of issues of merit. As long as we are focused on such topics, we are NOT paying attention to the man behind the curtain...

Mr. Harris is very upset and believes I accused him of not trying to make revisions to the parking lot bill. Evidently Mr. Harris was talking with some Republicans that agreed with him, but I was talking about the ultimate leaders in the house and senate, Lt. Gov. Ramsey, Speaker Harwell, Rep. Maggart, Rep. McCormick, Rep. Mcdaniels. The facts are simple the parking lot bill did not have enough votes to pass. The problem with the bill was the private property rights regarding private employee parking lots. If there were any statements made by me in your paper that Harris was not meeting with legislators that was incorrect by mr Harris statement. He evidently was not meeting with the correct house and senate leaders. If he had the bill would have passed. If I made an incorrect statement about Mr. Harris I am very sorry. There are 99 members in the house and 33 senators, it is impossible for me to know everyone Mr. Harris meets with. I still support N.R.A. and 2nd amendement, but also defend Private Property Rights and I have personal opinions the same as Mr. Harris has opinions. Please feel free to run this letter from Mr. Harris and my response. Again , Mr. Harris worked hard to pass the parking lot bill, but it failed to pass this session. Here is the fact, every Republican that did not stand up to Harwell in the "Secret Caucus" vote was against the bill, else they would have "Stood their Ground" on the Constitutional and House Rules issues. Some one correct me, but I can not remember a bill that made it to Calender and Rules that did not get a floor vote, they may have failed, but they get a vote once they have made it out of the regular committee jungle. Only House Leadership can stifle that, and, only when the Caucus is compliant. TCA code 39-11-611 plainly states that a vehicle is considered the same as your home as far as personal defense is concerned, under the "true man" rule, you have the same Rights in that setting (ordained by the TN Legislature) as in your house. As the bill under consideration (HB 3560/SB 3002) simply dealt with "keeping" a legally owned and permitted weapon in the private vehicle, unhandled, not displayed or "worn", they, the legislature, failed in its oath to uphold and protect the Constitution. The only power given to the legislature to affect firearms issues is their self imposed power to regulate the "wearing" of arms. Says so in Article 1 Section 26: “That the citizens of this state have a right to keep and to bear arms for their common defense; but the Legislature shall have power, by law, to regulate the wearing of arms with a view to prevent crime.†Past the failure to understand or protect the Constitution, I believe that all but 4 House members are guilty of Official Oppression, as a public servant acting under color of office or employment who intentionally denies or impedes another in the exercise or enjoyment of any right, privilege, power or immunity, when the public servant knows the conduct is unlawful. (TCA 39-16-403) I guess they COULD use ignorance as a defense, but only that. -
She needs to take remedial course in English first. Harris did not say he wanted to crucify Maggart, his exact words were "Rep. Debra Maggart's political career needs to end much as the Romans crucified criminals...". The apostrophe specifically relates to the career, not the person. And the use of the word " Symbolically" will be lost on the simple minded as well. Of course, expecting some one who cannot get a grasp of the Constitution to understand allegory WOULD be a difficult proposition...
