  1. Not in this state they don't. They can only hold you if there is probably cause that you have or are about to commit a crime, They can ask for your ID all day long, but rarely do they have a legal basis to require you to provide ID, and frankly, unless I'm suspected of criminal act, it's none of their business who I am... The truth is I generally treat LEO's the same as I would any other person... They walk up to me, shake my hand and introduce themselves... start up a conversation with me, I'll treat them just like I would any other person doing the same... they come up and act rude, and start asking me personal questions that are none of their business, I'm going to politely tell them no thanks. I've had police officers ask for an ID, I've politely said no, using joking about it... never had an incident or problem out of it... then again I've opened carried around a lot of officers in my day and have never once been asked for my HCP. So maybe I'm lucky... Truth is I've never really had a bad experience with an officer, but I know I've just been lucky so far
  2. Yeah, 16 folks walk into a steak and shake with a firearm in a holster, with their wives and children, sit down and order food... And obviously they could be some militia unit who is about to Rob the place... Oh wait, they could also be a sleeper cell of AQAP terrorists thee to attack the place! Come on we can all come up with what if... But none of them reach the level of probable cause... I don't fault the officers stopping by, saying hello, and interacting with these guys... I don't even fault them for asking for ID, just how they reacted when they were politely told no. It's clear from the video that this was not a group of master criminals, just a bunch of guys who were having dinner, and talking about firearms... And very likely to take offense to be asked for their IDs. You didn't need 5 or 6 officers to respond or send a patty wagon down there. Two or three officers should have been plenty and it shouldn't have taken them 5 minutes to determine no crime was being committed and move along.
  3. Under tn state law, if somebody forcibly enters your house, it is assumed you have a reasonable fear of death or serious injury. You are under no obligation to attempt to offer surrender to a home intruder under tn law. Even more importantly no DA is going to file charges against a home owner who shoots two men who broke into your home and are armed in the middle of the night. Further there is some really bad advice... First there is no such thing as a fair gun fight, there are people who fight fair, and winners. If somebody comes into your home armed, they're not there to bake you cookies... Use every tactical advantage they offer you, if that means exploiting their mistake of turning their backs to you... Take it. Once they're aware of you and your location, you have reduced your tactical advantage... Much better to be arrested and go to trail, than to be dead and God knows what they do to the rest of your family. Nobody here will call you a coward for shooting an armed intruder in the back.

  5. And that point is what? That law abiding adults can carry firearms for defense without permission for the state? Or that law abiding citizens shouldn't be harassed by the police when it's obvious they aren't master criminals? Just how long did it take the officers to figure out these folks weren't at the steak and shake to rob the place?

  8. Schools are off limits at all times, with very limited exceptions. Your pretty much out of luck... Call your state legislator and complain about it... That is the only way it gets fixed.
  9. Maybe I'm just naive, but ball and powder is an arm, and the legislature is limited to only regulating the wearing of arms, taxes are a form of regulation? Having a standard sales tax apply to ammo, might be legal, having a special high tax on an arm (ammo) would seem not to be within the bounds of our state constitution.

  12. Really? It seems to me his track record of screeching the sky is falling has been pretty much spot on? This is the guy who said there would be a bubble based on government backed mortgages, and a resulting crash because of it... back in 2003. And what do we know, 5 years later, crash.... for the exact reasons he outlined. Maybe if you could really see the road we're headed down... caused by out expansion in government debt, and devaluation of the dollar by the Fed, you'd be out 'screeching' about it too. If we see a sovereign debt crisis in our life times, it very well maybe the end of freedom in this country. The reaction will be 100x worse than Greece, IMHO. And we're headed for that debt crisis full speed ahead right now.
  13. The problem is that social conservatives (mostly Christians) want to control people's lives just as much as socially liberal progressives... It's because we've lost sight of the ROOT cause of the problem... The problem that you run into is a fairly simple one... people are scared of having gay marriage forced on them... run a business, have a religious issue with gay marriage... doesn't matter if they have a valid state marriage license you must provide health insurance to the spouse... So while the gay marriage license gives freedom to one group, in our current situation it takes freedom away from another. The solution to this problem isn't banning gay marriage, the solution is getting the Government out of marriage licenses altogether. Why exactly does the Federal, State or Local government need to be involved in marriage to begin with? If we completely do away with government involvement in marriage, then government looses the power to regulate which marriages you will or will not recognize, giving you your freedom back, at the same time allowing whom ever wants to get married to call themselves married. Force people to focus on the root cause... get rid of it, and freedom will be restored.
  14. They just should have passed a law that stated all exigent circumstances are null and void in IN.... that would solve the real problem... no warrant, no entry, like the Constitution intended.
  15. I'm pretty sure the law is a reasonable person standard... Meaning if a reasonable person believed the entry to be unlawful this law kicks in... a lot better than a true unlawful entry requirement. This isn't a lot different from shooting somebody laws... you have to convince a jury of your peers a reasonable person would think the entry to be unlawful.

