How about the case in Texas Nov. 14, 2007 where the 61 year old shot and killed two burglars in the back as they were leaving his neighbor's home, with a detective watching while he did it?  (Joe Horn) He was on the phone with LE, them telling him to stand down, a plain clothed detective in an unmarked car at the curb watching and waiting for back up when Mr. Horn ordered the two men to halt and then proceeded to kill them when they refused.  http://abcnews.go.com/TheLaw/story?id=5278638&page=2 Mr. Horn was "No Billed" by the Grand Jury.

I agree he should have shot for center mass if he was going to drop the hammer, or at least said that he did, unless he was simply trying to NOT have to kill the man but use his weapon to stop the threat.  But who knows what is in a man's mind?  I have  brother-in-law who upon his first dove hunt after 4 years in Viet Nam, could not bring himself to pull the head off a crippled bird. He brought it me and laid his shotgun down and walked to his truck and left, never said a word. (we have not talked about it since either, as his Dad, who was a WWII Vet asked me to keep it between us girls.) I seem to remember recently, a number of "professionals" throwing 102 rounds at a pick-up with two female paper carriers in it, resulting in two hits on the 74 year old and a scraped finger on the other.  This guy would have been far better off to have simply said he missed instead of admitting to firing a "warning shot", I think he could have sold that, Oregon is not that far from California is it? If they do not charge them with not verifying a target, or poor marksmanship, don't think they should charge this guy.

A favorite of mine (I have the American Made version of a ceramic cooker, the Primo http://primogrill.com/) is Pepper Stout Beef. Couple of chuck roast, a little salt, pepper and some ancho chili powder. Pop it on the grill offset (I have the d-plates to shield the meat from direct fire) at 225° till the internal temp gets to 165°. (have to admit to running the smoker with a DigiQ DX2 http://store.thebbqguru.com/weborderentry/DigiQ%20DX2 a little spendy, but wonderful control of temp for long cooks) I then take a throw away aluminum pan and cut up several bell peppers, normally a green, yellow and red one each, a large yellow onion and a couple of large jalapeños seeded and chopped, then add a full Guinness, rest the meat on the veggies and cover the pan tightly. I return to the pit till the meat hits 205°, then pull like pork and return to the pan and put back in the pit uncovered for another thirty minutes or so, shifting the meat to get a little more smoke. Toast some buns and pile the pulled meat on and add some cheese. This is what is left of 10 lbs after the kids ate and hauled off last weekend.   Not trying to be argumentative here, rather trying to understand what I have been told by attorneys and prosecutors here in TN.  I thought I understood that TCA 39-11-611, by statute, gave a non criminal who was where they had a "right to be" and not involved in criminal activity in specified locations, a presumption that anyone who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence, business, dwelling or vehicle, and the person using defensive force knew or had reason to believe that an unlawful and forcible entry occurred may assume to have held a reasonable belief of imminent death or serious bodily injury to self, family, a member of the household or a person visiting as an invited guest.  The continued insistence that one must be in the grip of a perpetrator, with a shiv in the ribs prior to being justified in TN "before threatening or using force against another person when and to the degree the person reasonably believes the force is immediately necessary to protect against the other's use or attempted use of unlawful force." is factually inaccurate, or do I not get the gist of the law as written?   As these are State statues, would they not preempt any "opinions/bias/education/community standards" should one appeal any conviction from a lower court level to one at the State?        

  So, are you saying our Public Servants, those charged with (and paid to protect) the general population are more concerned with their conviction numbers than adding years to the sentences of real bad people, the kind that uses a firearm in the commission of a felony? Kind of negates the need for "enhanced penalties" except as a form of campaign advertising, does it not?

I have also met and done a little collaboration with Glen Beck, does not make me any less of a concrete finisher or high school/college instructor, nor lesson my objectivity (at least on that single account).

  Somebody is making a good living off of that. I bet there are a lot more prison beds now than in the 80's as well.  More prosecutors, more defense attorneys too I would presume. Crime is a Big Business it seems.

I don't think that is how it works in TN.  How then did the guy in the wheelchair in Clarksville or close to Memphis, can't remember which, get by with shooting the Officer through the door?  Or do I dis-remember the facts of that occurrence?

  Realistically, aren't most individuals who write and promote books trying to sell books, or an idea or a belief system?  Would anyone so invested in attempting to gain remuneration for advocating their particular beliefs be so judged?  Because Mr. Lott is trying to make a living espousing a type of belief, does that completely negate his objectivity?

I concur, using history that I can remember in West TN, the lady that shot her husband in the back and killed him (Mary Winkler) was NOT charged with the additional crime of using a firearm in the commission of a felony, even though she was convicted of felony murder. I suspect that the percentage of those who use a weapon in the commission of a felony are charged with the extra crime about as often as felons who attempt to purchase weapons are charged for that.

  Sen. Doug Jackson (Democrat from Dickson) was one of the most ardent supporters of firearms issues while he was in office, as was Rep. Ben West.  Republicans do not have a lock on supporting our firearms Rights.
