  2. No. It comes down to surviving a traffic stop, or surviving the cops showing up at your door without you being carted off to jail. If you need to have a big azz discussion about your rights; do it right here. I am more than willing to participate and it will not end up in your arrest. You have Cops, former Cops, real Lawyers and some people who play lawyers right here on this forum. If you want to know what is going to happen when the cops show up, I would suggest you ask a cop. If you want to know what is going to happen in court I would suggest you ask a Lawyer. Yes, you can certainly remain silent. If you are guilty and know you are going to jail; I would recommended it. If the Police have been called on you, and they are doing an investigation; remaining silent could quite possibly be the dumbest thing you could do. It is rarely a good plan and usually comes about after massive amounts of alcohol have been consumed. The cop will now base his decisions on one side of the story. The Police are not in a stressful situation; they go from one of these calls to the next. In most of these “Neighborhood†“Disorderly†BS calls I was trying to settle things down and leave. If I had someone that did not want to talk about what happened (and that was rare) I just arrested them and let them sort it out with their Attorney and the courts. Yes I have. I also have seen the video that was made by an attorney and tells kids that when they are stopped by the cops to get out of their car and lock the car doors. I have seen attorneys (like anyone else) do and say some stupid chit but that one takes the cake. I hope young people did not watch that and think it was a good idea, although I’m sure some did. Just because a video is made by an Attorney, Cop, Judge…. Whoever does not mean that it is good info. You need to use common sense. And I would not be able to ask for anything more. But you have been saying to say nothing. That won’t end up well for you in most situations.

I wish I had a dollar for every time a suspect caused a misdemeanor to escalate into a felony arrest because they were totally clueless about what their rights are, where a person invoked Miranda when they were not yet a suspect, or were in a situation where my intentions were to let them go with a warning. And that is why I offer my own personal experiences. If you don’t know what the law is please take my advice and find out before you get into a pizzing match with a cop. You will lose, you will lose every time and it could cost you thousands and possibly a criminal conviction. I know it’s very popular and macho to get on a soap box and start running off at the mouth about what to do if a cop stops you or if they show up at your house; and if you are an adult and what to believe some of the silliness you are reading ;that’s fine. But if you are a parent it’s unfair to your kids you give them the wrong information. They don’t deserve to go to jail because you don’t understand how things work. Be informed.

  7. It’s an investigation, not an interrogation. Whether it is a loud noise or some other type complaint from a neighbor or a family member, the cops need to hear your side. If like an idiot you stand there and refuse to say anything; (or worse you try to close the door or walk away) they most likely would advise you that you are under arrest based on the information from the complainant. That point in time is the turning point for many people. No warrant is needed for the Officer to enter your home and take you into custody. <O:p</O:p Many times the cops simply need to hear your side of a situation, talk to both sides, and try to leave. You all of a sudden deciding that you are an attorney can cause you serious problems. It’s no wonder so many people needlessly end up in jail; where do you guys get this stuff?
  8. I don’t see a problem here. If you are off work and run into a client and it turns into some kind of incident…. If you have a carry permit you are fine. If you are working on your off hours by choice (like looking for a runaway) then you need to be unarmed. However…. Yes, I am sure your supervisor could give you better direction than we can.

  10. We have all heard that and it has been discussed here in several threads. The popular opinion is that it will not be any cheaper, but some say they do it to have custom loads and some others think they can load better ammo than factory. I really wanted to do it if I could save some money and load my own rounds. But math kept getting in the way. I couldn’t buy the ammunition components for what I pay for loaded ammo. I don't think you can buy .40 any cheaper than WWB at Wal-Mart.
  11. I didn’t say anything about slamming a person who is complying to the ground. I simply stated fact; gun control can (at the Officers discretion) go into effect when the Police are lawfully on your property. Their safety trumps any perceived gun rights you think you may have. I think that’s the part you are having a problem with….. but yes; that is what I am saying. There is nothing in the United States Constitution and nothing in Tennessee law that would keep and officer from protecting himself and others around him when a firearm is displayed. Then this discussion is not even an issue is it?
  12. If you are being a dick; there is always “Plain View†and there is the complaint they were sent there on. Standing there like a mute or invoking Miranda when you are not yet a suspect is also not real smart.
  13. Having been in those cops shoes, I’m not opening the door until I see that it is cops and when I do open the door (out of respect for the Police Officers) I will not be wearing a gun. What could they do? Well I know this won’t go over here very well, but gun control goes into effect when the cops are called to your property. Their right to stay safe trumps any perceived gun rights you think you may have. They have a right and a duty to be there and depending on how you appear to them, you may be disarmed and you may not like the way it goes down. Don't be stupid.

  19. I’m not going to put a tracking device in my car. But I am going to go out on a limb here and say that the number of people convicted of putting a tracking device in a private vehicle they own in the state of Tennessee is…. Zero. It is my understanding that the cops don’t need a warrant; only probable cause. I think there was a ruling on that recently, but you will have to look it up.
  20. The “Domestic Violence” laws really started changing in the early 80’s and I had a big problem with it. As a Police Officer our discretion was taken away and we were forced to make an arrest if there was a claim by anyone. Orders of Protection are a joke. You want to talk about a violation of your fourth amendment rights, how about being removed from your home and not being given any opportunity to address the court issuing the order? I have seen countless orders issued so that one party could clean out the house while the other party was not there. There have been many innocent victims die because of this practice. There is absolutely no “Protection” in an Order of Protection. Maybe Mr. Stegall can comment on what Tennessee law is, but as far as I know the Judge can order whatever he wants as far as disposition of firearms and always has been able to where I was from. Also, if you are convicted of domestic violence I think some federal laws kick in that keep you from having guns; but I’m not positive on that. And let me add this while I am on a roll….. Cops are not social workers or ministers. If you live with someone that calls the cops on you…. Leave them. And if you think that calling the cops on a family member will help them…. Get a grip. No good comes from calling the cops to your own home when you can’t handle your family problems.
  21. And stirring it up even more…. This has nothing to do with 2<SUP>nd</SUP> amendment rights. Your state, your Federal District Court, and lastly the SCOTUS has ruled that you have a right to keep arms in your home but you absolutely have no right to bear them. <O:p</O:p As some have posted here; many churches allow carry. What’s so hard to understand? The leaders of the church got together and decided to put up the sign. Unlike you, who have no rights in this whatsoever; they have not only a right but a responsibility to do as they see best. If you don’t agree with them, exercise the only right you have here… don’t go back. <O:p</O:p I don’t support the “No Guns†signs. But I hate to see this. Businesses are forced by their insurance companies, board of directors, and lawyers to post their premises due to liability reasons. The laws need to change. Suing a business simply because a shooting took place there is wrong and our legislators need to stop it. <O:p</O:p But of course that isn’t going to happen because many of our legislators are lawyers and they don’t want to deprive their low life fellow lawyers from getting money from innocent people simply because they are the only ones in the case that have any.

Cops can do it without a warrant; I certainly can on my own car. That doesn’t sound like the owner of the vehicle is the one attaching the GPS unit.

  25. Wow… if that’s true; that’s too bad. I don’t own any Springfield’s right now, but I have in the past and would again if they are still the quality they made in the past. But thats just me.
