  1. I know you have trouble comprehending anything that involves a cop; so let me explain. On a small bag of pot I had discretion. I could let you dump it and continue about your evening, or I could place you in handcuffs, tow your car and take you to jail. If it’s someone that I think just learned a lesson and really isn’t a bad person, I can (and have) let them go. If I am presented with “do you have a warrant?†“Am I free to go?†“My Dads an attorney and he told me never to allow a cop to search my car.†I might decide that you need to learn something about both life and the law, and I hook both you and your car up and haul you off. Choices man…. You have to make them and then you have to take responsibility for them. BTW… your attorney could do whatever he likes. At that point my job is done and all I do is take the stand and tell the truth. I really don’t care about the outcome.
  2. There’s the key. You might consent to a search if you think the Officer isn’t being a dick. That works both ways… If the Officer has you for a minor infraction (traffic, bag of pot, open liquor) and he is asking for permission to search when he already has probable cause; he may be trying to decide if you are going to be a dick. Moral to this story? Don’t be a dick.

    Revolvers?

    Everything depends on the application. I have many handguns; revolvers and semi’s alike. But a revolver is on the headboard of my bed protecting me and my family.

    Same thing happened to me at UPS. I called corporate and it is not their policy; but they would not override the decision of the guy at the hub here because a firearm was involved.
  5. Possession of a stolen firearm in Illinois was a felony when I was a cop. I couldn’t let someone go if I wanted to. I had to take them in and turn them over to the Detective Bureau; they would interview them and between them and the States Attorney on duty they would determine if they were going to be arrested/charged or not. But one of the forum FFL’s told me Tennessee has no such law. I haven’t bothered to check. Being found innocent at trial or even having charges dismissed can be pretty expensive.
  6. I don’t see where it is even an issue as long as both parties lay out their requirements prior to meeting. Prior to getting my C&R I told the people I sold to that I would need to see a photo ID issued by the state of Tennessee. I only needed to know that I was not selling to a minor or an out-of-state resident. Now that I have a C&R I have to keep logs of what I have and where they go. So names and addresses are required. I don’t mess with any of the criminal background questions because they are not required. The State nor the Feds has made background checks available to me and they only require that I not sell to someone that I know to be ineligible to purchase. I have heard stories of ATF agents making illegal transactions (from forum ads) and arresting the sellers. I don’t know if they are true or not but I have had people respond to my ads from other states and saying they could meet me in my area. That would be a pretty expensive trap to fall into.
  7. More cops than not will want a magazine disconnect. It’s the general public that doesn’t want them.
  8. Even though he is not required to, if the Police Officer is not explaining to you what is going on there is probably a problem. There could be many reasons for it. I have said this before, but I have never asked anyone for permission to search where I didn’t already have probable cause. By asking I’m just engaging them in dialog to see how this stop is going to go. Now when they refused my request and I searched anyway; I’m sure some of them thought their rights had been violated. Probable cause is a 20 lane Interstate a thousand miles long. PC for a stop doesn’t take more than a few blocks, and PC for a search is there or it isn’t.

    The finish of a blued 19 can swing the price by more than $100; they are pretty much mint; or they aren’t. Also the grips can make a $50 difference. Here is a good example (although from the pictures the finish isn’t anything to brag about) on GB that is ending in 3 hours.   14. If a person did not have a carry permit; I would not chance an IWB holster. There does not appear to be any real definitions. (But again we don’t have much access to case law) So it looks like it is up to the Officer and you may possibly find yourself in court charged with a weapons violation.   15. A phone call to S&W would answer the serial number question. Tennessee Highway Patrol ordered a bunch of Model 15-3’s with THPXXXX, so I guess another department could have done the same. The G doesn’t make any sense; but 6 does. 6K389XX would make it 1974.

