Do you feel that business should have the right to Opt-Out?
JayC replied to a topic in Handgun Carry and Self Defense
Wow... just wow... I can't believe people miss the entire point of liberty, freedom and property rights we fought for and the Constitution that protects those rights. First, WyattErp, you've got it 180 degrees backwards, the places that should never be posted are Government locations, since the Constitution (both the state and federal) protect our right to keep and bear arms... It's those government office buildings, that I'm forced to go into the pay taxes and conduct other business that I can not opt out of... that I should not be disarmed. Second, private businesses are owned by private people (at least for right now, the way things are going that might not be the case in 10 years) those people have property rights protected by the same Constitution that protects our right to keep and bear arms. You have no right to dictate to them how to operate their private property anymore than they should dictate to you how you run your home. Unlike with the government you always have a choice when it comes to a private business, you can ALWAYS get service from somewhere else. And it's never been easier to vote with your feet! That is how the free market works, and it works pretty well. If your local business wants to post, let them... you can buy products from another company, you can encourage others to buy products from another company, and you can picket and protest their actions if you want. But, we don't have the right to force them to allow you in their business for any reason what so ever... We don't need more government rules on private businesses we need fewer... we probably do need a lot more rules limiting the power of local and state government entities, including removing their ability to prohibit law abiding citizens from carrying firearms on public land and in public buildings. -

In most places "relieved of his duties" is paid leave, not termination. -
Ohio police threaten to execute permit holder video

And that is the problem right there... This officer CLEARLY has broken the law, if a citizen made those types of unprovoked threats and lied on official government documents they would be going to prison to be bubba's girlfriend. Anything less than formal felony charges is a white wash by the DA's office and anything less than termination of the officers POST certification is a failure on the part of the state licensing bureaucracy. Also, while I'm on my soapbox, failure to notify laws are unconstitutional to begin with, a violation of the 5th amendment against self incrimination. -
Last time I was down there, it was not posted... I personally don't believe it falls under the definition of a park.

I don't think he's made any yet... just got a letter from the ATF telling him it would be illegal to make one. -

Web Training May Suffice for Wisconsin Concealed-Carry

Honestly, I don't think the class or range time serve any benefit what so ever in TN... Much less than 1% of people who attend a HCP class/range don't pass... It's corporate welfare for gun ranges and instructors and nothing more... It's a needless expense required by the state to get a permit to carry a firearm. An online class and test or just an online application would serve about the same purpose, and wouldn't result in a significant increase in risk to the public. -

What else do you expect from the RINO Beth Harwell? -
Select the right ammo and the 9mm will be fine.... Remember the 19 will have 15+1 chances to stop a bad guy while a G36 has 6+1.

Store Owner Shoots Robber In the Butt; Doesnt Get Charged...
JayC replied to a topic in Handgun Carry and Self Defense
Wow, I completely agree with Dave for once... Store owner made sure nobody else would be threatened with death by this thug... I'd buy him a beer. -
Clear violation of the first amendment... Boy, you'd think there would be much better things our legislature could have been doing this session... like I don't know.... removing more anti-2nd amendment gun laws? Meet the new boss, the same as the old.

Store Owner Shoots Robber In the Butt; Doesnt Get Charged...
JayC replied to a topic in Handgun Carry and Self Defense
Umm, unless we think the store owner isn't telling the truth... and I'm going to believe the word of the store owner over a BG robber personally... The owner was completely justified in shooting the suspect. You have a BG who has physically assaulted the owner... The owner is in a place he is legally allowed to be... and the bad guy turned and caused the store owner to be in fear for his life... That sounds like a clean justified shooting under TN law to me. My understanding of TN law is, if you're any place you're legally allowed to be (ie outside your store) and are threatened with serious bodily injury or death, you're free to defend yourself. -
Carry was not addressed in Heller and McDonald because the lawyer running the case specifically did not want to address it in those cases. Since they made no claims against laws banning carry, SCOTUS made no ruling on the matter. That same lawyer has filed a new case Palmer vs Washington DC which does address the right to carry. The lawyer in question says this was the plan all along to go at this bit by bit.

Tygard was the guy trying to violate state law by passing a beer ordinance requiring restaurants to post... So he is NOT pro-2nd

Exactly which case has SCOTUS ruled that carrying of firearms is not covered by the 2nd Amendment? Neither McDonald nor Heller state that, so which case exactly are you referring to?

Self Defense via Vehicle Break In?
JayC replied to cyh1830's topic in Handgun Carry and Self Defense
And that is exactly how TN law is currently written, it's assumed somebody bold enough to break into your house poses a threat of serious bodily injury or death. The same for your car, and any out building, screen porch, etc. We're in complete agreement. -
Self Defense via Vehicle Break In?

This incident was covered in one of the videos you watched to get your carry permit. If you confront a bad guy on your property and he runs away don't shoot... If he turns and moves toward you, I highly doubt you'd ever be charged in TN for shooting the guy dead... reasonable fear for your life and all... But, if DA's around TN are any indication, if somebody is on your property and night breaking the law, you're going to have to try really hard to get charged with anything.. In the last 18 months we've had cases where homeowner shoots through a door killing an off duty deputy who was trespassing, and was no billed 3 times in a row (and lets be honest if it hadn't been a deputy it would never have even gone to the grand jury to no bill)... and the family who shot a teenager in the leg for playing "ring and run" and no charges were filed. Both clearly didn't meet the definition of the law as it's written today. My personal opinion, bad guy breaking into your car on your property turns towards you when confronted... is a justified shooting in my book, I'm never going to vote to charge or convict. -
Self Defense via Vehicle Break In?
JayC replied to cyh1830's topic in Handgun Carry and Self Defense
It's not the act of carjacking that turns it into a justified shooting, it's our "castle" doctrine which includes vehicles. If somebody forcibly enters your vehicle why occupied you are assumed to be in fear for your life. The same as if they broke into your house.... Doesn't matter if they're carjacking you, or trying to get into the car to beat you down... forcibly entering a persons car uninvited is the same as breaking into their house under TN self defense laws. -
Better than nothing, and in some rare cases you might have just enough time to 'arm' yourself with a loaded firearm.

Just think what 2 to 4 weeks of real training would do Mix in a bit of discipline and you'd have real problem on your hands. It doesn't say much for the Libyan army, that these untrained citizens have taken over half the country, and are advancing.

Go to the city hall/county admin building... ask for a map of city and state roads in that section of town... they're required by law to allow you to review that map for free if it's for personal use.

It's still on their checklist... they ask to see it from time to time.
