It has been explained to me by LE, that any consumption places one under the influence. Hence the "no alcohol and carry" presumption of the officers I have questioned on this. Don't know what the officers take in everyone else's neck of the woods is, but here in Madison County, you are under the influence if you have consumed any, with respect to carry. I am having a hard time getting my mind around the difference.

Seems to me that the whole discussion by Sen. Marrero and backed by the Senate Attorney and Sen. Jackson was tilted a little shy of the truth. I find it hard to understand how one could be "under the influence" if one had not "consumed". Say you "toss a few back" as described by Marrero, would you run afoul of TCA 39-17-1321? I can just see trying to convince the nice young man in blue that it was O-tay to have your carry piece on your person with a few shots of Jack in your system, and the evidence on your breath.

I have lived and worked in Mexico, and can promise you this much, you take about 10 steps down there without papers, and you will be visiting rats and cockroaches, in a Mexican jail. Stage yourself a protest against the Mexican Government, or any State thereof, and Geraldo will not be doing an interview with you, nor will you have a chance to see your native country again. I stood in the center of a Coca-Cola Distribution Project in Monterey speaking with a prospective sub-contractor for another job we were bidding, watching concrete blocks being made by hand, and caissons being excavated by hand and five gallon buckets (2008), I asked the PM for the firm why they did not purchase heavy equipment, and he pointed to the people lined up around the fence surrounding the property, and explained that his cost per day was less than $2.00 per laborer vs. the millions a yellow piece of CAT equipment would cost. A discarded Wal-Mart bag is luggage, never have to worry about job-Site clean up, the poor souls down there take every scrap of what we would consider garbage home and use it. Immigrants there are treated far worse there than they are here.

Washington DC’s low murder rate of 69 per 100,000 is due to strict gun control, and Indianapolis’ high murder rate of 9 per 100,000 is due to the lack of gun control. 3. Statistics showing high murder rates justify gun control but statistics showing increasing murder rates after gun control are “just statistics.” 4. The Brady Bill and the Assault Weapons Ban, both of which went into effect in 1994 are responsible for the decrease in violent crime rates, which have been declining since 1991. 5. We must get rid of guns because a deranged lunatic may go on a shooting spree at any time and anyone who would own a gun out of fear of such a lunatic is paranoid. 6. The more helpless you are the safer you are from criminals. 7. An intruder will be incapacitated by tear gas or oven spray, but if shot with a .357 Magnum will get angry and kill you. 8. A woman raped and strangled is morally superior to a woman with a smoking gun and a dead rapist at her feet. 9. When confronted by violent criminals, you should “put up no defense – give them what they want, or run” (Handgun Control Inc. Chairman Pete Shields, Guns Don’t Die – People Do, 1981, p. 125). 10. The New England Journal of Medicine is filled with expert advice about guns; just like Guns & Ammo has some excellent treatises on heart surgery. 11. One should consult an automotive engineer for safer seat belts, a civil engineer for a better bridge, a surgeon for internal medicine, a computer programmer for hard drive problems, and Sarah Brady for firearms expertise. 12. The 2nd Amendment, ratified in 1787, refers to the National Guard, which was created 130 years later, in 1917. 13. The National Guard, federally funded, with bases on federal land, using federally-owned weapons, vehicles, buildings and uniforms, punishing trespassers under federal law, is a “state” militia. 14. These phrases: “right of the people peaceably to assemble,” “right of the people to be secure in their homes,” “enumerations herein of certain rights shall not be construed to disparage others retained by the people,” and “The powers not delegated herein are reserved to the states respectively, and to the people” all refer to individuals, but “the right of the people to keep and bear arms” refers to the state. 15. “The Constitution is strong and will never change.” But we should ban and seize all guns thereby violating the 2nd, 4th, and 5th Amendments to that Constitution. 16. Rifles and handguns aren’t necessary to national defense! Of course, the army has hundreds of thousands of them. 17. Private citizens shouldn’t have handguns, because they aren’t “military weapons”, but private citizens shouldn’t have “assault rifles”, because they are military weapons. 18. In spite of waiting periods, background checks, fingerprinting, government forms, etc., guns today are too readily available, which is responsible for recent school shootings. In the 1940’s, 1950’s and 1960’s, anyone could buy guns at hardware stores, army surplus stores, gas stations, variety stores, Sears mail order, no waiting, no background check, no fingerprints, no government forms and there were no school shootings. 19. The NRA’s attempt to run a “don’t touch” campaign about kids handling guns is propaganda, but the anti-gun lobby’s attempt to run a “don’t touch” campaign is responsible social activity. 20. Guns are so complex that special training is necessary to use them properly, and so simple to use that they make murder easy. 21. A handgun, with up to 4 controls, is far too complex for the typical adult to learn to use, as opposed to an automobile that only has 20. 22. Women are just as intelligent and capable as men but a woman with a gun is “an accident waiting to happen” and gun makers’ advertisements aimed at women are “preying on their fears.” 23. Ordinary people in the presence of guns turn into slaughtering butchers but revert to normal when the weapon is removed. 24. Guns cause violence, which is why there are so many mass killings at gun shows. 25. A majority of the population supports gun control, just like a majority of the population supported Health Care Reform. 26. Any self-loading small arm can legitimately be considered to be a “weapon of mass destruction” or an “assault weapon.” 27. Most people can’t be trusted, so we should have laws against guns, which most people will abide by because they can be trusted. 28. The right of Internet pornographers to exist cannot be questioned because it is constitutionally protected by the Bill of Rights, but the use of handguns for self defense is not really protected by the Bill of Rights. 29. Free speech entitles one to own newspapers, transmitters, computers, and typewriters, but self- defense only justifies bare hands. 30. The ACLU is good because it uncompromisingly defends certain parts of the Constitution, and the NRA is bad, because it defends other parts of the Constitution. 31. Charlton Heston, a movie actor who was president of the NRA was a cheap lunatic who should be ignored, but Michael Douglas, a movie actor as a representative of Handgun Control, Inc. is an ambassador for peace who is entitled to an audience at the UN Arms Control Summit. 32. Police operate with backup within groups, which is why they need larger capacity pistol magazines than do “civilians” who must face criminals alone and therefore need less ammunition. 33. We should ban “Saturday Night Specials” and other inexpensive guns because it’s not fair that poor people have access to guns too. 34. Police officers have some special Jedi-like mastery over handguns that private citizens can never hope to obtain. 35. Private citizens don’t need a gun for self- protection because the police are there to protect them even though the Supreme Court says the police are not responsible for their protection. 36. Citizens don’t need to carry a gun for personal protection but police chiefs, who are desk-bound administrators who work in a building filled with cops, need a gun. 37. “Assault weapons” have no purpose other than to kill large numbers of people. The police need assault weapons. You do not. 38. When Microsoft pressures its distributors to give Microsoft preferential promotion, that’s bad; but when the Federal government pressures cities to buy guns only from Smith & Wesson, that’s good. 39. Trigger locks do not interfere with the ability to use a gun for defensive purposes, which is why you see police officers with one on their duty weapon. Handgun Control, Inc., says they want to “keep guns out of the wrong hands.” Guess what? You have the wrong hands.

