  1. Depending on the wording... it could have much farther reaching impacts than that... Heller makes the 2nd Amendment an individual right (duhh what took 200+ years)... If McDonald binds the states to adhere to the 2nd Amendment it will have much farther reaching impacts than just owning a firearm. No, CA assault weapons ban... No magazine restrictions on weapons in any state... I suspect that we'll see sucessful challenges to anti-carry laws... TN HCP permit costs for example are probably unconstitutional (If the permit itself is even constitutional)... This is a much bigger deal than just Chicago residents being able to go and buy a handgun.
  2. Tennessee National Guard should be changed to "any member of the Tennessee Military Department" this covers national guard, Air guard, State guard, TEMA, General staff of the state and would cover the militia should it ever be called up.

  4. First, businesses can block your rights all day long... Think about how your work blocks your first amendment right all day long The Constitution protects your god given rights from an abusive government... Because you largely are an unwilling party to that agreement (unwilling as in born into it with no choice to op out). The business you work for, is a choice you make, you can quit at anytime if you don't like the rules and restrictions placed on you. The same goes for places you do business with... you can always choose not to do business with them... when they restrict your rights they do so with the understanding you may at anytime choose to end that relationship. Bills which require you to do business any group are unconstitutional IMHO because we have the freedom of association, which also means we have freedom to not associate with somebody for whatever reason. (This IMHO includes parts of the Civil Rights Act)
  5. Nashville is also in the same top ten list as Memphis on crime... Memphis being #2 and Nashville being #8.... There are parts of Nashville I refuse to go without a firearm... And parts I won't let my wife go even with a firearm.
  6. Break the law? Do they have legal signs at the entrance to the parking lot? Otherwise it's not against the law, you're just risking being fired for having a firearm in the vehicle at work.
  7. I wouldn't bother... you can find a little electric alarm trip wire device on the internet for $10-$15 which will work just as well..
  8. That is MUCH boarder than just the business owner... It covers anybody's 'place of business'... It doesn't require you to be the owner, it should cover all employees... Also I believe that 1359 does not apply to persons under this exception in the law.
  9. It's time for a change at the NRA- and the NRA-ILA... anybody know anybody about how members of the NRA board are appointed or elected? It's time for us to change the organization from within or exit stage left.
  10. That entire part of the law was done away with... Unless I'm mistaken... Now only LEOs, HCP, and persons who fall under some other exception can carry. The requirement to do if for 'security' has been done away with.
  11. I see lots of people carrying both OC and CC... I suspect that HCP holders and LEOs tend to know what to look for and tend to notice a lot more than the general public... It doesn't surprise me you noticed, I would be surprised if 4 other people in the restaurant noticed by themselves.
  12. People wonder why some of us don't think the NRA always has out best interests in mind when they make these backroom deals... So it's wrong to impact their freedom of speech, but they'll lift no hand to defend everybody elses... including a number of smaller state level firearm associations which frankly get a lot more done at the state and local level. What a crappy thing to do, roll over for a special exemption.
  13. Gun Facts 5.1: Fact: 11% of police shootings kill an innocent person - about 2% of shootings by citizens kill an innocent person. Note that figure is all citzens, not just those who have a HCP, and means some likely have much less range time than your average TN HCP holder. Point Blank: Guns and Violence in America by Professor Gary Kleck (a liberal Democrat, and member of the ACLU and Common Cause) The odds of a defensive gun user accidentally killing an innocent person are less than 1 in 26,000. The Gun Facts is the current version, although the referenced study is from the mid 1990's... The Point Blank book is also from the mid 1990's but the data used for the 1 in 26,000 is from 1979-1985. I'm not aware of any other studies on point which are more recent.
  14. No documents because it's not on the list of places we can't carry... It's just like any other public business... unless posted or on school grounds carry if legal.

