  1. Bredesen heads for China next week (economic devel/recruitment), so no action on the bill would seem likely until the following week. The GOP budget proposal should be introduced next week as well...legislature may indeed still be here through the 20th or so.
  2. Yes, Scott, I believe that is correct. In fact, Bredesen did exactly that on another piece of legislation passed just recently in this session - a bill that prevents spending public dollars on a controversial medical procedure. He actually sent a letter to the Spkrs of both houses indicating that while he was generally in favor of the concept, he was opposed to certain specific aspects of this bill...thus, he was allowing it to become law without his signature. Somehow, I just can't bring myself to think we could be that lucky...

  5. Status has now been updated to indicate its been transmitted to the governor.
  6. In that those signs don't have (any of) the three essential elements listed in the bill, they aren't properly posted, so it would appear that the prohibitions listed would not apply, nor the criminal penalties described in the bill.

  9. @ Mike - yes, it allows a legal posting to consist solely of or include the international circle/slash.
  10. Next, the bill goes to the Gov's desk to be signed. I believe he has 14 calendar days to sign (maybe 10?). If he signs, bill is law. If he does not sign and simply allows it to sit on his desk with no action, it becomes law after 14 days. If at any time in the 14 days he vetoes, it goes back to both the House and Senate for override votes if they are both still in session.

  23. According to the esteemed Rep. Shaw, a bar is any place where you can buy a drink. And that's a direct quote, on video if you care to watch it...straight from the horse's...mouth.

Would defer to the legal experts on this, but given the actual wording of the statute, I'm guessing that the phrase "establishment open to the public where...alcoholic beverages are...served for consumption on the premises" may have a particular meaning within the framework of the regulations that would be widely recognized by the courts and preclude your concern.

Speaking of this...I saw an AP report tonite that indicated the TN ABC has been getting a lot of pressure from the legislature as fallout from Bonneymore's decision, and has begun to actually enforce the most egregious instances. Apparently, they recently closed a few places in Nashville (Buckwild and Trax), including one that consistently had food sales of 5% or less of total. The ABC spokesperson quoted in the piece made some reference to a 1983 Board decision that allowed them to also consider other factors before taking enforcement as the primary reason they have not enforced the law up to now.
