While Doug Jackson was a strong supporter of our 2nd Amendment rights, he had other very bad ideas, and more importantly backed leadership on votes to limit our other rights... If you're a conservative Democrat, you are at risk of getting voted out in swing elections because of the D next to your name, and Doug is proof of that fact. -
As Fallguy has already said, I don't see how you could be charged with going armed... but also our stand your ground law would protect you as well... You're allowed to defend yourself anywhere you're legally allowed to be, doing things you're legally allowed to do. It seems to me that process serving is clearly a legal activity and unless you're criminally trespassing, you're doing it somewhere you're legally allowed to be. Seems you therefore are allowed to defend yourself if you're threatened with death or serious bodily harm. but IANAL, I'm sure from a civil liability stand point all bets are off Also, since a process server can't be a party to the suit, if somebody becomes violent with the process server, an independent third party, if I'm the on the jury I'm going to side with the process server, because he's just doing his job, and would have no reason to inflame the situation.

IANAL, but it seems to me if you intend to live with your parents, but you need a place to stay while working in Huntsville, until you find a closer home, that doesn't mean you're becoming an AL resident. But, truth is, find a house to rent in TN if you plan on living in TN... and problem solved.

You'd be surprised... even if you're buying the ammo for a rifle... many clerks will refuse to sell you 9mm or 45acp if you're under 21 in a WalMart.

I'm very anti drug too... took a long while before it finally occurred to me how bad the 'war on drugs' was hurting the country... much worse than the problem by an order of magnitude.... Once we legalize one, the rest will follow in short order. Oh yeah and that undeclared third war we're fighting on our southern border, goes away over night.

A majority of registered voters in the country now supports legalizing pot in some way shape or form.... It might not play well with social conservatives... but his point that 90% of the problem is issues with enforcement, and 10% is from people doing the drugs... from a fiscal conservative point of view, I'm all for getting rid of 90% waste.

Well, I find it a little impressive I understand it's not the feat it once was, but the mental toughness I've seen on the discovery channel show impressed me with people who do make it. But I agree it doesn't mean he's rambo

There are lots of reasons to carry at a concert... most importantly to and from said concert in a downtown area that does see a good bit of crime... Which is why it's not against the law to carry in large public gatherings. I have no clue what concert you went to... but it sure doesn't sound like somewhere I'd want to be anyhow... And nobody was suggesting they can't deny you access, that is their right as the property owner, I was just pointing out they can't take your weapon if you were caught carrying in an unposted area, you can't be charged and your weapon can't be confiscated by police officers, they must return it when they release you from the scene. Personally, I don't go anywhere I can't carry, unless I have no other choice - ie, state office buildings, courthouse, etc. If it's so dangerous that they feel the need to post, I figure it's probably better I avoid the business...

Private schools are also registered with the state. With very few exceptions having to do with religious schools which are certified with their respected religious school associations, but the VAST majority of them are registered with the state as well.

If it's not posted, why would a police officer take your weapon? That would be a violation of state law, unless you're being arrested police officers are required to return a HCP holders weapon when they are released. Worse they could do, turn you away.

IANAL, but it doesn't appear as if the Boys Club is a school registered with the state of TN Department of Education. You can contact the state for a list of "schools" both public and private registered with the state, my own opinion if they're not listed with the state then it's not a school under state law Unless they're renting land from a local school board, it should be safe to carry there.

The short answer is yes, we do more things than NCIS would do, and we charge a $10 tax for the privilege... Seeing as TCIS is clearly unconstitutional under our state constitution we should get rid of it.

8 is awful, we're in the middle of the pack ranked 23rd.... Not somewhere I want to be with a constitutionally protected god given right. What if we were ranked 23rd in providing habeas corpus rights? Would you find that ok?

Stupid question, but if the legislature is limited to only regulating the wearing of firearms... how exactly are they allowed to tax the sale of firearms?

Training Required (To Say The Least)

I guess carrying without one in the chamber is a choice, but it's a stupid choice If you're not comfortable carrying with one in the chamber you need to get a different gun, or more training. The time needed to rack a slide is too long when you need the gun to go bang... not to mention the gun is useless until you manage to rack it, while possible fighting with bad guys. As for training, I agree completely... if all you do is go to the range and shoot at paper targets in your aisle, you're not helping yourself prepare for a real fire fight... Most police departments learned this a long time ago. -
Why on earth would I want to fly to Europe? 12+ hours in small seats with no leg room, bad/no food, and 200 other people? No thank you Flying to the west coast was barely worth the effort before 9/11, now with the security theater, it's just not worth it. I understand your point, I'm fortunate to not have to travel by air... and frankly I'm glad, because it's the most uncomfortable method of travel IMHO... add in the strip searches/porn scanners... and the general headache of flying... and for me, the list of places worth getting on a plane again are very few... Europe is for sure not on the list.

You might believe that, but history doesn't seem to be on your side... The legislature even changed to law last year to keep a "half decent" ADA from charging you, by making an exception that allows you to defend property if you feel threatened with serious bodily injury or death. Tell you what, cite a single case in TN where a homeowner was changer under those circumstances. I'm betting you won't find one in the last 10 years. Also, I'm allowed to leave the safety and security of my home to perform lawful activities, I have no duty to retreat from one part of my property if somebody is trespassing or breaking into my vehicle... I'll call 911, but I'm not going to rely on the police to show up 15 minutes later and fill out a report... I'm going to confront people breaking into my car... you're welcome to hide in your home and pray they don't do anything other than steal your property. And I wouldn't kill somebody over a piece of property... but I would assume somebody willing to steal my property and not run away when confronted and holding a weapon is willing to do me serious bodily harm or worse... and I could see how that could turn into a justified self defense shooting... If somebody can shoot a teenager hiding on their property for playing a ring the door bell and hide game... and can't even get arrested, let alone charged by an ADA... Again, ADA don't like loosing cases... bad guy vs home owner, tend to be loosing cases, unless the homeowner acts so outrageously that they can not have been in fear for their life. As for shooting somebody over property, I'm all for us enacting Texas law concerning other crimes we can use deadly force against, frankly I think it would make people think twice about breaking into a car or back shed in the middle of the night if they knew it was open season on bad guys.

It's not illegal to defend your property... it's illegal to use deadly force to defend your property. So, while you might not be able to shoot the bad guy for breaking into your car, if you confront him, and he moves towards you with a weapon in his hand, you may very well have a justified self defense shooting. We had a report of a similar case here on this forum about 2 years ago, a woman confronted a bad guy breaking into hear car, she held him at gun point until the police showed up... They asked to see her permit and let her go without charging her. If somebody is breaking into my car... I'm going to go outside and confront them... if while confronting them, they turn towards me with a weapon in their hand... I'm very likely to believe they pose a serious threat of bodily harm or death to me... I seriously doubt under those conditions any DA in TN would file charges.

We've seen some very interesting self defense shootings reported here in TN over the past few years. Not that I would want to rely on that past history... You've got to be very wrong it seems to get yourself charged... if we're to believe the news reports... Case in point, in the last 12-14 months we've had 2 shootings on property that probably weren't covered under the letter of the law... Shooting of an off duty sheriff deputy through a door in the back of the head and shooting of a kid to was playing ring the doorbell and hide... While the sheriff deputy case did require 2 or 3 no bills from the grand jury before the local sheriff finally gave up... neither case resulted in criminal charges.

The better question isn't why are they so important... but why they are so unimportant that we won't allow law abiding adults to carry for their protection. At least 1 school shooting was stopped early by an adult going and getting their legally owned handgun and stopping the gunman.
