  1. Parks Bill - State/National 'parks' are opening right as of today. Cities and Counties can start to pass resolutions blocking local parks from carry starting today. Local Parks which aren't subject to one of the above resolutions will be open to carry Sept 1st. Long Guns - Is law today, you can start to carry long guns tonight legally. Senate amendment #3: Good news!

  3. CA has it wrong... the bill has not yet been recalled, and likely will not before midnight tonight...
  4. No clue, clearly not soon enough... Maybe he'd feel more comfortable moving back to NJ? I'm sure a large chunk of us would be happy to pay for a one way ticket there
  5. As it stands right now, the bill IS on the Governors desk waiting to be signed, the 10 day limit to be reached or the Governor to veto the bill. Things that can happen... 1. Nobody does anything and the bill will become law at 12:01 June 13th, 2008 2. The Governor vetoes the bill before midnight tonight. The bill would be returned to the Legislature for a possible override vote (there is some question whether we have the votes for an override on this or not.) 3. The Senate passes a recall motion today, the house has already passed the motion so if the Governor agrees he can send the bill back to the Legislature (It's my understanding this would have to all happen before midnight tonight). If there was a sucessful recall motion, the bill could be changed and resubmitted to the Governor kicking off another 10 day (minus Sundays) timer. That appears to be the complete list of what can happen at this point.
  6. I don't think this is correct... If you watch the video from the "recall" the motion set forth was on a recall vote from the Senate the House would approve the recall as well. I'm not an expert on recalls (they don't happen very often) but it appears as if both the Senate and House must approve a recall, and I can't find any record of the Senate doing that yesterday. As of right now the bill is still sitting on the Governors desk and unless he veto's it, the Senate approves a recall, it becomes law at 12:01 tomorrow. Now the House may have given the Governor perfect cover for a veto but doing this... If anybody has other information please post it, it's not like we see recalls on a regular basis.
  7. That is my understanding as well... Which means the Bill is still on the Governors desk waiting to be signed today. It's also my understanding the Governor is heading out of town today as well.
  8. Agreed, we can get the "beer permit loop hole" closed... Just have Rep Todd and Sen Jackson both propose an amendment to a budget bill to block the loophole and force it through... If he vetoes the budget bill they'll have to come back to town to deal with that anyhow. Time to stop playing nice.
  9. Just a heads up, it's being reported the Senate did not vote to resend the bill, so unless the Governor veto's it will become law.
  10. FYI, it's being reported on TFA's forums that the Senate did not vote to recall the bill... If this is the case, the Governor will have to veto or allow it to become law tomorrow.
  11. There is a $200 or $300 fiscal note on the bill from the TWRA (I'm guessing to update some documentation) so it must go through the budget committee before going to the floor.
  12. My point is we need to be calling our Legislators and pressing them to hold the line, all state parks must be included... 1 exception will start the floodgates of all major counties pushing to include their state parks as well.
  13. We can only hope the 'compromise' stops there, but I'll bet you can name at least 3 Legislators who will propose an amendment to this 'new' bill requesting that state parks in their county be included in the list of banned parks.
  14. Again, I think our best bet to open local parks was to pass this bill as written, and come back next year and remove the opt out language after there had been no incidents in state parks. None of us have seen the compromise language yet, I have no clue how they're going to determine which state parks are in or out... I know that if they start naming 1 or 2 parks, there will be Legislators who will be requesting that state parks in their counties be included as well. Until we see the language of the compromise none of us have any clue how bad the damage really is... Here is the score card... All state parks, and at least some local parks would allow carry within a week or so after an override of the governors veto... Now, no local parks not a single one... and some number of state parks will not allow legal carry. Until we see the language of the compromise we all need to continue to call our Legislators and tell them how important a clean bill is, at the very least all state parks must be open to carry, no exceptions.
  15. I don't think the beer board was used as an example, but a city planning commission was using the exact same tactic that any successful beer permit ordinance would use. It might not have been fixed until this year, but the problem should have been taken care of in some of these bills working their way through the legislature right now. To give up local parks completely to cover a 'loop hole' in the law that should have been taken care of as part of the original bill isn't a win... We might only have another year to pass pro-firearms legislation before the legislature returns to anti-gun status. Not getting some form of local parks carry through is a shame. Also, we don't know the language of the compromise yet, this mention of state parks being completely within the boundaries of certain cities/counties could include a bunch more than just 1 or 2 state parks. Clearly the bill we had passed, was better than what we're getting, or could get if the legislature would just stand firm and override threatened vetoes.
  16. The overall problem with 39-17-1314 had been identified to some State Senators over a year ago, with a request that it be fixed.