  16. LEO's are 5 times more likely to hit an innocent person than HCP/CCW holders nationally... There are lots of good reasons for this, mostly because HCP holders know exactly who the bad guy is because they're normally the victim... but if somebody starts throwing rounds in a public place, the math says it's better for a HCP holder to be the one shooting than the police. A perfect example of this is during the recently shoot out in a bar (The video of which was posted on here a few months back)... civilian shooters didn't hit any innocent bystanders and were able to protect themselves from some gang bangers.... I'm sure it could have turned out different but here is one example of a bar shoot out which didn't turn deadly for innocent bystanders. Also, the truth is going to and from the restaurant is probably the most likely time a HCP holder is going to need to use their weapon... Most criminals won't try to rob a place with 100 people in it... but try walking to your car at night in a bad part of town... So disarming people inside the restaurant also disarms them outside where they are very unlikely to hit somebody other than the criminal threatening them. I'm sorry but reality is that as bad as HCP holders can be and still pass the test, they're just not hitting innocent bystanders left and right like you suggest in this or any other state.
  17. I had the exact same problem with my wife... She loves to go and shoot (much better target shooter than I am)... Went and got our HCP's together years ago... But she never could get in the habit of carrying a pistol with her all the time... Well earlier this year all that changed, a couple who are good friends of ours had an incident in their front yard... my wife's opinion was it was probably an attempted kidnapping of the young lady or worse... The very next day she asked to borrow my KelTec P3AT and started carrying it everywhere she goes... I had to go out and buy a new KelTec for myself It only took 1 experience for her to change her mind on carrying a firearm.
  18. Because the vast majority of our legislators really don't care about the 2nd amendment, and only care about getting re-elected? Or, the vast majority of our legislators don't bother to read the bills they pass? Or, the vast majority of our legislators have no clue what the law really says? Take your pick... But as good as we think we have it, firearm laws here are a mess a lot of the time... The school activity one is very scary... You can be in a building, have adults who are old enough to drink show up for a college sponsored activity, and suddenly it's the same as carrying your firearm into a school building... One of those bad situations.
  19. No, they must post the entire park, or none of it. But, it doesn't matter, the park becomes off limits when it's used for a school function... Just like McD's becomes a no carry zone when a school bus full of kids shows up to eat lunch, or the local college astronomy club holds it's weekly meeting at Shoneys....
  20. Me personally... I'd go somewhere else for vacation... There are a bunch of other states that will allow you to legally carry which have great spots to visit for vacation... Why give up your right to defend yourself? Walking around New York City unarmed doesn't sound all that relaxing to me personally

  22. 39-17-1352a reads in part: 39-17-1352a6: If TDOS becomes aware that you have violated 39-17-1359, notice that the way it's currently worded a conviction of violating 39-17-1359 is not required, just that "sufficient evidence" is given to the department.Even if they can't make that stick, TDOS can use the 39-17-1352a3 catch all: The one time I'm aware of this provision being used, the person had not even violated the 1351-1360, wasn't arrested nor charged with a crime. Also in this one case, the suspension appears to be the equivalent of a lifetime ban of the persons HCP.So, it's a much bigger deal than just a $500 fine, if TDOS finds out your permit will be revoked or suspended, and who knows for how long it could very well be a lifetime ban. Needless to say, 39-17-1352a3 and a6 need to get deleted...
  23. 39-17-1309b1 states: For sure day care is not covered, and "pre-school" is not "school", pre means before school and since "pre-school" doesn't appear to be regulated under this law for carry... K-12 and virtually all post-secondary schools are covered by the law, and prevent people from carrying a firearm for self defense (something we should focus on changing asap). But day care and pre-school do not appear to be prohibited by 39-17-1309 and therefore unless posted are carry friendly zones (IANAL). I would carry at either location with no concern - as long as the day care or pre-school aren't on a school campus.
  24. If you live in Williamson County, think about running for the school board... you'd be surprised how much good you can do for a pro-2a pro-constitution view point... School Boards have a LOT more power over our future than most people realize.
  25. That law did pass.... and I doubt we'll see any serious attempt to add anti-gun laws to the books... For a vast majority of legislators, suggesting an anti-gun bill of any sort is a quick way to loose an election.... It's one thing to oppose restaurant carry because of crazy not-likely-to-happen stuff... it's totally different to suggest banning something that is currently legal. But, we all should focus on retiring more anti-2a/gun legislators this election season, and focus on getting a good solid pro-2a into the governors office this year.