  17. Lets set aside the Federal question for a minute... FFL's are regulated by F-Troop I mean the BATFE... Most states use a Federal background check program... that costs the dealers and gun owners nothing.... (Well at least nothing directly) TN passes this make work law called TICS, to employee a bunch of desk jocky's at TDOS who for the most part take the information and check it against NICS for free, and pocket $10 unconstitutionally. Technically there are other checks they can do, but I've NEVER seen a denial except through NICS. Where does the TN Constitution give the legislature the power to regulate the purchasing of firearms? It seems the Constitution forbids the legislature to regulate anything except the wearing of firearms. So why do we have TICS? Why do we have a super high ammo tax?
  18. There are people (like myself) who strongly believe in God given rights, that don't agree with the parking lot bill. Some of us believe that property rights are just as important as the rights protected by the second amendment. Now if the law was to ban posting in government parking lots I'd be 100% behind it. But my property is MY property and I should be able to set the rules for my property... don't like my rules, go do business with somebody else. The problem here is that people won't take a stand... I will never again work for somebody who says I can't have a firearm on my person at all times as a condition of employment, let alone I can't leave one out in my car. I won't go to a business which is posted and give them 1 red cent. So for me the problem is solved.... The places I can't avoid? The government! I have to do business with the government I have no choice in the matter, and they can and do prevent me from carrying a firearm for protection... We should be stripping the government of it's power to post, not private business owners. Want to carry where you work? Simple find a business that doesn't care, start your own business, but don't just sit there and beg the government to come to your rescue! You're a free person (or at least they keep telling us that lie), put on your big boy pants, and go earn a living at a company that respects your basic rights to protect yourself. People who want the parking lot bill are no better than the OWS crowd IMHO... You can solve this problem without the government passing another law. Now, if you want to repeal parts or all of 39-17-1359, I'll be there with bells on
  19. I can tell you exactly why it's still posted, Beth Harwell! She won't sign the order removing the postings, if people would flood her office with calls, it could be unposted tomorrow. And I'd rather be armed going to and from the plaza than not, while the plaza might be safe the areas around where you have to park often aren't, even more so after dark. More importantly, those security guards have no obligation to protect me...
  20. Well, I try and stay out of these discussions... but, I'll point it out again... Carrying a firearm to protect yourself is the key issue here... don't discourage people from carrying just because they can't easily conceal the firearm, OC is better than NC (no carry). There are a lot of people who for whatever reason can't easily conceal... I'm one of those people, my business dress does not lend itself to concealed carry of my Glock 19 even more so during summer months. I'm wearing slacks and a dress shirt tucked in... it's the middle of the day and I need to run into the gas station to pick up something... I'm better off leaving my pistol in the vehicle than on my person just because it's not concealed? Hogwosh More importantly, what does it matter? It doesn't hurt me if somebody carries concealed, nor does it hurt me if somebody carries openly... At the end of the day they're a law abiding citizen who is old enough to know better. It's not my place to judge them on what works best for their personal safety.
  21. Less than perfect? How about not even constitutional. The TN Legislature is limited to regulating the WEARING of firearms... last time I checked, that did not include purchasing a firearm. So why is it we have to pay a $10 fee on every firearm purchased via a FFL? It's nothing but make work for TDOS, desk jobs which do nothing to protect us and violate our God given rights everyday. I'm hoping one day we can get a class action lawsuit against the state for all the money they have stolen from us.
  22. And ask yourself why Legislative Plaza is still posted? One person is holding it up, Beth Harwell, she could sign a letter tomorrow with the State Senate and the Plaza would no longer be off limits. RINO Beth Harwell, the problem.

I've used them in the field for training, to prevent a pistol from becoming lost, due to falling out of the holster while getting up and down, moving over obstacles, etc. For those environments, they're ok, I'd never voluntary wear one day to day because they do catch on stuff, and can snag when trying to draw the weapon.
  24. I say you could put the videos, and an online test on a website, and allow people to take the test from the comfort of their own home... Total cost to the permit holder?? Maybe $5 But, I don't think we need a test at all, look at Vermont, Arizona, and Alaska, no permits are required, they don't have any more incidents of citizens breaking the law than we do here. There is no reason you can't leave the DMV with your permit, do a simple NCIS background check, if it passes, add licensed carry as an endorsement to your drivers license. Or for that matter lets just have Constitutional carry and be done with the silliness of the state being involved.
  25. Read the quotes at the bottom... The guy makes 90% of his living from corporate welfare mandated by the state.... IE he is a handgun permit instructor... He has a vested interest in people using his service to get a carry permit, and not using open carry which requires no permit in his state. Simple rule - follow the money. Get rid of the corporate welfare... no more mandated useless courses required by the state to carry a firearm... less than 1% of people fail the current course, it is completely useless as a method to bad behavior with firearms.