  18. It's my understanding that National Forests are covered under state law not federal. You are allowed to carry in NF's out west, where as you can't carry in a NP anywhere. My guess is that the public recreation language in 39-17-1311 is being used as the reason to prohibit... Either way, HB0716 clearly repeals any such statute... since it says national forests and recreational areas are included.
  19. Nope appears to be the exact opposite... HB0716 as transmitted to the Governor on June 1st... Includes 2 Senate Amendments 2&3... This is Amendment #2: http://www.capitol.tn.gov/Bills/106/Amend/SA0483.pdf All that Amendment #3 does is remove WMAs from section 1i (because there is a WMAs bill working it's way through the legislature I guess). So as I understand it... National Parks will be legal under TN law tomorrow (unless the Governor vetoes this bill) but we'll have to wait for Feb of 2010 for it to be legal under Federal law. So National Parks - Feb 2010. National Forests generally follow the laws of the state it is within... So should be legal to carry in starting tomorrow. The issue is what about NF's which also happen to be WMAs (since we're still waiting on the WMA bill to pass)... I'm not sure... It appears to me that the NF is first a NF and therefore would be legal to carry in, but that question has still not been answered. Long and short, LBL should be legal to carry in starting tomorrow barring a veto, although you should contact the Ranger office and ask them to be certain, don't except a standard short no, ask them how HB0716 impacts the policy.
  20. My bet the manager was making this up... I've been to Applebee''s in 3 or 4 different states that allow CCW/HCP holder to carry and not a single one has been posted. Stranger things could happen, but I seriously doubt you'll see any major chain ban carry.
  21. If it had passed it not only would have banned armed security... it would have banned owners from having firearms in the establishment to protect themselves... Also, no more armed deposit service, or having ATMs in the establishment... It was a bad idea, and not well thought out....

Yes because nobody told them before they submitted the bill it was likely illegal (quoting them the state code) and they didn't just go ahead anyway without first seeking information from the council's legal team? No that would foolish wouldn't it? Oh wait that's exactly what they did, my bad.
  23. I disagree, there are some smart anti-gunners out there, just as smart as any of us pro-gunners... I don't want to give out a road map to anybody reading on how to word the law to possibly bypass 39-17-1314 but I think it could be done... The key here is that the soon to be pulled ordinance bars possession which clearly violates state law, but state law only bars direct impact, not indirect impact. I hope you're right and this is over... but I personally think we need to keep our eyes open of the course of the next month or two to make sure the metro council doesn't try to pull a fast one on us.
  24. If this company is in TN, then you could not be charged with criminal trespass if they found a handgun in your vehicle. But as many have said, they could and probably would fire you. There are very limited conditions where a private company can force you to submit to a search (or a search of your vehicle)... Simply put they can not force you to allow them to search your car, you can always refuse and leave instead.... Again they will likely fire you for refusing the search, but they can't force you to allow the search. As people have stated, if they do force the search it would not be a civil rights violation (because generally speaking civil rights violations can only be committed by the government or entities working on behalf of the government) but it likely would be a lawsuit looking for a place to happen... As a general rule, private businesses do not have the right to force you to submit to a search, you must consent to any search, otherwise they are likely breaking the law.
