39-11-611 says vehicle is the same as you home, business, curtilage, dwelling, or residence. Vehicle (meaning any motorized vehicle that is self-propelled and designed for use on public highways to transport people or property), roads and parking areas in any "park" is "public" I would think, and as such is treated as your castle and under the vaunted "a person who is not engaged in unlawful activity and is in a place where the person has a right to be" dictum seems it would be allowed, but my thoughts and a buck fifty will get you a cup of coffee...

Not aware of any "new" HCP laws regarding vehicles...last years change allowed "keeping" your legally owned or possessed firearm in a vehicle an individual has the legal ability to operate, whether you have a permit or not. Someone will correct me if I am wrong, but I believe you will be able to have a firearm in your vehicle if you can legally posses the firearm and are legally allowed to operate the vehicle in a County Park. That does not allow for carry on the person outside of the vehicle, UNLESS the municipality allows permitted carry, and one has a permit.

We have a supermajority in both houses of congress in TN to go along with the governor's mansion. We passed far more restorative measures re Article 1 Section 26 when we had a Democrat for governor and a basic 50/50 split for the legislature . The more one sided it gets, the less we get done in Tennessee. NRA loves Lamar Alexander, the only Republican Senator to vote against the permit carrier to be allowed to keep their lawfully owned firearm in a Federal Park. We shgould not back parties, bur rather principals, and individauls. -
If you had a real Conservative Leadership group it would be one thing, but Haslam has shown that he is willing to put an iron foot down on "expanding gun rights", which in truth should be termed "restoring gun rights". Till the current Leadership group which holds monetary sway on the big PACs changes, the little people will do what the Big Man says. Always remember politicians care more about getting re-elected than any other single thing.

Under the "imitation firearms" portion of the amendment (which makes the bill) in fact that would be a criminal act. I "think" the amendment was structured to keep "Reenactors" from staging events close to schools, would not want the children to learn a little history, or see what an actual battle might look like, or so it was espoused to me by an aide close to the bill this morning. SUMMARY OF AMENDMENT (004275): Deletes all language of the original bill. Authorizes handgun carry permit-holders to carry handguns within any public park, natural area, Historic park, nature trail, campground, forest, greenway, or waterway or other similar public place, including any buildings located within or on those areas, that is owned or operated by state or local government. Removes from statute provisions related to required signage indicating the penalty for the unlawful carrying of a handgun in such areas. Removes the authority of local governments to prohibit by resolution the possession of handguns by valid handgun carry permitholders in parks or recreational areas owned or operate by the local government. Removes from statute provisions related to the replacement of, or the changing of, existing signage indicating that firearms are prohibited. Prohibits the carrying of explosives, explosive weapons, permanently disabled firearms, hoax devices, imitation firearms machete, or swords openly within 150 feet of a school. Creates a Class A misdemeanor for any such offense. Prohibits any state department to change, remove, or replace signs as a result of this act prior to the time the signs are regularly scheduled to be changed, replaced, or removed, or are required to be changed, replaced, or removed by any other law, or due to destruction or theft; provided that the General Assembly may specifically provide funds for the purpose of removing or replacing signs in the general appropriations act. -

Fat finger disease, HB 0410/SB0369, deals with Elder Abuse, makes aggravated stalking of a person over 65 years of age a Class E Felony, like the same for one under 18 is.(moves it up from a simple misdemeanor) Got out of House Health subcommittee today, headed to full Health and then Finance. Has a fiscal note, but might just squeeze by at end of session, maybe. If not this year, will be back pushing it next year. Promised my Mother before she died I would get it done. -
If you will notice, the "Constitutional Carry" bill IS that Omnibus bill. Daring this legislature to vote against a bill that truly expands firearms rights when most who would support such issues sit on their hands and do nothing does not scare these folks one small little bit. They bold faced stole the "Right" to vote for Supreme and Appellate Court Justices with the electorate's eyes wide open. the have billions of dollars, and Fred Thompson and TV and Radio. It will in fact take a Herculean effort, ala the fight against the Income Tax to ever make a change, and that was 20,000 people at the LP, and a credible threat to legislative seats. We did not even get Steve (Naifeh Eight) McDaniel, he is Beth Harwell's right hand man. We are going to have to get a lot more folks engaged, walking the halls and making their legislators fear reprisal via primary opponents. I know how my elected reps are going to vote if they ever get a chance, and I see they are cosponsoring the right bills, if everybody could say the same we could get something done. As it is, Don Quixote is on the way to pick up Sancho Panza for another round of tilting at the windmill that is Bill, Beth and Ron, who will form up with me?

Very interesting conversation with the staff person for Chairman Coley. She said they were in the Speaker's conference room having their "regularly scheduled" pre-meeting of the session related to House Civil Justice sub, as this week is the last calendar for that auspicious group. Seems the Speaker is aware, and is party to the meeting I would think beings it is in her conference room...

No actually, I let the Sheriff and the Judge know that I would file charges against the Judge for "Official Oppression" that same day, had a friendly Legislator make the same call, (as it takes a legislator to file the charge), the "instrument" was rescinded post haste. I watched the Duputy read the new order to the "neighbors" which stated that I was able to carry on my father's property, as it was not posted against my doing so, and that he (Father) was restricted from bearing arms only within 200 feet of the mutual property line. As I was not party to the law suit, there were no distance restrictions placed on me. This situation is coming to head via HB0419/SB0369 which will preclude another family from having to bear shuch BS against their 85 year Former 'Tennessee Teacher of the Year' Mother from convicted meth manufacturers. It is up in House Health subcommittee tomorrow, I will be testifying. -

I am the furthest thing from a lawyer, but consider this: They popped the whole legislature for Ghost voting, (remember, buddies covering buddies when one was out so they could draw their per diem, had them on tape for that one too) Madam Speaker was accosted by the "Press" and that fraud was forgotten in one news cycle. When you hold the podium, you make the "Rules". I well remember when the judge in my Father's case against the meth thugs that tried to "adversely possess"=steal his property, issued an order that my Father could not carry a firearm on his 26 acres until the case about who owned the property was complete, oh, and by the way, he so ordered that I could not either. I challenged him as to the Constitutionality of that Order, and he explained to me that it was "his" court and he could do anything he wanted. It did not work out well for him, by that is the mind set they all have. -

Some here remember the fight we had over the State income tax. It tool a lot of people, but we got it done. These issues are won on a face to face level INSIDE Legislative Plaza. If you you want to make a difference, you will have to show up. As long as they can count on the media to take their part and advocates do not show the numbers needed to push an issue, they win, every time. There were 565,646 hunting license purchased last year, and 480,000 plus handgun carry permits. There is some overlap, but folks, that is a big enough number to make them sit up and listen. If we got 20,000 at LP on "Gun Bill Day", I bet that would make a HUGE difference.

The Employee Safe Commute Bill in 2012 had a much better way of determining this, simple prevailing party wins legal fees from the other. It was worked into the language and passed the committees to be killed by Leadership in a closed door caucus meeting where supposedly a vote was taken. They then stepped out and killed it in Calender and Rules. Y'all keep on loving your Republican Supermajority. -

And if you have to get out of your vehicle, sans permit you have to leave it there, unless you are under attack, and THEN you can possess it outside the vehicle, but you had best be able to prove that you were in a life or death situation. In addition, you can still be fired for having it in your vehicle, regardless of the "Guns in Cars" bill passed last year.
