Who exactly signed the National Parks Carry into law? Oh yeah Obama! You add the act as an amendment into a time sensitive can't veto bill, and it will get signed into law. And just because there is a federal law that says you must honor, doesn't mean they get to mess with the issuing process, the drivers test in TN is nothing like the drivers test in IN. I agree waiting to see how Palmer v DC turns out... would be a good idea... but I seriously doubt we won't be facing a new civil war/revolution long before the Federal government gets around to trying to centralize the national handgun permit process.

I'm sorry while I'm a very limited powers kinda government, this is EXACTLY what the Constitution calls for, regulating activity between the states. Telling all states that they must honor drivers licenses, or marriage licenses from all other states is perfectly fine, so how exactly can't the federal government require that all states must honor carry permits? Trust me, if you view this as a slippery slope... you missed that boat by about 75 years... we're way down the hill already on the federal government should stay out of state business by a long shot. Telling me that growing wheat in my back yard for me to eat is "interstate commerce" is something we should do away with... Telling 2 states they must honor each others licenses when citizens travel, is a lot closer to what the framers intended when they wrote the constitution.

You know, $307k a year must pay for at least 2 to 4 of the workers in that department... seems pretty simple to get rid of that fiscal note, just add a rider to have the TBI fire 4 or 5 employees, then the bill saves us some money. Or better yet, lets just get rid of TICS altogether, and go to NICS and we can fire the entire department. Less unconstitutional fees, and fewer government workers, sounds like a win-win to me

Judge Revives Tennessee Gun Rights' Lawsuit

Exactly how do the laws in TN get any worse? Other than doing away with the permit system all together? -

Judge Revives Tennessee Gun Rights' Lawsuit
JayC replied to MikePapa1's topic in 2A Legislation and Politics
Truth is, if some of the proposed legislation passes, it will make his lawsuit a non-issue. The only thing that would be left that is likely unconstitutional is the TICS system, which I don't think Kwik is complaining about. Frankly I can't wait for that class action lawsuit, lots of $10's that should be returned to the gun owners of TN. -
Ron Paul potential GOP presidential candidate?
JayC replied to a topic in 2A Legislation and Politics
His son Rand Paul from KY would be a much better choice for a true libertarian republican presidential candidate. Younger, and comes across a lot less hard line than his father. -
Well for the record, I left my 6 figure income, and started my own business in the middle of a recession, and now make about 30% more money, and don't have an employer telling me what I can or can't use to protect myself. I understand your point, but mine is it's a choice, I thought I was going to take a 10-20% pay cut when I left... And I was willing to accept that in order to be the master of my own destiny... I understand money is what drives most people, my values are much more important than money to me.

Constitutional Law, Union and State.

That is the real question isn't it... I believe in the four boxes of liberty... And my hope is we can return to true liberty before having to resort to the final box. -
Constitutional Law, Union and State.
JayC replied to Worriedman's topic in 2A Legislation and Politics
My point is that while we're living under it... We often gloss over how it came into being, how it was changed, and the stink of illegal means that were used to force it on the people of TN. People hold up our state constitution as being the "will of the people", but fail to mention how it really came to pass. A lot of stuff that happened in this state between 1855 and 1875 would make a lot of people take a step back and question if the current constitution should stand or if we should revert to the 1834 one. -

The current definition of 'judicial power' is completely different than the one held 250 years ago. Marbury v. Madison - Wikipedia, the free encyclopedia You'll note that there is little or no mention of the court having the power to over rule the President or the Congress in any of the federalist papers, or any of the discussions I've read from the state legislature when ratifying the constitution or the bill or rights. And at the time English common law did not support the practice either... Again, what we were taught in school, is unfortunately much like a hollywood movie version, where the hero is painted as a wise man, and there is no mention of him being a child molester in real life. It's fun to watch, but it's not real history. -
HB 1668 (Matheny) - TN Gun Owners Improvement Act
JayC replied to GKar's topic in 2A Legislation and Politics
I'm not positive, but it seems in this bills version of 1359 governments would only be allowed to post buildings, not parking structures or grounds. Also it does seem to remove the prior 1986 laws still on the book. Now, I don't see where it would still allow local governments to post public parks... do any of you? -
HB 1668 (Matheny) - TN Gun Owners Improvement Act
JayC replied to GKar's topic in 2A Legislation and Politics
Wow, this basically re-writes the law... cleans it up some... but it's going to take a lot of time to dig through and figure out what has changed... I do see the $10 TICS fee can now go down, but no controls are placed on TDOS preventing them from hiring or buying equipment to make sure it never goes down. -
Well to each his own... I personally wouldn't work somewhere if they asked me to be a defenseless everyday... Just like I wouldn't work somewhere that was providing abortions... And while there are other things you can do to protect yourself, most aren't as effective as a firearm. I can cut a tree down with a knife, but a chainsaw is much better for the job. I just don't understand folks, and their priorities sometimes.

