Released - Monday, December 26, 2011 The Obama administration has decided to eliminate a 1998 restriction on the sale of guns to foreigners, claiming federal law does not allow the government to have different gun-control rules for noncitizens. In a letter to firearms dealers, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) said it would no longer require sellers to obtain proof from foreign buyers that they have lived in the state for 90 days. The rule was originally instituted after a disturbed Palestinian, 69-year-old Ali Abu Kamal, admitted to the United States on a legal nonimmigrant visa, bought a 380-caliber Beretta semiautomatic handgun in Florida and, on the observation deck of the Empire State Building in New York City, shot to death one person and injured six others.

The lesson here is that the current Supreme Court is letting laws (Obamacare) stand on their own. Robert's said if you want different results, elect different legislators and governors, (or, scare them enough to make them do the correct thing Constitutionally). This is the year, the sentiment is out there Trump has raided issues, and terrorist have acted in such a way lately to raise the anti for politicians. I started walking the halls of LP yesterday, it is time to be heard. Lame duck ineffectual governor and the scuffle for that seat has already begun. Make hay...

Cities can't be sued for such, they have qualified immunity. They could only be sued (successfully) if they were part of, or party to, or had knowledge of illegal activity taking place on public property and did nothing about it. You get your car stolen at the fairground at a lingerie show, you can't sue the City for its value. You get robbed and they take your Rolex, you can not sue the City to get that value back, get your teeth kicked out, they will not pay for your pablum... Just try suing them because they created a "gun free zone" and you were denied your Constitutional Right to bear arms for your defense because it made them feel good to disarm you. You could pay an attorney to file suit either way, you will not win. -

The West TN Regional Chapter of the Tennessee Firearms Association will hold its Next monthly Stated Meeting October 13, 2015 at Brooks Shaw Old Country Store, located in the Casey Jones Village, Jackson Tennessee. Our room will be available at 5:30 P.M. for those wishing to share a meal and fellowship. There will be a short legislative update beginning at 6:45, with the Featured Speaker to follow at 7:00 P.M. This month we have State Senator Mark Green as our Speaker. Sen. Green is a Physician and former Army Ranger who was the Dr. who took Saddam Hussein into custody upon his capture. Membership is not a requirement to attend, all are welcome.

We are now building the list. I wanted to file it, and am fleshing out the requirements as we go, I am not an attorney, but I am interested in getting to the point where we can be effective with the suit (I am seeking council as this progresses). One would think that he was among compatriots here, not before the bench yet. As you can tell from the thread, I am working my way though this, and as always, seeking interest is the first order of business in my mind. You want to file, jump in and have your own way.

It is my consideration that if we do not sue at this point, some judge will be able to point to the acceptance by the general population of the violations of the law as reason to allow such actions to occur, pointing to the fact that the governments had acted without restraint from the people. I am no legal scholar, but the time seems right to act.

At this time the names of the attorneys are being withheld. To answer the question regarding standing, "Ideal plaintiffs live there or nearby AND actually attended or attempted to attend the fair."

Pretty sure that being a resident of Knoxville Proper is the requirement, but I have posed the question to the attorneys. Do not think having been turned away is a requirement. If I lived there, I would certainly have been intending to go, till the Mayor violated State Law by fiat and I decided it was unsafe...

TFA is looking to file suit regarding the Mayor and City of Knoxville re the Parks issue. We have a fund that is specific for suits of this nature, with enough money to file the paperwork. We are coming off of a legal battle with the State, where they alleged that we were a Charitable Organization, and as such, subject to registration and special requirements for donor information. We were successful in fending off that attack, but are under strict scrutiny as to where we get funds to operate, as of this time we are limited to seeking contributions from Members only. We are currently looking for plaintiffs that meet the specifications for "Standing" in Knoxville. If any are interested, please PM me here or e-mail per my address listed on TGO.

