Here's my problem with that. Even if the founding fathers and writers of our state constitution (more about that later) really only meant for protection against a standing army (which we currently have, so what about the constitutionally of that?) and our government, they didn't state that clearly in the 2d amendment. It's amazing how people think the 1st amendment should be taken at face value (one of it's intents was protection against the government!), but the 2d shouldn't? (that pesky comma (originally a semi-colon) and the word "people" instead of "militia" make a huge difference.) It really doesn't matter anyone's intent, it matters what's actually written down when it comes to law (at least it's supposed to!) We saw this issue with the parking lots law two years ago where lawmakers like Ramsey were saying "well, we intended it to protect workers", but we mostly agree here that the actual wording doesn't protect workers from firing at all. Judges use the word "intent" as a fancy way to ignore the words written. Yes, we have to understand what the words like "well regulated" mean because that phrase was used a certain way back then that's not the same day, but research hasn't shown that the words "people" and "infringed" hasn't changed in english since the late 1700's. That constitution wording can really be taken at face value and it was supposed to be. Now about court decisions. The problem with our legal system and how it decides legality of laws is that it relies way too heavily on other legal cases. I encourage everyone to read this op-ed piece by former Justice John Paul Stevens (https://www.washingtonpost.com/opinions/the-five-extra-words-that-can-fix-the-second-amendment/2014/04/11/f8a19578-b8fa-11e3-96ae-f2c36d2b1245_story.html?utm_term=.04797c7f8e29) as it's a prime example of citing horrible former decisions and wanting to legislate from the bench. Here are some of the real doozies from it: What's interesting about the first sentence is Stevens is a fan of trumping states rights in many cases, but for some reason in this issue he's all about states rights. He also willfully ignores the 10th and 14th amendments, which both have been repeatedly affirmed by the SC (if he wants to refer to former court cases as a basis for his argument.) The entire constitution either applies or it doesn't. He refers to the Miller case, but strangely leaves out any details except the final ruling. Details such as, the previous judge (a gun control proponent in congress before becoming a judge) ruled in millers favor (which his argument was simply quoting the 2d amendment), but his ruling was designed to push the case to the SC and that when the SC took it up, the defendant (a bank robber) wouldn't show up to defend himself or the constitution. You start reading the argument by SC and it's pretty crazy. But here's the real kicker, the SC heard arguments from the government but NO ONE argued for Miller. So Stevens is citing a case that is the definition of one sided (setup to be so from the beginning!) To see a former SC justice quote such a case should give us all great pause about judges using other case law to decide the law. But this issue is bigger than just gun law, this issue permeates all aspects of the law. It's amazing how many cases I'll look up when I see a case cited and and flabbergasted at the ruling in the original case. I would encourage ANYONE who says they support the second amendment to read this doc (http://www.law.nyu.edu/sites/default/files/ECM_PRO_060964.pdf) and the original ruling (https://www.law.cornell.edu/supremecourt/text/307/174) and then the Heller and McDonald rulings (https://www.law.cornell.edu/supct/html/07-290.ZS.html) (https://www.law.cornell.edu/supct/cert/08-1521) It's amazing how the two latter cases TOTALLY contradict the rulings of Miller case (people's right vs militia's) but also how the two latter also didn't take it to the full logical conclusion-aka don't want to deal with the politics of actual liberty. What's amazing is that, even states like IL have it in their constitution that the right to keep and bear arms shall not be infringed. So the state constitution says a right to bear arms, but that's somehow ignored by him? What's even more frustrating is that he thinks, in this case, the states should decide, but in other cases he's all about zero states rights. He is inconsistent beyond belief. But that's why I bolded part of his statement above. It shows, by his own words, that he's really more interested in the political outcome (his) than the actual rule of law. I am sure that he would have voted for the gay marriage issue if could have, even though it was a states rights issue. I honestly believe that we will never have consistency in the ruling of law because there are too many people that are about their own political purpose than what the Constitution and law actually says.

Who's to say that I don't need to carry a handgun to protect myself from the government each time I leave my house? Handguns were also used in war at that time, so it's fair to say that they are military weapons. The key here is that it plainly says, the right of the PEOPLE to keep and bear arms. It doesn't specify that the right only exists while going against the government. There's quite a few quotes from the founding fathers that back this view up. But let's be really honest, politicians started ignoring the constitution before the ink was even dry on it.

Sorry, I meant McDonald. But what I was getting after was that the SC did say that the 2d Amendment does apply to just more than the federal government (incorporation). That's an important basis for any future ruling. Of course, I often times wonder if we are reading the same documents when I see much of what the SC writes. Then, I remember that these people went to law school where they weren't taught to read the plainly written words and go with that, but were taught on how to redefine the law to win (huge differences.) Sometimes people's heads are so buried in something they can't see how simple things are and because of that you can look at how inconsistent their rulings are. Heck, the gay marriage ruling should make national carry an easy ruling, but they won't let it because of politics.