Constitutional Law, Union and State.
JayC replied to Worriedman's topic in 2A Legislation and Politics
Robert, When did the addition of can 'regulate the wearing of arms' come about... It wasn't in the original TN Constitution, look into the process of how the current Consitution was drafted and passed and notice that it might not have conformed to the legal process of amending the TN constitution in place at that time. Also, note who was or wasn't allowed to take part in the drafting or voting on the current constitution. The spoon feed history we were given in school, glosses over all these issues, that shortcuts were even taken, let alone holding them up to the light of legality. -

Keep in mind that no where in the Constitution does it say that SCOTUS gets to decided what is or isn't constitutional, that is a power they made up for themselves. The 10th Amendment clearly states that other powers are granted to the states or the people, and the 2nd Amendment is a right of the People, not of the states. -
I just don't understand people... My safety and the safety of my family is a lot more important than going to some concert and having to walk around unarmed in downtown Nashville. My wife knows to not even ask me to go somewhere posted, and if we show up and it's posted, we're going to get a refund and go home/somewhere else.

Constitutional Law, Union and State.
JayC replied to Worriedman's topic in 2A Legislation and Politics
I would contend the 2nd Amendment and the 10th Amendment make it clear that regulation of firearms does not belong to either, that the Constitution is the Supreme law of the land, and it states: You'll note that it doesn't state the right of the States... then you have the 10th Amendment which states: Clearly the 2nd Amendment is meant to protect a God given right to "the people" which can not be taken away by any level of Government, the States included. Lets be clear, the States should have some authority in our daily lives greater than the very limited Federal government, but they do not have absolute authority, they are limited in the powers the people of that state granted to them as well, just as the federal government is limited in the power the states granted it. The exercise here is not to go from 1 Federal monster, who we put back in it's Constitutional cage, and exchange it for 50 little monsters... The goal is to return to true freedom, where we have just enough government intervention to prevent society from slipping into anarchy on a regular basis, and nothing more. -
HB0355 (McDonald): Parking lot bill filed 2/7/11
JayC replied to GKar's topic in 2A Legislation and Politics
If it bothers you so, why not find a different job where you can carry? Why make money for a corporation you disagree with on such a fundamental level? And before you say such companies don't exists, they do, I've worked at them, and know people who continue to work at places that allow carry on their person let alone in their car outside. -

JayC replied to GKar's topic in 2A Legislation and Politics
Robert, Words have meaning... Corporations are government created entities... But a person doing business is different either via a sole proprietorship or a partnership.... Both are doing "business" as you describe... but one clearly does have inalienable rights, while the other may or may not. You posts constantly strike me as having a conservative progressive bent... personal property rights are an inalienable right, not something to be granted or taken away by the government. If the government can control what we do on our own property (without causing direct harm onto others) then we don't really own the property in the first place. Society getting it's way is 2 wolves and a sheep voting on whats for dinner, inalienable rights means the wolves vote doesn't count, the sheep has the right to live period. -
Two by Campfield RE carry on college/univ campus
JayC replied to GKar's topic in 2A Legislation and Politics
Now, where is campus carry for HCP college students? One more bill and if they all passed we'd pretty much be a gold star state. -
SB0397 (Campfield): Expanded carry legislation
JayC replied to GKar's topic in 2A Legislation and Politics
I doubt most clerks would notice a single letter in the endorsement line while glancing at a DL... but there is a valid concern over using the DL... by law you can only have 1... So that would remove our ability to have backup copies of the HCP... So for that reason I'm kinda in agreement that a separate card would be better, they're still charging us $115 for the permit, making a card seems not too expensive