That rift has been repaired, Rep. Andy Holt is helping me start a Chapter in Weakley County. He and I share spots on the radio. If you ask him he will verify the fact that he is now supporting the TFA, to the point that he donated two of his tobacco stick flags for our auction this Saturday. John and I have different delivery types, but his knowledge of the issues is as good as I have ever seen. I do a lot of the face to face now, and in a few years when I am able to retire, I will have a much more visible role at LP. I can promise that I see less than a handful of activist each year, and I spend at least 15 days (will be 20 this year as I just topped 20 years at work so I get an extra week of vacation, and I have for the last several years spent it all up there) during session walking those halls. I know the firearms friendly legislators, and I know the snakes. With the exception of the Speaker of the House, I get audiences with committee chairs and even still am on friendly terms with the Lt. Governor. I welcome any help, unless there are tons of money to pass out, (and we do not have that stash) Citizen activism is the only tool we have, and one or two guys do not sway the Chamber money loaded majority, unless they can be painted into a corner by shining light on their actions. If we had one true activist in every district of Representatives and Senators, wearing them out by public speaking, (I will do my 21st and 22nd event next month in Dyer County, at the Rotary and the County Republican Party meeting respectively). I do a radio show on average every two weeks. Like John, I do not get paid for my gas, meals or time on any of the trips I make. If we had more to help, John would not have to shoulder the entire effort of confronting recalcitrant public officials by himself. However, there can be no doubt that John Harris has done yeoman's ervice to the effort over the years, he just hates a liar, and talks bad about them when being silent is the easier thing. Perhaps the problem in not John Harris, but rather the lying, feckless mouther's who feign support for the "2nd Amendment" when they are really firmly attached to the teat of the Chamber. Funny just a few years ago... I am not shilling for the organization, not seeking to "Mine" for members, that is an agreement I have with TGO David, but possibly the cause of friction has to do with the failure of a Supermajority to produce the promises they made as they sought our help to achieve that status, and then forgot their friends who helped them get there. -

I would like to know who those "staunch gun rights lawmakers" are. The hate that most have for John Harris is that he tells the truth about the way they want to appear (legislators) and what they really do. He and I have different means of conveying thoughts, but I have never known him to tell an untruth. Yeah, he wears Leadership out, but what has it done to move the ball forward? Bills passed still get you fired for having a gun in the wrong vehicle on the wrong parking lot, yet if you can prove they let you go over having a firearm in your vehicle you have a cause of action (prove that in an At Will employment State) and more and more Municipalities are thumbing their noses at the State. As far as someone who helps lobby at the State, I would like to meet them and join forces, because there has been danged little if any going on in the last few years. They do any testifying in committees? -

I for one do not rely on Police for my personal safety. I can not afford to hire one to sit at my elbow, or escort my disabled wife to Wal Mart. In the few seconds a crime takes to occur, one can just about bet that they will be acting alone in producing any safety. I live 15 miles outside a very dangerous City, I am sufficiently aware that I will be required to "hold the fort" till help arrives should an incident occur. There are 12 homes in close proximity, we are lucky to have a young Police Officer (former Marine) who lives out here, he helped organize our Neighborhood Watch. When the tornado hit us in 2011, he and I did a house to house, luckily no one was injured. The neighborhood cut all the trees up (young preacher from the local Church was up at daylight with a chain saw, we did not quit till the roads were clear) and hauled them off, we had no assistance from the County, State or the federal government (16 days without power) never saw a "government" vehicle or employee.

We are going to move forward on two fronts this year (2016 Session). One a re-written Constitutional Carry Bill, broad enough to encompass signs, parks and most of the issues that have plagued the lawful gun owners since 1870. What are the chances Haslam and Co. will let it pass? Pretty slim actually, he is no friend of the general population having firearms at all, though his desire to higher office MAY keep him less vitriolic in public on the issue this year. Second, a simple repeal of 39-17-1307 ala Mike Bell's knife bill. It will require a couple of years of moving permit only defenses off the books as statutes, but I think the aura this year may be sufficiently supportive to get this passed. Beth Harwell is running for governor, as is Diane Black, Mark Green, Mark Norris and some others, it appears the primary for governor may well resemble the presidential scrum. Harwell will take a hard "right" and has started already with opposing the governor on his "gas" tax. As soon as we get the verbiage of the new bills out, those who wish to be involved are more than welcome, and if anyone has a line on Jim Coley, we would greatly appreciate it being deployed, as Civil Justice sub has been the killer on most bills recently, then that fraud Harrison in Finance sub will be the next hurdle. Anything out of committee in the House will pass the Senate.