Maybe we should enact the same immigration laws that Mexico does... after all, fair IS fair. 1. If you migrate to this county, you must speak the native language 2. You have to be a professional or an investor. No unskilled workers allowed. 3. There will be no special bilingual programs in the schools, no special ballots for elections, all government business will be conducted in our language. 4. Foreigners will NOT have the right to vote no matter how long they are here. 5 Foreigners will NEVER be able to hold political office. 6. Foreigners will not be a burden to the taxpayers. No welfare, no food stamps, no health care, or other government assistance programs. 7. Foreigners can invest in this country, but it must be an amount equal to 40,000 times the daily minimum wage. 8. If foreigners do come and want to buy land that will be okay, BUT options will be restricted. You are not allowed waterfront property. That is reserved for citizens naturally born into this country. 9. Foreigners may not protest; no demonstrations, no waving a foreign flag, no political organizing, no badmouthing our president or his policies, if you do you will be sent home. 10. If you do come to this country illegally, you will be hunted down and sent straight to jail. Mexican Constitution 4-5, 9: Article 33: "Foreigners may not in any way participate in the political affairs of the country." (See also Article 35 listing the prerogatives of Mexican citizens.) 5: Article 32: "In order to belong to the National Navy or the Air Force, and to discharge any office or commission, it is required to be a Mexican by birth. This same status is indispensable for captains, pilots, masters, engineers, mechanics, and in general, for all personnel of the crew of any vessel or airship protected by the Mexican merchant flag or insignia It is also necessary to be Mexican by birth to discharge the position of captain of the port and all services of pratique and airport commandant, as well as all functions of customs agent in the Republic." 5: Article 55: "The following are the requirements to be a deputy: I. To be a Mexican citizen by birth, in the exercise of his rights;" Article 59 extends makes the requirements to be a Senator the same as a deputy, except for age. Article 82 require the President to be " Mexican citizen by birth, in the full enjoyment of his rights, and the son of Mexican parents by birth". Article 91 states that to be a secretary, you have to be a Mexican citizen by birth, too. Article 95 extends the requirement of Mexican citizenship by birth to ministers of the Supreme Court of Justice. Article 115 requires governors to be Mexican citizens by birth. Article 130 limits ministers of any religion in Mexico to Mexican citizens by birth. 8: Article 27: "Only Mexicans by birth or naturalization and Mexican companies have the right to acquire ownership of lands, waters, and their appurtenances, or to obtain concessions for the exploitation of mines or of waters. The State may grant the same right to foreigners, provided they agree before the Ministry of Foreign Relations to consider themselves as nationals in respect to such property, and bind themselves not to invoke the protection of their governments in matters relating thereto; under penalty, in case of noncompliance with this agreement, of forfeiture of the property acquired to the Nation. Under no circumstances may foreigners acquire direct ownership of lands or waters within a zone of one hundred kilometers along the frontiers and of fifty kilometers along the shores of the country."