    Everyone hates to have to use customer service. But S&W sure does know how to make it a painless process. Congrats on the new .45. Does it have the external safety?
  17. At 50 miles you would need a Large Directional or “deep fringe†antenna. Most HD signals are using UHF (But there are some VHF). Here is a source of info to get you started... http://www.antennaweb.org/aw/welcome.aspx There is another source that lists exactly where all the antennas are for the TV stations, and has a lot of good info, but I can’t find it right now. Shameless plug… I have 60 feet of Rohn 25 tower with a hinged base, rotor and controller for sale. (With or without a Jo Gunn 3+3 Star)
  18. It’s pretty common on many forums. Some people do not understand or do not agree with the way the laws and their rights are interpreted and see the cops as the cause. Many cops or former cops are more than willing to discuss these situations on an open forum; while your legislators and Judges are not. Now back the original question. Having a HCP gives you no special protection from the Officer making the scene safe. You are an armed citizen. We have absolutely no information on why the Officer wanted to secure the weapon so I will just say that he has that authority at any time, whether it is on a traffic stop, stopping you on the street, or when he is called to your home. If the cop found something illegal while getting the gun out of the car; that would be a call for a Judge to make. Most Officers will explain why they are doing what they are doing, but as I have said before if I were to suspect that an HCP holder or anyone else is a danger no discussion would take place until he was disarmed; by force if he took it to that level. Legally PC need only be discussed in a court room in front of a Judge should you decide to challenge it. Here are some things that run rampant on the internet that are just some bad information. A cop has to explain why he has probable cause to search, a cop must show you the radar/laser gun on a traffic stop, a cop must read you your Miranda rights. And my latest favorite… get out of your vehicle and lock the doors. The idiot attorney that made that video should be disbarred. If you think the Officer is doing something wrong, you have recourse; but not on the street.

  20. You are exactly right. Gun control and abortion are safe issues to talk about while dodging the hard issues… Jobs, the economy, taxes and health care. I know that putting this county back to work and restoring our economy rests squarely on the shoulders of the American people; but I would like to know if any of these candidates have any ideas on how to help.
  21. New Orleans was an isolated incident involving a disaster the likes of which no other highly populated area in this country has seen. The infrastructure was devastated. There is plenty of blame to go around. Crimes were committed by many high ranking officials. The President was slow to invoke his power to step in. The Governor was delusional when she thought she could handle the situation. Mayor Nagen was slow to order an evacuation because he was more concerned with the city's liability for closing hotels and other businesses than for the saftey of the people. Nationl Guradsmen were openly questioning if what they were doing was legal; they didn’t know. We know now what they were doing was not legal. The orders to search homes for weapons were unlawfull. If any of those troops had killed citizens in those searches they would have hve been courtmartialed for murder. One of the news programs did an on-camera interview of two black female NOPD Officers looting a store. Were they ever put in jail? Some good things came out of it…. Federal law was passed outlawing what they did in NO.   22. I do not know how the restaurant owners feel; I can only guess that like anything else there are mixed opinions. But I know they are the only one with rights at stake. As a group (gun owners) we are fighting for rights or privileges that many do not think we should, or do have. Yet many of us supported the trampling of the bar owner’s rights with the smoking ban and bars are closing. Business owners should have the right to do business as they see fit. If they don’t want you to carry in their business; that should be their right. If they want to let you carry; that should be fine also. You can look at this a couple of ways… 1. Right now the same corrupt state government that saw fit to decide no one can smoke in their businesses has decided that no one can carry; the business has no choice. 2. The state of Tennessee does not recognize under either the United States Constitution or the Tennessee State Constitution that you have a right to carry a gun; they have ruled that you clearly do not. However… your state legislature has allowed you the opportunity of purchasing that privilege from the state. Many states don’t have that.
  23. I am. I’m talking about going in people’s home on an arrest warrant. If any amount of drugs or anything else illegal is in plain view I have a free pass to search anywhere in the rest of the house where that item could be.
  24. The state of Tennessee makes no bones about trampling all over the only people in these fights that truly have any rights…. The business owners. Just as they did in banning smoking in bars. If it’s okay with you I’m not going to participate in kicking a victim while they are down. I will leave this issue right at the feet of those responsible for it…. The state legislature. Gun owners have enough enemies without boycotting those that are not their enemies.
  25. No warrant needed when drugs (or anything else) are in plain view. That is the law…. And we are all about following the letter of the law… correct?
