I’ve seen this question posted several times on the net and have not seen anyone reply that they have been arrested. I think most of these minor laws would be add on charges. I would guess that it would all depend on how and why the ATF was looking at you or your weapons.

I don’t agree with any of his views on firearms, but it really pizzes me off that he wants to dance around the issue. This man does not believe that you have a right to own arms but he is trying not to say that in case the SCOTUS rulings say you do. And he under no circumstances believes that you should be able to carry guns to protect yourself from the criminal thugs that will help him get elected. The gang bangin’ thug kids of his Chicago constituents are the ones that will be pulling people from cars and putting a bullet in their head.

Mine would be the size of a J-frame. It would hold 15 rounds of .45ACP. It would have the accuracy of a 6†L-frame. It would not be black It would not have any Polymer in it. It would not blow up when I fired it. I could put my finger on the trigger without an ND. Yep…. That’s what I would design.

I doubt you will find any information like that is documented. It would require that all information be in all Police reports and then someone would have to go through and build a data base on accidental or negligent discharges. Just do some checking every time you hear of an AD or ND. It will be the same name most of the time.

Unless it has changed recently you can ship a firearm that you already own to yourself in another state for the purpose of hunting “or other lawful activityâ€. The problem comes in finding a carrier that will do it. Can’t ship a handgun through the USPS, UPS won’t ship to a non-licensee. Fed-ex might…. It is Federal law that you notify the carrier when shipping a firearm.

Well… back in “the old days†when most everyone that carried all the time was carrying S&W or Colt revolvers, Model 39’s & 59’s or 1911’s there were AD/ND’s (whichever name you like best) but they were few and far between. When you had someone at gun point you had your finger on the trigger without worry that your weapon would discharge. Enter Glock….. Now AD/ND’s are common place, they are almost always Glocks and the Glocksters claim that is because all those people are not properly trained or they put their finger on the trigger. You have to do your homework and make your own decisions. I don’t know how many times I have seen someone post that magazine disconnects are in the same “lawyer gun†category as internal locks. Clueless…. They are absolutely clueless. But that doesn’t keep them from offering their opinions. Everyone is responsible for choosing a firearm that is the best fit for them, the way they carry, and the environment they are in. It’s not only your safety but the safety of those around you. Get what you want, what you can handle, and what you feel comfortable with. I would say that if you have a weapon that you don’t feel is safe to carry with a round chamber; that is not a safe weapon for everyday carry, get rid of it. Get something you can trust. And practice…. a lot.

I did it prior to 911 one time. It went kind of smooth; other than a new agent that freaked when I told her I wanted to declare a firearm. But when I got to California my bag came out on the carousel with a big red tag on it that said GUN. I didn’t do it anymore. GUN

I don’t know anything about it other than its not a Remington; they are the importer. It’s a Baikal made in Russia, but that should help you find some info.

I agree that cops make mistakes, but I don’t agree that it is necessarily ignorance of the law. (Although sometimes it surely is, especially with new cops.) Cops are not college graduates that have went on to law school and passed the bar. That certainly could become a requirement but I don’t think you would have many people applying with what cops make. I have never said it is the best system that it could be. I have always said that we have a legal system not a justice system. You are correct. I have tried to give advice that might keep some people from incurring legal costs that could be financially devastating to them. But hey… this is an internet forum and statements like “Always refuse a request to search†“always invoke your 5<SUP>th</SUP> amendment rights†“the cops have to have a warrant to search your car.†or “Never submit to a BAC test.†will be met with applause. Those statements show as much ignorance about the law and the Constitution as someone that would say “Always agree to a request to search†“Never invoke your 5<SUP>th</SUP> amendment rights†“the cops never need a warrant to search your car.†or “Never submit to a BAC test†I have tried to explain to my kids and family how to know what decisions to make when faced with those decisions. But like everything else in life it depends on the circumstances. If you are going to teach your kids how to “Survive a traffic stop†don’t you think they deserve to have the best information available to them? Factual information based on the law; not emotions, not what someone thinks the law should be and certainly not based on a parents hatred for cops. It’s not fair to them; a conviction for a minor drug charge, DUI, or even domestic violence could destroy their career plans. I believe that our founding fathers meant to protect the innocent people from unreasonable intrusions by the government; not to tie the hands of the police or keep them from putting criminals in jail. That is why they use the term “unreasonableâ€. Unfortunately not all of us agree what is unreasonable and what is not; so the courts decide. The fact that a Judge rules a search inadmissible does not necessarily mean that the cop did anything wrong; and he should not be punished for it unless there was evidence it did it intentionally. I have never met anyone that has never made a mistake on their job; cops included. I enjoy discussing criminal law and the Constitution as it applies to us. I can offer a view from someone that has stopped countless cars, conducted many searches (all of them legal and most without a warrant) arrested many people and let many go, and impacted the lives of people both for the good and bad. My opinions will not be popular with many but my target is the young. They don’t get a fair shake because they don’t have any experience and their parents are sometimes not much help. If I can make them understand that there are no pat answers and they need to be armed with information and not hate; I have accomplished something. <O:p</O:p I don’t see anyone that can make an intelligent argument or add something of value to the discussion as a jerk. -
That’s not how I read it, but maybe I’m wrong. That can happen in any community right now. If you call the cops and say your neighbor has illegal weapons; cops are bound to act. If your information is good it can be anything from simply asking your neighbor about it, asking him for permission to search, or attempting to obtain a warrant based on any information they have. But just telling you they have no probable cause to do anything probably will not be the answer. <O:p</O:p I just see a big difference in being notified of criminal activity and randomly going door to door and asking to search.

