As such, it follows the order of the 10th Amendment, which reads "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."   As the 2nd Amendment does not give the federal government "United States" the ability to regulate firearms in truth, and does in fact limit it by saying the federal government may not infringe on the ability of the People to keep and bear arms, it is in fact the sole prerogative of each of the various States to order the ability of their Citizens to keep, bear and wear them or not. Our State says in Article 1 § 1. Powers of people That all power is inherent in the people, and all free governments are founded on their authority, and instituted for their peace, safety, and happiness; for the advancement of those ends they have at all times, an unalienable and indefeasible right to alter, reform, or abolish the government in such manner as they may think proper, and Article 1 § 2. Doctrine of non-resistance That government being instituted for the common benefit, the doctrine of non-resistance against arbitrary power and oppression is absurd, slavish, and destructive of the good and happiness of mankind. Pretty clear that whatever we as Tennesseans desire shall be the deal, not what some government hack in lust for Power wants, if we the People are strident enough in our call out to our elected employees and serious enough about our calling. Dr. Suzanna Gratia-Hupp said it best I think when she described her view: "How a politician stands on the Second Amendment tells you how he or she views you as an individual… as a trustworthy and productive citizen, or as part of an unruly crowd that needs to be lorded over, controlled, supervised, and taken care of."
  3. As such each State had the ability to decide what level of Liberty is allowed its Citizens, and gives the individual the power to "vote with their feet".  Maybe Oregon's rule of law would better suit your taste over this backwater redneck one.

The differences among statist systems are only a matter of time and degree; the principle is the same. Under statism, the government is not a policeman, but a legalized criminal that holds the power to use physical force in any manner and for any purpose it pleases against legally disarmed, defenseless victims. I get what Statism means and is.

Present Not voting Republicans Smith, Swan and Mark White. Democrats in favor Dunlap, Hawk and Windle. Senate Vote Of the Senate Republicans, our friend Overbey was the single no vote.

The registry that you think is permissible is the quickest way to achieving the disarming of the People.    
  8. I wouldn't be opposed to it, but I not going to push for it. Consider me neutral on the subject. Though I can see the benefit of using a registry to trace a gun to determine if someone is buying guns for criminals once a registry has been in place for a while. Wow, and you said you were not a Statist. I do not think the word means what you think it does.
  9. My problem is I buy guns, but never sell them...is there a law against that outside of SWMBO's rulings?
  10. We have a bad case of that disease in Tennessee as well.  One would think that Rep. Jim Coley should be counting the days down to his ejection from the house, but we will see.  Steve McDaniel, last surviving member of the "Naifeh 8" is currently Speaker Harwell's bestest friend, her appointed Deputy Speaker and sits athwart the Finance Ways and Means Sub and full committees, along with Charles Sargent, if they can gin up a "cost" to any bill, they do the Speakers will, damn the desire of the rest of the House.

  13. Evidently Charles Sargent did, Chairman of House Finance, Ways and Means Committee.  They funded a lot of stuff that was over $100K, like $120Million for a new Museum Downtown, but hey, Museums write a lot of checks to campaign funds...
  14. It is the same as in a business, if your are notified, you have the opportunity to leave without being "guilty", failure to do so after notification is like in a business, you would guilty of criminal trespass there, in a park if you failed to leave you would run afoul of 39-17-1351.

I think, and will have to verify, that the GA could override a veto in the next year, as it is still this General Assembly (109th Session of), odd years are just part of the same session that ends in even numbered years.  He would get his spanking in January, he will not do that I don't think. Made a call, I was correct, next January is simply an extension.  Even my bill HB0410, (Elder Abuse bill taking "aggravated stalking" to a Class E Felony from a misdemeanor) while relegated to Finance sub in both houses, is still alive and I do not have to start over (rolled to the first calender of Finance next year).  "Uncertainties" at the end of an even numbered years is a death knell, but this year Parks survives to be overridden if the squishy governor vetoes.

  17. Well, that took about 17 forevers...and yes, they passed the Majority Report of the Conference Committee, squirt gun gone, carry at legislature gone, but no more City/County opt out.  Now, on to Senate.
  18. No, and most likely they will not.  Have to listen to Sargent lie and Fitzhugh prattle.  They have to get through appropriations, and everyone, us included knows what is going to happen (Sargent and Haslam get their way), but they have to talk long enough to postpone 0995.
  19. Does not look like they will get to 0995 today, they will run out of time debating the car insurance bill. If the House does not simply go into recess if they pass it in the first place, instead of adjourning, it is dead anyway.  If they recessed instead of sine die, they could reconvene and override, otherwise is is simply a wink and a nod to the governor and a finger in the eye of the People as he vetoes and they all get together for a drink and a laugh as they draw plans to build the Museam...
  20. So, I am guessing that you would not be opposed to "registration" of every firearm?  That is what private background checks is about, building that registry.

  22. And just how do you propose to do a background check at time of purchase for a private sale?  Do we give in to a background check to give a firearm to a loved one, to will one to a child? Where does your Statism stop?
  23. The "Intent" was to force it to fail with the Fiscal Note. My question, was it proffered before or after the vote in the Senate, had to be after, as the amendment was put on in session.
  24. I found it interesting that Rep. Goins had the tiller for the House side instead of Harrison (sponsor), who if I remember correctly did not speak a word, (other than "Aye")? By the way, I like that young man (Goins) he has the Right Stuff.  Van Huss, the Hill brothers, I see some new blood headed the correct way!
