  1. Someone please explain to me how this works? I’m not very familiar with the workings of the <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" /><st1:State>Tennessee </st1:State>legislature, but I see Naifeh being blamed for all the gun bills being shot down. How can the speaker single handedly shoot down a bill that has the votes to pass?

  8. The grips shown in that picture are “Service grips†(probably what it came with). The grips you are describing are “Target†or “Combat†grips. If it is a shooter he should have whatever grips feel and shoot the best for him. If he is like many of us S&W owners he will end up with one set that shoots the best, one set that looks the best, and one set that are correct for originality. Be extremely careful messing with these revolvers. They are works of art and can become habit forming.

  10. Well a 54 Harley new in the crate is a gold mine. It’s going to be in the tens of thousands, so if the old guy is anywhere near that price I would assume he knows what he has.   13. Securing an area in a disaster is sometimes required. Cops, firemen, paramedics and other rescue workers are required to save people even if they are doing something stupid; this puts those first responders in unnecessary danger. The good news is that it usually is not a problem. I didn’t read everything about what this guy did, but from scanning through the story he tried to use force to go through a roadblock and ended up in jail. It’s too bad that cooler heads could not have prevailed; but that sometimes happens. As far as the cop bashing…. I think it’s worse here than on most forums; but I don’t think it is any worse here than any other gun forum. There’s a lot of reasons for that. As a former cop I love a good discussion/argument on the law, vehicle stops, search and seizure, etc. I also think it serves a purpose. But just like with firearms; it doesn’t take long to figure out who has a clue and who doesn’t. But it is really sad when you have those that want to turn it into personal attacks because you may not be saying what they want to hear.

  15. That’s a pretty broad question. I wouldn’t piss off a rookie; that probably wouldn’t end well. If the cop is being decent and I really need to be somewhere I would just tell him that, and ask him to write me a ticket and let me go. If I get vibes that it’s a bad cop I can’t think of anywhere I could need to be in such a hurry that I would risk taking on a bad cop. I have worked with bad cops and after I left, one of them I didn’t get along with stopped me. I hadn’t done anything but I ended up in jail for 14 hours. I knew when I was doing it that I was poking a dog with a stick, I just didn’t think he would bite; I was wrong.
  16. We were talking about when I had probable cause; what part of that don’t you understand? When there is probable cause there is no need for a warrant. I have said before that I never asked permission to search a vehicle where I didn’t already have PC. It was not common practice to go on a fishing expedition or ask everyone you stopped if you could search their car. But yes, I watch cops also and I see them do it all the time. I have said may times; if you feel your rights have been violated you have recourse. If you are pisssed off by court decisions that allow cops to search cars; I don’t know what to say other than our founding fathers never expected the Constitution to protect criminals or tie the hands of law enforcement. The Constitution is a piece of paper. I have two honorable discharges and served my county as a Police Officer. I am a Patriot. I support my county and my people; not a piece of paper. I can’t imagine myself ever turning my back on my country or its people, or violating any of the protections written on that piece of paper. I apologize but I just can’t get my mind around the idea that letting a cop search my car somehow will damage the Constitution.

