Okay, here's the full email after I pointed out that what I found on the city of knoxville website when it came to Chilhowee park and the punishment. So according to our Gov, Chilhowee park is not actually a park. According to him, you can also not get any jail time for carrying in a city park. The worse a cop can do to you legally (short of arresting you illegally for carrying) is write you a ticket, and ask you to leave--which at that point you could get arrested for trespassing if you don't leave. Except I was told by our new gov in an email that Chilhowee did not apply under the carry rule like other city parks. Take it for what it's worth, but that's what he clearly said in an email. -
Maybe we should get a law passed that changes that to if you are not charged or either win a case/have any charges dropped, that means it was in self defense and therefore cannot be sued.

You will get sued, but then it will be thrown out if ruled justified. I was kinda told the same thing, "you will get sued if you shoot someone in self defense". However, I am starting to think that may not be that accurate (please someone correct me if they have been sued after a legal shooting.) Seems like most people wouldn't sue when a lawyer says that if it's ruled a justified shooting that it will instantly get thrown out. Of course, a lawyer might not tell someone that part to try and get another case, or someone might just ignore that fact because they are so mad. Either way, I would just rep myself and start with a motion to have the case thrown out since you can't be sued when ruled self defense. Of course, please anyone correct me if I am wrong.

Gun Belt - Where to buy in Knoxville area?

Not sure what kind your are looking for, but I bought a wilderness belt and love it. Didn't get the plastic insert, but did get the five stitch to make it a little firmer. Make sure you measure exactly to their instructions because I over measured and mine is slightly too big, which doesn't work as well (can't get it tight enough sometimes.) -

But do you not give up rights to do certain things? According to the TSA, I give up my right to a warrant search of my body if I choose to fly (not that I agree with that.) So does someone opening up their property not give up some rights because they are "open to the public"? We do have a constitutional right to be armed, correct? While I agree with you in principle, in reality, we business owners have lost many "rights". Owners should be able to hire only who they want to, but can't always (affirm action.) Shouldn't have to put in handicap stuff if they don't want to. Shouldn't have to ban smoking if they don't want to. The list goes on. So why shouldn't they be forced to acknowledge a constitutional right? Here's the issue that it really comes down to for many businesses. Lawsuits. Owners are afraid of letting the public and their employees carry because they don't want to get sued. We need to get a law passed that squarely puts blame on the shooter, and that's it. The law would say that unless a business hires an armed guard or tells an employee with a HCP in writing that they need to be armed, they can not be held responsible. The same would go for a customer that shoots inside a business. Matthew -

As Fallguy says, the best we can hope for is removing the penalty. Why? Because any business owner can put up whatever sign they want no matter the law. Just like the Atlanta Ikea has gunbuster signs at it's doors even though there is no law in GA about posting legally. So we may be able to get the law changed, but that won't change idiots. But at that point, it won't matter because we won't be committing a crime to walk past one and we will know what companies to NOT support. BTW, I am still a firm believer that under the TN constitution, that allowing businesses to post with legal consequences is illegal. The constitution gives them the power to restrict carrying with a "view to prevent crime." Well, how is a business owner deciding if guns should be allowed in their business opened to the public "preventing crime"? Really, under our state constitution only carrying in jails and in active courtrooms would be close to "preventing crime"--besides the restricting people who have committed certain crimes already. Here's the issue. They are advertised as being really green because they use less fuel. However, they are a dirty car to make from what I hear, they don't use that much less gas unless you do a lot of stop and go driving (which unless you live in a really big city, or drive i-40 through nashville at rush hour is unlikely to happen enough to really help), and instead of using gas, they use power made by mainly coal plants. And you must be a shorter person, because at 6'4, the Prius is one of the most uncomfortable cars I've ever driven and the dash is horrible as far as I am concerned. Just my view. Matthew

Not quite. Anyone can do whatever they want. The question is wither or not it is legal do to where they are. I can understand giving a ticket for having a headlight out-although, a high beam is a stretch since your normal headlights are working. However, I am unaware that a LEO could take your license without due process, and normally that would involve a DUI or something else dangerous car related. Matthew

No, he said it was a normal Beretta 92. He did say they were a full load though. My friend said that he did the WWII battle in Oak Ridge this year at the Secret City Festival and just stuck 30.06 blanks in his M1 with no problems. Maybe it has to do with certain weapons. I wonder if my FAL would fire with blanks. Matthew

I can 100% confirm that is incorrect. I was in Nashville last month shooting a movie and talked to our armorer one night when we were shooting a crime scene. He was using a regular Beretta 92 with blanks and it was cycling just fine. From 4 feet away I was getting hit with bits of gunpowder and plenty of percussion, but then again they weren't aiming right at me, just to the left of me (I was operating camera)