I have to add that this borders on coercion and duress. A law abiding person being confronted with uniformed, armed Police Officers asking to search their home can be intimidating. <O:p</O:p Any guns they find that have been used in a crime will be challenged under an unlawful search. <O:p</O:p I have been sent to homes where the parents called in and wanted their houses searched for drugs or guns. I think that is okay, although I would advise parents that there are better ways to handle the problem than getting the Police involved. <O:p</O:p Looks like DC will have another case going to the SCOUTS. <O:p</O:p Here is a better way to handle it.....

I hope these people are not consenting to searches. <O:p</O:p I would also be curious to know if any Officers have made their concerns known on this issue; Police Unions, PBPA? <O:p</O:p I understand that they are not violating anyone’s rights by asking; but this is wrong at face value. <O:p</O:p If they want to set-up some kind of “gun task force†where Grandma can call in and have her home searched if she thinks her little gang banger thug Grandson is keeping guns there is one thing; but this…. <O:p</O:p Especially in a city with one of the highest crime rates in the country. Thugs don’t hand over guns and they don’t allow searches. How many man hours are being wasted on this?

I don’t know if the story is true or not, but those pictures are said to be from a Deputy Sheriff in Louisiana that had been practicing at the range wearing a Sheriff Department windbreaker. After qualifying he reloaded and holstered the weapon. When he got home he pulled the paddle holster from his pants and apparently the draw stings on the windbreaker were caught in the trigger and the weapon discharged. It shot him in the leg.

I have never owned a Sigma, but I have owned more S&W’s than I can count. If you think you have a bad mag call them. After discussing the problem they will probably either have you send the gun in for repairs or they will send you a new mag.

Take a look at your community. If your chances of being killed or injured by a “criminal†are greater than being killed or injured by a traffic offender; that is where your Police Department should be directing its manpower. They don’t need to hold a bake sale; they don’t even need to write tickets for revenue generation. The costs are paid by home owner’s property taxes and sales taxes. Historically business and industry has paid a huge share of these taxes through their own taxes and the high wages they were paying. Well things are changing. Industry is being given a pass on taxes to either stay in the state or to move into the state, and wages are dropping (in comparison to the cost of living). As jobs and wages decrease; crime increases....Someone has to pay the bills. I don’t know any cops that are confused as to why some people don’t want to deal with them. People that don’t like dealing with cops have a reason. You would have to ask each person what that reason is. As a former cop I don’t want to call the cops for anything. A big part of some people’s problem is that they don’t understand the law or the Constitution. They want to have a trial on the street to determine if the stop or a search was lawful. It doesn’t work that way and hopefully never will. Our founding fathers intent was to protect innocent people, not criminals. That is why they used words like “unreasonableâ€. We have a system in place to deal with those questions and problems as they come up. Most people’s perception would not change if cops stopped writing tickets. If Serpas (or any top cop) was to put any kind restriction on his Officers that are legally and legitimately stopping cars he would be derelict in his duties and crime would rise. <O:p</O:p Unfortunately cops are generally reactive not proactive. Vehicles are usually the biggest identifier in crimes and they are what is used to transport the drugs; that is where you will find the criminals. -
I don’t understand. You are a Police Officer whose department requires that you carry a Glock with no other options and you are a part of a military unit that uses Glocks?

Then buy what you want. I have found that starting a thread of what you want, placing an ad on GOLSN, and letting friends and family know what you are looking for gets much better deals than waiting for something to be advertised. Especially if a motivated seller is in your area.

Most all Police Departments have quotas and very few of them have to do with revenue generation. (Although writing 3 MPH unless it is the PC ticket for a DUI or a criminal arrest tells me that is probably what it is.) <O:p</O:p My department called them “acceptable standards”. They were 100 tickets a month for a Traffic car and 10 tickets a month for a district patrol car. That’s five tickets per shift for a traffic car and a ticket every two shifts for a district car. If an Officer couldn’t meet that he wasn’t doing anything. <O:p</O:p I think that a Chief or Sheriff saying that his department doesn’t have quotas is bad. If a cop doesn’t write any tickets he is going to be called in and ask about what he does for 8 hours. <O:p</O:p This is why I said earlier that you don’t want an Officers discretion taken away. In district patrol I would stop several cars per night. I almost always had a traffic violation for PC for the stop, but would generally not write a ticket unless I was arresting someone. If required I could have ticketed everyone I stopped… but that would not have been good for anyone. <O:p</O:p “Revenue Generation” is usually the out cry and rarely the truth. (although it does happen) But is revenue generation really a bad thing? Our industries are leaving, and our economy is failing. The more jobs we lose and the lower wages go… the more cops we need. Neither of the two parties are going to reduce the size of government; it just keeps getting bigger. So as a homeowner my property taxes will increase as the economy decreases. I’m more than willing to shift that burden to traffic offenders. If you can’t drive right and don’t know how to stay out of the way of cops….. pay up.