  18. Yes. 1. If you are in possession of a felony amount of drugs, or other contraband where the Officer has no discretion. You are not getting a pass, so you may as well simply refuse and possibly give your attorney something to work with. 2. You don’t think the Officer has probable cause for a search, both you and your vehicle are clean, and you just don’t like the fact that he is fishing. 3. You in some way feel that by not exercising your rights they may go away.
  19. Now see, that’s just a cheap shot at me; I would expect no less from this guy. Sure rabbi, maybe we could talk about the weather. Because I certainly wouldn’t want to ask about the situation at hand or start asking any questions that would require someone to have to think about what they are going to say.
  20. No, it wasn’t about me being vindictive and teaching a kid a lesson. And now it’s not about me being liable for letting a kid with a bag of weed go; that was perfectly legal for me to do. An uncooperative suspect making an unjustified complaint could be a concern. And Sorry if that’s how you took it; some took it that way, some understood what I was saying. When a cop has discretion; he can have it however he likes. That does not sit well with some people; I understand that. But how you interact with the cop truly does matter. Some people want to think they can say whatever they like without consequences. Sorry, life doesn’t work that way. You can say what you like, you can stand behind any right that you have. But asking you for permission to search, asking you to submit to a BAC test, Mirandizing you and asking if you want to make a statement are all questions where your answers will have consequences. If you think that refusing a search and reaming silent 100% of the time is the best thing for you; then that is what you need to do. The Officer is going home that night and the situation will have no further impact on him or his career. You will either drive away or go to jail. You have a window of a few seconds where you will be required to make decisions that could impact the rest of your life. Having asked those questions and seen the results I just think people need to know that. I don’t care if you are disrespectful to cops or not. That’s on you; not me. You can disagree with me on any point of law or Police procedure you like and I will be more than happy to discuss my thoughts and feelings about it. But I will not stand silently by while my words are twisted and someone says they are sure I have violated more people’s rights than they have. That was a personal attack and was unnecessary. No where in my posts have I said anything that violates anyone’s rights, and I have not posted anything that tarnishes the image of law enforcement. Sorry you feel that way.
  21. I am typing this verrrrrrry slowly and I am trying very hard to choose my words very carefully so that Rabbi can both understand them and not try to twist them around. I gave a specific scenario where you might want to think about how you answer the big question of “Will you give me permisiion to search your vehicle?†As I have said before I never did ask for permission to search unless I already had PC to do so. It was simply polite conversation to what kind of a reaction I got. If the person would ask “Am I free to go?†the answer would have been a polite “NO, not until I search your vehicle.†Okay… the kid has a small bag of pot in his car. I now (because I have discretion on a misdemeanor) need to make a determination if I label this guy a criminal or let him drive away. What do I base that decision on???? He isn’t a concerned citizen exercising his rights; he’s committing a crime and is trying to use his rights to keep me from finding his dope. Do I let him go?? He just asked me if he was free to go. If I let him off without charges am I going to be called in on a citizen’s complaint or a civil rights violation? Why in the world would I risk that? I still stand by what I said people need to understand that there are no pat answers and you need to think about what you say. If there was no down side to refusing a search or invoking Miranda; it would be a well know fact and everyone would do it. If you are squeaky clean you have nothing to worry about. But if you aren’t, choices you make are pretty important to your future; make them wisely. The fourth Amendment to the United States Constitution does not say that cops need a warrant to search your car. It also contains the word “Unreasonable†which many people like to forget. Our founding Fathers were trying to protect innocent citizens from unreasonable searches; not protect criminals hauling dope. Not one word I have posted can be construed as infringing on anyone’s rights. You may not like it that I had that discretion, or that Police Officers make decisions on how they use that discretion based on peoples attitudes, demeanor, and what they say. If that is the case; get the law changed, have the discretion removed. Make it like a felony; if there is reasonable suspicion you go to jail. But I hope you can’t get it done until I’m to old to drive. Because I haul azz and if I get stopped and the cop wants to search my car…. have at it Officer. And I’ll be BSing with him the whole time if I think he may give me a break on a ticket. Giving up my rights…. You have got to be kidding me.

I have never said to ALWAYS allow or ALWAYS refuse a request to search. I said it is dependent on the circumstances and there is no pat answer. You don’t know me from Adam. You can twist my words around and make all the hate filled dumb ass attacks you like; if that makes you feel better. Unbelievable..
  24. And I apologize for that. Some understood my point; some didn’t. You are right Rabbi. Get out of the car, lock the doors, and refuse any request to search. A bag of pot or a DUI can be a career ender for a young person before their career even gets started. When they get the word that they are ineligible for the big job they wanted maybe they will thank you for all the good advice.
  25. Rabbi, I know this is going no where but I have to ask… Where did I say anything about infringing on someone’s rights? I did not say I wanted to teach someone a lesson, but if they have learned something… so be it. I didn’t use it as a reward for sucking up…. But if you want to paint it that way… so be it. You try to teach people to always say no. I have tried to (on several occasions) to point out to them that there is no pat answer and in teaching their kids they should understand that there is a precise moment in time when everything that a parent and a child has worked for (as far as the child’s career) can be gone; simply because the child didn’t have to tools to deal with a traffic stop. I do not offer people legal advice, but I’m going to say that I am (by far) more qualified than you are to offer possible scenarios on how a traffic stop will end.