Man, you are so right. I can't stand how every show HAS to show racking the slide to show "we mean business" I especially hate it when they show LEO's doing it. Personally, I believe that chambered is the only way to carry. It already takes a second to get your firearm out to start with, why waste another second chambering a round (if it doesn't jam while trying to chamber.) If you are worried about carrying a gun with no safety (glock, XD, etc.) then buy something like an M&P with a decocker and safety. That is extremely safe because like the glock, they have drop safeties, plus they aren't cocked so there is no way for them to go off even if that does fail. Another solution would be having the chambered round be a blank. If you ever fire it accidentally, there is little chance of hurting yourself or someone else, and it will cycle the slide to load a live round. Plus, it would be much faster than racking the slide. But just know that modern firearms do not go off by themselves. Because of drop safeties, then physically can not go off without pulling the trigger. Matthew

If we are talking about the same thing, it wasn't a tax break at all. For most Americans, all it did was take the money that they normally would get BACK from the gov at the end of the year (taken through withholding) and go ahead and give it to them. If you made enough money, then you actually had to pay that money back. Not a tax break at all. Just a scam by the dems.

This is a really hard one for me. In one way I see needing to keep some things secret, but in other ways our federal government has gotten so out of control that we really need tons of "secret" information released because the government IS supposed to be ruled by US. To those who say this puts our troops at harm, I want to remind you that it wouldn't put our troops in harm if politicians weren't running the war. If we let the military run the wars the way the should be run we would have been out of there long ago.

Except, that the Federal law follows state law when it comes to carrying, IE you have to have a valid permit in that state, etc. It is a valid question to ask what the actual federal law says because I thought the federal law follows any part of state law that would apply (which is why we can have a loaded, but not chambered rifle in our cars in the park.) IT would be interesting to get the actual text to see if the gunbuster sign would apply at trail heads. Of course, how would that even apply even if it was a "legal" posting? Not saying it does, but it technically could be illegal considering how our state senators/reps seem to write vague laws.

Legal to carry a unloaded handgun without permit?

So wouldn't it be illegal to carry an unloaded gun into the firing range in a case? Or in a case from the store into your car, etc. I am not saying a cop would arrest you for that, but technically, that would be illegal since it's about you and concealed. While I like Duncan, he said something in the last year about getting money for us in his district because "someone is going to get the money anyway, why not get it for the people I rep." That's the very problem with Washington right now. "It's going to happen, oh well..." So I am voting for Joseph Leinweber, Jr. because he is FAR more conservative...even if he doesn't have a chance I voted my mind which is the best thing I can do. Matthew

Every time I've voted since getting my carry permit I've been armed while voting. I always do early voting in places like a strip mall and they've never been posted before.

But you are HIGHLY over thinking 99.9% of criminals in the US. Most to all criminals are just plain stupid. They get caught doing stupid things like hanging around the place they just robbed, spending the money two blocks away, admitting to the cops everything when they could have kept their mouth shut and stayed out of jail. Heck, just look at the TV cops. When criminals are committing crimes like armed robbery, they are nervous and the adrenaline is flowing. Even if they are casing a joint, they are not thinking clearly and miss details like what's written on someone's clothing. IF they DO notice it, it seems like studies from criminals have said that criminals normally like to avoid people that they know have firearms ready to use. It's the simple law of. "no gun=no getting shot=better chance of walking away alive." It's the same reason you don't normally see cops getting jumped even though they have uniforms on and open carry. Of course, if everyone open carried, and more people carried period, crime would probably drop (at least robbery in public) like a rock. You might be able to take on one guy with a gun, but 5 people in the store armed ain't good odds. BTW, I've had an NRA sticker on my truck for over a year with no problem. Even parked overnight in downtown Atlanta with no problems. Criminals are more interested if you have a stereo in your car that they can see is worth stealing (or something else valuable left out in the open.) -
Yes, that is what he said (another stupid lawyer that can't understand what another lawyer wrote.) However, since it's under the pre 1986 law, it's only a $50 fine and that's it.

None of the cabins are posted, so you can stay there with your firearm, just can't dine with it.

Okay, so I wrote an entry earlier today but it didn't post. I hiked LeConte back at Easter armed and when I got to the top found that the visitor's center (really just a room) and the dinning hall were posted. I know that LeConte Lodge is not run by the NPS, but by a private company (may be a non-profit). I have heard that the NPS "encouraged" the private businesses to post (the scum) However, you can get water easily up at the top as it's just a spout in the middle of the camp, and the bathrooms are not posted. So enjoy the hike, and let someone, unarmed, go inside and tell the employees to tell their bosses to kindly unpost the lodge. It's quite pointless as there is rarely a ranger up there to enforce anything, and that silly sign isn't going to stop anyone who means harm (how you would have breath the cause harm after the hike up, I do not know!)
