  1. I'm interested in this lawsuit that apparently is going down. Cyberlaw is a complex and ever-changing discipline, and there's not much precedent because it's still so new. I don't know nearly enough facts about what has happened between dude and Mr. Volek, but I will be interested in seeing how it turns out. Maybe Mr. Volek can tell us all about the suit when it's over with. Someone on this board suggested dude should get charged for stealing. I don't think that happens much with intellectual property. Probably difficult to prove, but there might be some federal laws that allow for it.

    This isn’t intellectual property; it is real physical property.

    I don’t see this as any complex cyber-law problem, this apperas to be theft.

    Although things are not always as they appear. We only have one side of the story. I have not seen a peep out of this other guy; has anyone else?

    I can only guess the reason this guy has not been arrested is because Oleg doesn’t want to go deal with the local cops where this guy is, or the local cops have already been involved and there is a question as to the ownership of the forum.

    Guy comes into your yard with a baseball bat threating to beat your brains out. Would you shoot him? How about if you were in a wheelchair?

    He is armed with a deadly weapon the same as if he had a gun. He gets a verbal warning as he moves within striking range. (if there is time) If he continues and is nearing striking range he gets shot. You being in a wheelchair would make do difference.

    You hear a pecking on your car window at a red light. you turn to see a man with a gun in his hand, out of breath, asking you to call the police because hes just been "Jacked". Would you shoot him? What If you were deaf, and just happened to turn and see an out of breath guy with a gun beating on your car window?

    You are talking about shooting an innocent person. “Reasonable Person†comes into play.

    Is he threatening you? Would a “Reasonable Person†think he was threatening you?

    Using deadly force carries a tremendous responsibility. You can’t shoot someone because you are scared. And you can’t shoot someone just because they have a gun in their hand. (That’s another danger of pulling a gun; another armed person may not know for sure what they are seeing)

    You come out of the mall and see someone backing your car out of a parking place. would you shoot him? What if the van is handicapped accessible with a lift, and hand controls, because you are a parapalegic amd it would take upto a year, and 100K to replace?

    Nope... call 911.

    I’m not shooting anyone over property no matter what it cost.

    And secondly, you don’t open fire in a mall parking lot and you sure don’t start firing at a vehicle in a parking lot.

    Mu scenario...You are leaving work, standing on the corner waiting for your carpool to pick you up, when a man walks up to you and says"Give me your wallet, or I'll cut you up." Would you shoot him?

    "Give me your wallet, or I'll cut you up."

    Would a reasonable person believe that you are in danger of death or great bodily harm?

    You bet; light him up.

    Would you shoot him? What if you were legally blind and couldnt see due ro rhe glare of the sun in full sunlight?

    OK, in my case where do those lines begin and end? From 10' I couldnt tell if the guy had a gun, rock, candlestick, ot a smiley :D face burroin in his hand. So my plan is easy, draw first and call the law. If they refuse to stop, get down or resume advancing towatd me, i will shoot. and I will nor shoot to wound. I dont feel that I have the luxury of doubt in these situations, as i cant see anyway.

    Sorry, but if you are legally blind you have no business carrying. You need to be able to see that the threat is directed at you and that it is credible.

    You need to be able to identify your target and the innocent people around it. Anything less puts the innocent public in danger of being shot; and that is not acceptable.

    If you can’t see, you can’t pass the HCP course.

    Rumor: An iPhone for Verizon in 2009

    Chalk this one up to wishful thinking.

    A leading Apple blog posted a rumor Sunday that the iPhone — which is currently available in the United States only through AT&T Wireless — could be coming to Verizon, perhaps as early as January 2009.

    Cleve Nettles, writing in 9 to 5 Mac, says “negotiations between Apple and Verizon are ongoing but they expect to hammer out agreements by the end of the year.â€

    When faced with that dilemma I went to Anniston and bought a Garand and a 1903. (I went back later and got the M1 Carbine.)

    I thought I better get them while I still can.

    The next time I bought a DPMS panther .308AP4.

    I wanted an AR, but didn’t want a .223.

    The next time I bought a Remington 700 VLS and a Leupold scope.

    I wanted a long distance .308. rifle.

    I have no idea what the next time will be. :wave:

  6. If it’s just as fast, do whatever is comfortable and works for you. However you train is probably how you will react under stress.

    The chances of needing more than 12 rounds in a shooting are slimmer than winning powerball; and if you do need them you are probably hosed anyway.

  7. A macho hero's reward in this type of case could be a number and a cell, as well as family on the street because you lost the house in a law suit. At 65, and current financial situation in U.S. it is not something I can worry about after the fact.

    This is an excellent point that many don’t think about.

    I have to laugh every time I see “I would rather be tried by twelve than carried by six.†Sounds pretty macho huh? It’s silly and shows a total lack of knowledge of the law.

    I don’t want to be tried by a jury in criminal court; depending on where you live the conviction rates are up around 70-80%.

