Castle law is simply a legal concept. Most states have varying forms of the castle Doctrine. Florida made a lot of noise when they removed their “Duty to retreatâ€. Tennessee does not have a duty to retreat. -

A presumption can be overridden. Take for example the “presumption†that you are impaired at .08% BAC. That can be disregarded by a jury if they believe that you are not impaired even though you blew above a .08. So back to my question… you shoot a kid (an unarmed kid that is clearly no threat to you) that is running away from you or trying to surrender; do you think this “presumption†will keep you out of prison? And BTW this is a question not an argument; I don’t know the case law in Tennessee well enough to argue this. Common sense just tells me that you can’t execute a kid for making a stupid mistake. -

I disagree. If what you are saying is correct; what you tell the DA would not matter. I need to see what part of the law you think gives you a green light to execute a criminal that is surrendering. Disclaimer: I am not saying that is a bad idea; I am just saying that I do not believe Tennessee law allows you a free kill just because someone is in your home illegally. -
I don’t see the delivery system being as big a problem as the round that it is delivering.

I think you are misunderstanding the law. There may well be a presumption if you are trying to protect yourself. I contend there is no such presumption if someone is trying to get away or surrender. -

It is my understanding that Tennessee has recognized the Castle Doctrine for many years. Most of the “noise” that is being made about the Castle Doctrine is either removing the “duty to retreat”, which I don’t think Tennessee has ever had, or extending your rights to the rest of your property and a motor vehicle (car jacking). Are you saying that if you enter your home through the back door and you see a 12 year old kid that has been burglarizing your home trying to get out the front door; you can just shoot him in the back and call it a day? I contend that unless a jury would believe that you are in danger of death or great bodily harm; you will most likely do prison time. But I could be wrong. -

I think so too. Okay I exaggerated it’s $198.15. I need to find an alternative to Comcast. First let me say before everyone starts dising Comcast that I am really happy with the quality, content and service of Comcast. But $200 a month is ridiculous. I have everything Comcast offers including Internet, all premium channels (expect the skin channels) and two HD boxes. Here’s my priorities maybe someone has some ideas. 1. High Definition. Almost everything I watch is HD including local channels. (4 TV's, Two need HD) 2. Fast Internet. Can’t complain about the speed of Comcast, it’s so fast the numbers don’t matter anymore. We are totally cellular and don’t have phone lines, so replacing it with anything across phone lines (like DSL) would involve the cost of basic phone service. 3. DVR. Gotta have some form of it. I want to watch when it’s convenient for me, and I don’t watch commercials. 4. Premium movie channels. We watch a lot of movies. But I guess I could give this up if it was cost effective to join some kind of movie club. 5. On-demand premium channels and other shows. I guess I would have to give this up unless I stay with cable. 6. Equipment costs. When one of my boxes has a problem I take it to the office a few blocks away and they give me a new one. Any ideas on what I can do without it hurting to much?

You should be aware of the fact that if you use deadly force at any time other than when a reasonable person would believe that you are in immediate danger of death or great bodily harm; you will more than likely find yourself in criminal court fighting for your freedom. There is no guarantee against a civil suit. If you are not charged in a shooting that is not a ruling that it was a justifiable shoot. A court would need to determine that it was a good shoot, and then you could try to recover expenses from whoever sued you. Good luck with that. There is no “Free shoot†in any state that I have ever heard of simply because someone is in your home. -
All that is required is that the notice uses language that is substantially similar to the language provided in the statute.

The short version for a handgun… Forget USPS, declare exactly what you have at the counter of UPS or FED-EX. UPS must be at a terminal. Just keep in mind that even if you are legally shipping a firearm you are still at the mercy of the shipper regardless of what the law is. I recently was refused a legal shipment at the UPS terminal in Murfreesboro and had to drive it to Chattanooga. Have a back-up plan.

You notice how in these “zero tolerance†cases no one wants to take responsibility. This is The school administrators are spineless weasels and so is the cop that responded. If required to do anything, I would have set the kid a juvenile appointment and left her at the school. Hey Sheriff, when did you stop enforcing state law and start enforcing school policy? “Zero Tolerance†policies are for people that are to lazy to do their jobs.

As Mike pointed out the odds don’t matter. If they do…. What are odds of surviving an armed robbery if you are unarmed vs. the odds of surviving it if you pull a weapon? I’m absolutely sure I know the answer to that question, but I would still like to be armed. -

I hope that now that you know this you don’t try to bypass the Sheriff without your customer knowing exactly what he is in for. <O:p</O:p Right or wrong I’m pretty sure there won’t be any ADA worrying about wiping egg off his face, but there sure could be an innocent citizen spending tens of thousands of dollars on his legal defense. <O:p</O:p We have discussed the AG ruling thing before and I don’t think (although I will admit I could be wrong) that an AG opinion can block a case should the court decide to hear it; it’s just an opinion. <O:p</O:p <O:pI am not implying that I think he is right, but getting arrested for something the Sheriff has told you is illegal can be expensive. </O:p -
I’m saying that I don’t care if it started over a woman, the person doesn’t like your looks, you are all drunk and no one even remembers what it started over… etc. I am saying that it does matter whether you are a willing participant or are attacked without provocation. And I submit that it absolutely is not. First off… if you voluntarily get into a fight while you are armed with a handgun you are an idiot. You keep your mouth shut, you walk a way, you run, you do whatever it takes. Second… people can suffer death or great bodily harm in a fight; that is what happens. If you voluntarily enter into a fight you are accepting that that may happen. If someone chokes you out… boo friggin hoo for you; you don’t get to kill them because you are not an innocent victim. That is the point we are in disagreement about. The law is more that just the written law; it is case law and interpretation by Judges and Juries. The law doesn’t care if you think you are in danger of a death or great bodily harm, it matters what a “reasonable person” would believe (that is a jury). People get choked out in fights all the time; you don’t die, you pass out. However…. I am not an attorney, I don’t play one on TV and I didn’t sleep at a Holiday inn last night. We are agreeing that if either party pulls a weapon that is a deadly weapon by its very nature such as a gun or knife; then the other person or a bystander has a green light to take them out. And as I said above; I content that the choke hold won’t fly with a jury; they will send you to prison where you belong.

I spend a lot of time on the phone with my elderly parents trying to help them with simple computer tasks. Is there a way for me to have control of their computer and them be able to see what I am doing? Also, can I add video conferencing or something to be able to see and talk to them? What’s involved software and hardware wise? They are running XP home on an AT&T DSL connection and I am running XP Media Center on Comcast cable. Thanks

I don’t see it changing. But if I wanted to change it I would try to get legislation that would remove any liability of the businesses owner in a shooting by a HCP holder. In your travels around talking to business owners, what reasons have they given you for the signs?