Going to check this out a little more. I have family who are very involved with funding for Lipscomb, and as with any University, faculty can steer programs otherwise than wished for from the principals of the backbone.

The only chance we have in getting something decent out of the Legislature on this issue this year, is to get a great conference committee to strip the amendments. Lt. Gov. Ramsey will appoint good people out of the Senate, the House will be problematic.

Dead on there OhShoot, they have not done a "Food Audit" in about seven years. I have a contact inside, they have been instructed to not inspect. One must realize, that they ABC works at the "Pleasure" of the Governor only, they have no duty to any other entity, other than the "Hospitality Lobby". Bredesen took the money from the NRA, stood flat footed and promised to sign any "Restaurant Bill" that hit his desk, if we could get it there. ABC does not count beer as an alcoholic beverage in their reconnoitering, the deck is stacked against the HCP holder. Our Legislators are sticking it to us, they think the average Citizen will be fine with them taking a little of our Constitutional Rights at the time, they see the Federal Government getting by with it, so they think we will simply sit idle and allow this. We must prove them wrong or we are lost!

When we organized the first Tea Party in Jackson, we made a point to recognize our men and women serving our country in the Military. We gathered items of need for our soldiers and shipped them overseas. We had several recently returned veterans who guided us in procuring necessities and niceties, had the kids write letters to them to be sent with the packages. We picked up the trash, left the park we held the event at cleaner than when we showed up. It was in all facets, a positive atmosphere, while we made our points to support smaller, more Constitutionally minded government, there was no semblance of hate or negativity. We have built on that core principal, of recognizing the United States as the Greatest County in the World in all of our subsequent events. I believe that the norm for Tea Parties nation wide is the same.

Seems the powers that be in the Republican Party of the State of Tennessee still support Lamar, he is to be the featured speaker at the Regan Day Dinner this Friday in Tiptonville sponsored by the Obion, Lake and Dyer County Republican Parties.

If ever there was reason to run certain Life-time Legislators out of office, this "debate" is it. The scope of this committee is to deal with the dollar impact of legislation, not to debate the merits. Sans data that would prove its passage to increase crime, there is no Constitutional reason for the Legislature to NOT put this into law, rather it is a public display of Power to usurp our Tennessee Constitution. We are being bilked of our Rights by men bought and paid for, against the interest of the Citizen, and we should not forget their fingers on the throat of Liberty.

How else could our Legislators afford to run a campaign without the "Hospitality (read liqueur) Lobby"?

With permit, rounds in the magazine, tube or removable is permisable, none in the chamber. If a threat is perceived, OK to then load the chamber.

I would suppose some one wants to keep her specifically out of their gun safe? About the best way I know to turn some one off to the shooting sports.

I am sure that is a true statement, hence my desire to gather views from as many different agencies as possible. I would suppose that LE agencies are much like any other group of employees, they have structure. The Brass lays out what the rules are. Not being privy to those, it behooves me to ask questions of those who are. The only way I have ever learned anything is to seek information from those who have specific knowledge. Been trying to get a sit down with the Sheriff of Madison County for a couple of years, no way is he going to put himself in a situation where he has to give an answer to any specific question. On the other hand, the New Chief of Police in Jackson granted me an interview within a few weeks of taking his position. I was very impressed with his openness and sense of wanting to forge a relationship with the Gun Owning public. The Officers I know on that force like his style as well. -

Generally that is understood to mean if the firearm is in the cab of a pickup, the ammunition must be in the bed, or if in a car, the ammunition must be in the trunk. Otherwise, it can be construed to be a violation of "intent to go armed" if both are within reach. HB 2567, which has been voted out of the both the House and Senate and is now on the Governors desk will relax that somewhat, allowing for carry of both in the same compartment as long as the weapon is unloaded, and no loaded "clip" or magazine is "in close proximity" to the weapon. Basically, this is set up to allow hunters to carry their rifle or shotgun from home to the field, with ammunition in the riding compartment of a vehicle. As it stands now, that is a violation if one does not have a HCP.

2nd Amendment Does Not Apply to States

I was speaking to the current case before the U.S. Supreme Court, McDonald v. Chicago. The Second Amendment has yet to be incoporated to the States like the First has. It is my hope that it will be as a result of this case. Heller decided that the Second speaks to an individual right to keep and bear arms, but as DC is not a State, this second case was necessary. We shall see in June when the ruling is made. Incorporated or Not Incorporated? 1st Amendment: Fully incorporated. 2nd Amendment: No Supreme Court decision on incorporation since 1876 (when it was rejected). 3rd Amendment: No Supreme Court decision; 2nd Circuit found to be incorporated. 4th Amendment: Fully incorporated. 5th Amendment: Incorporated except for clause guaranteeing criminal prosecution only on a grand jury indictment. 6th Amendment: Fully incorporated. 7th Amendment: Not incorporated. 8th Amendment: Incorporated with respect to the protection agains "cruel and unusual punishments," but no specific Supreme Court ruling on the incorporation of the "excessive fines" and "excessive bail" protections.