    I also don’t want to be tried in a civil court. Losing everything you have does not help protect your family.

    The days of killing someone to protect property are over in most states. The Castle Doctrine laws of today are not to give you the right to kill to protect your home, but are intended to remove the burden of proving that you were in fear of your life, from an intruder, while in your home.

    I can buy a new house, I can buy a new car, and also they are both covered by insurance. I will not put my freedom or my family’s future in jeopardy merely to protect property. I have firearms to protect lives.

  8. According to wikipedia (I know not necessarily the best source of info) Iowa, Pennsylvania and Virgina say you must retreat to some degree. It says in Iowa you do not have to leave your home, but may require you to retreat within your home.

    TN would be considered a "Stand your Ground" state also, in that you do not have to retreat anywhere that you have a legal right to be. Some state while not requiring retreat within your home may require retreat when you are elsewhere.

    When you hear a noise in the night and walk into your living room to find a thug pointing a handgun at you; how far do these state laws say you need to retreat? My guess is they don’t.

    I am not a lawyer and never played one on TV, but I would bet money that “The immediate danger of death or great bodily harm†trumps duty to retreat in all 50 states.

    “Duty to retreat†was brought into play by criminal coddling liberals that believe you don’t get to murder some poor misguided thug because he breaks into your home. But even those liberals are willing to blow his azz away if he is an immediate threat.

  9. In some states you still have a duty to retreat before using deadly force, even in your home :rolleyes:, but I think more and more those types of laws are going the way of the dodo bird. I think it's only a matter of time before all states have at least some form of castle doctrine.

    I think my own personal justification will work no matter what state I am in; but I want to be sure. What state has a duty to retreat when faced with immediate danger of death or great bodily harm? That statement, by its very nature implies that you do not have time to retreat, and has nothing to do with castle law.

    Castle law comes into play when you want to shoot people in your home and you don’t want to have to justify the shoot; by their mere presence they are assumed to be an immediate threat.

  10. If a “reasonable person†(that means a jury) believes that they are in danger of immediate death or great bodily harm, they are justified in the use of deadly force. That works in all 50 states as far as I know.

    Shooting someone because they are on your property or stealing your property probably will land you in court.

    Most reasonable people will agree that meeting an intruder in your home satisfies “danger of immediate death or great bodily harmâ€. Shooting a 15 year old neighborhood kid in the back that is trying to escape does not.

    Tennessee has no law that protects you from a lawsuit.

    Tennessee has a law that allows for a judgment against someone that sues you when you were justified. A judgment will not help you get back the money you are going to have to spend if the dirt bag that sues you has no ability to pay.

    As someone that has responded to these incidents I have said this before and I will say it again….

    You need to have a plan in case you have to use deadly force. Whether or not you go to trial could be determined in the minutes or hours following a shooting. If you are justified you need to cooperate with investigators when they arrive. If you are going to invoke your right to speak to an attorney prior to making a statement; you need to be able to make contact right then. Not the next day when he gets to the office.

    Your first call should immediately be to 911. The second call should be to an attorney if you are going to use one.

  11. Federal HydraShok's performance has been far eclipsed by many other rounds...Speer Gold Dot, Federal HST and Tactical, and Winchester Ranger-T all far exceed HydraShok.

    Do you have a local source with decent pricing for any of those?

    I want to try a bunch of .40 and .45ACP in a couple of weapons to see how they feed. But buying Hydra-Shoks in 20 round boxes gets pretty expensive.

  12. Collector guns may hold their value, but used everyday carry guns and others will drop.

    As you can see the higher priced used guns are not selling well, while the “deals†are snatched up as soon as they are posted.

    When people need money; they need it. They don’t have time to wait for the right buyer. With 401K’s and investments crashing “toys†will be the first to go.

    Some of you guys with Garands or 03’s may be interested to know that CMP now has finished Black Walnut Stock sets.

    Yes, they aren’t even close to being in the same league. (Rimfire Vs. Centerfire)

    Right now I'm only shooting out to 200yds so I'm not looking for anything to go very far but would like to know if a .22 is going to start dropping out at 100yds.

    Yes.

    Long distance shooting is half the shooter and half the equipment.

    .22LR allows you trigger time to train yourself. It makes no difference if the target is 50 yards or 100; you are looking for consistency. Take that training or consistency and add it to a quality long distance rifle and you are good to go.

    Reason for my interest of a .22 is simply ammo price. I could shoot all day for next to nothing.

    That’s why many of us do it. I bought a .22LR Smith & Wesson revolver for that reason. It’s the same size and weight as a real gun but the cost of shooting is insignificant compared to .357Mag or .45ACP.

    Extra over what?

    What are you going to use this scope for and on what?

    I understand these have better glass, 1/2 in adjustments.

    An M2 is 1/2 MOA adjustment, an M1 is 1/4 MOA, and the M3 is 1 MOA elevation and 1/2 MOA windage.

    What would be a good price for this I think you can buy one for 1400 or 1500 new.