That makes no sense to me. Heller somewhat incorporated the second amendment to apply to ALL states. So why couldn't they incorporate the "bear" arms also? That seems like a very logical step for forcing other states to accept other state carry permits. A federal carry permit would not pass constitutional muster because it would be infringing from the federal level (though, there are plenty of federal laws that infringe that they seem to be okay with.)

I've never bought a pair again since the mid 90's when I accidentally visited San Fran during gay pride week and they were passing out Levi t-shirts that said, "Get Into Our Pants." There is one thing supporting gay rights and another thing being absolutely crude about it. Besides, they are wayyyy overprice. -
I very much doubt the park vista is burning. I've stayed there 20+ times and that building is nothing but concrete. The landscape around it would be the only thing that could burn. Ironically enough, I stood on my balcony one time there and watched a car out in the parking lot burn because the engine caught fire. Kept waiting for the gas tank to explode but the GFD got to it in time.

Just search on facebook for 2016 home depot black friday ad. Once something is posted to the internet, it will never be stopped. My buddy who is a manager at Lowes told me that getting their deals online is the best way because they have a crew come in thanksgiving night that pulls all the orders from the store stock before they open Friday. I am honestly hoping to do this at most stores and there's only a few that I'd like to grab which are in store only deals (most being at HD ironically.)

After the gay marriage ruling there should be no legal legs for a lawsuit. But, of course, the courts treats the, actually in the Constitution and clearly written, 2d amendment totally different than the rest of the Constitution. I am sure states would try to impose such laws to out of state people, but I would be shocked if the NRA didn't sue as that would not be equal protection under the law. Out of state drivers in TN aren't subject to different driving laws than residents and vice-versa. Of course, the stupid courts again aren't consistent. -

Bingo. Both of these last two were because they were carrying without a license. Again, for my trip in Sept it would be impossible to carry through on person, but quite easy to carry through in a bag if decently hidden. Their bag checks aren't that great because there are so many people waiting to get in. But I also don't think I gun would be very helpful in a situation because I would imagine a bomb would be the method of attack at a park.

For those of us with young kids it's horrible. Totally worthless. I wish the entire country would shift a half hour and stop with the time change entirely.

Agreed. Jack reacher is 6'3 and 250 lbs. Cruse has most of the emotion (or lack thereof) down, but there were moments that felt wrong to me (the ending felt too happy, but it was a nice "movie" ending.) I am wondering if they continue to make them if he'll step out of the role and let someone else closer to the size of the character play it? But I am glad they are making the movies since I do love them. I wish they would make Nothing to Lose as that was one of the books that's really stuck in my mind.

Just saw it. It started like the book but compressed the timeline and locations Then it went away from the book some (bad guys in New Orleans instead of LA so they could). It held closer to the book than I was expecting, but it is still a movie so they can only be so accurate to a 500 page book (unless you want a 6 hour movie.) Overall as a movie just by itself, I think it's pretty good. Good plot, acting, and action scenes. Few little bits were a little on the nose when you compare it to Child's writing, but most Americans would probably need it to understand what's happening.

BTW, there is a free website/smartphone app call credit karma which will let you see if companies have been accessing your credit (like if you apply for a credit card). This would help him see if someone has stolen his identity or just using his address. But many prayers for your dad because it's going to be a mess either way. An illegal in TX had stolen my mom's SS number and used it to report wages for a restaurant job in TX. My mom discovered it one year and reported it to both SS and the IRS. The lady USED IT AGAIN THE NEXT YEAR and my mom had to deal with it again. So even when stuff is reported and they know who is doing it, the government doesn't go arrest the criminals.

Okay, so I have wanted to contact someone about that road for a long time. It's the same speed limit on that road as it is on Westalnd Drive between I-140 and Northshore Drive. On that section the white line is the edge of the road and there are a ton of driveways. Aren't there supposed to be state regulations about how a speed limit is determined? Veterans Parkway in PG should be 50 MPH almost the entire stretch if you look at any other road with the same amount of traffic, lanes, and roads attached to it. But like you said, it's 40 MPH. It seems like someone got the speed lower than it really should be so more tickets can be written on that road. Follow the cash flow, not the safety talk.

Somehow I think if you challenged Disney they would have a very difficult time in court explaining how their PRIMARY business is to manufacture, use, store, or transport explosives. Yes, they use and store fireworks, but that is not their primary business...which is hospitality (hotel rooms and food service.) This is again how businesses and government get away with not following the law because you have to have money and time (look at the Knoxville Fair Issue that is now over a year old) to get justice.

I was at MK and Epcot a few weeks ago and they were searching all bags and everyone was going through metal detectors. If you wanted to get a gun or knife through in a bag it would not be difficult - especially a knife. Security theater as I think it'd be pretty easy to even get a bomb past them.

Before my first set of twins were born that's kinda what I thought. I figured it couldn't be as hard as two kids, more like 1.5x one, right? Totally wrong. There are so many things that make life much harder...like one twin waking up in the middle of a nap, not wanting to go back down, and then loosing an hour or two of naptime that you'd use to bath/eat/etc. I will say the second set is much easier, which is good because it's amazing how being five years older really affects being tired/etc.
