  1. Didn’t direct and Dish try to merge a couple of years ago and the government stopped it? Maybe this is a work around. They both suck. I wish someone could give Comcast some competition so I could get my bill down.

  3. If you have had nothing to drink, aren’t high, and there is nothing illegal in your car… thumb your nose at the cop. Most everyone on the Internet says they wouldn’t let a cop search; just like they all say they will invoke Miranda. As a cop I just didn’t see it happen much.
  4. You are not required to specifically tell the Officer that you are not consenting to a search; he is required to specifically ask you if you are voluntarily allowing him to search. If he has PC he doesn’t need your consent. If he conveys that to you all you can do is let him do whatever he is going to do. You are not required to open a trunk if he tells you to, but if he has PC the trunk is getting opened. Your own common sense will tell you what to do during a traffic stop. Don't be stupid.
  5. That is a great plan as long as you have nothing illegal in your vehicle. Following the instructions of an Officer is not giving consent. The Officer can ask you for consent to search (that does not mean he doesn’t already have PC) and you have the right to either grant permission or refuse. If you are clean; it really doesn’t matter. If you have something illegal in your car you better pause and think before you answer because the words that come out of your mouth at that moment could impact your future. The fact that someone told you to always refuse a search may not be much comfort if you are standing there in handcuffs watching your vehicle being towed away. I think most cops are like I was, they just ask for permission to make conversation and see how things are going to go. They already have PC for a search.
  6. I don’t see where it says that the Trooper ask for permission to search. If you are buying this story, he says the ammo was having a peaceful ride in the trunk with the AK (that was unloaded and in a case) and the handgun (that was unloaded and in a lockbox.)

  8. Somebody needs to spend some time on it. I would guess it ranks up there with “Do I have to use an FFL to ship my handgun to a buyer across state lines?†as one of the most misunderstood topics. I’m guessing there might be some HCP instructors that don’t understand it.

  10. I was arrested for having a gun in my car. I was guilty as hell; never made any argument otherwise. But I got the charges dismissed. That doesn’t mean I was innocent; it just means I spent the money to play the game. We are discussing the circumstances of a case that we can’t even determined ever happed. Why would someone make up the story…. For exactly what you see going on here and having a thread named “THP out of controlâ€. Drammmmmaaaaa.

  12. Cops have meters. Or if you just want to know, stop in a window tint shop. They will tell you just by looking. Most cops I know wouldn’t stop you just for window tint. But if you get their attention and they are looking for a reason to stop you; window tint will do it. I don’t know how Tennessee is, but in Illinois you could have tint darker than the law allowed if you have a note from your eye doctor. Of course you would get stopped occasionally.

  15. $2500 to $8K. From what I saw I would guess that it is like selling vacuum cleaners; if they think you are going to buy they can drop a bunch off that price for a “special deal†just for you. We didn’t get that far. I left the store laughing. There are some reasonably priced competitors. Of course, you have no way of testing a bed. I ask the salesman about their 90 day try-out guarantee and he said they don’t offer that here because Tennessee law won’t allow them to sell a returned mattress as new. I’m going to go out on a limb here and say that is probably the case in most states.
  16. They don’t know… and they don’t care. That is until the gun you sold is used in a suicide/murder of a top NFL quarterback….. Or some other scenario you are dismissing. Cops trace guns every day. Selling guns as a side business without an FFL is against the law also. Do people do it? Certainly. They do it every day and most don’t get caught. That is until they gain the attention of the wrong person or make the wrong sale. Then the ATF destroys their life and sends them to prison.

  20. Yes, you can ship within the state. However… you are required by law to notify the shipper, and as soon as you do that you may well be out of luck. Handguns can’t be shipped by the USPS unless you have an FFL. If you cross state lines you need to ship to an FFL. You aren’t required by law to ship from an FFL, but many FFL:’s will not accept shipments from private sellers. Is a crime. I have seen out of state sellers on this forum make comments that they come to Tennessee often. I have always assumed that they were either ignorant of the laws or were ATF agents seeing if they could get someone to bite.
  21. Yes, I am sure. I referred him to the lawyer that is supposed to be the top “Gun Rights Attorney†in the state. He told him that he could probably get his conviction expunged, but that the state of Tennessee would not restore his guns rights. The way he explained it was that this is not a federal problem; they will recognize the expungement. It is the state. In short, it is my understanding that if you were convicted on drug charges (He was convicted of possession in the 80’s) or a violent crime Tennessee will not restore your gun rights. The fact that you may pass a background check does not mean that you might not be arrested for “Felon in possessionâ€. And if I’m not mistaken Felon in Possession in Tennessee is mandatory prison time. As a former cop I can tell you that expungements might be good for keeping a conviction from a potential employer on a background check, but no conviction is ever “goneâ€. If you apply for a job as a cop or need a security clearance for the military; it will probably show up. But those places don’t ask if you were ever convicted, they ask if you have ever been arrested.
  22. I’m not saying put your permit at risk. I’m saying I don’t stand around outside businesses scanning for signs. I’m not going to go to a website to see where I should eat either. What some here are asking for I see as impossible. For the state to force private businesses to allow you to carry would require them to acknowledge that you have a 2<SUP>nd</SUP> amendment right to do so; not a privilege you bought. That would be a wonderful outcome if the state is willing to do that. But at this particular point in time you do not have a 2<SUP>nd</SUP> amendment right to bear arms and carrying loaded guns is illegal. The state of Tennessee can recognize the 2<SUP>nd</SUP> amendment as an individual right to keep and bear arms any time they choose (as have a couple of other states); but at this time they have chosen to only recognize your right to own firearms. Because that is all the Feds have required them to do. I don’t own a business here. But If I did and I could get people to say that they weren’t using my business because of a website like that (either side)… I would sue the website, and the state for putting me in that position.
  23. They got placed in the middle of this by people on both sides that would rather make idle threats against business owners rather than deal with their legislators and the issue. Show me one case that can be verified where an HCP holder that carried into a business has been cited or arrested. So far we have seen none here. The worst we have seen is where the cops were called and ask someone to leave. I carry concealed so I honestly don’t look for signs when I go into stores or restaurants. If I get tagged…. So be it. If that happens I will come here and without hesitation ask one of the forum lawyers to represent me for free and if they won’t I will ask the members to help me pay for an attorney to take the case as far as I can. Until there is either case law or legislation; the bickering is useless.
  24. Well, I think one thing we can all agree on is that we can do without the ATF or any other Federal agency being involved in firearm sales. But I doubt you and I will live to see that. (I changed your statement to what I think you meant.)
  25. That’s the way it is now. Tennessee allows the sale of firearms to 18 year olds. It is Federal law governing the FFL’s that restrict it to 21; and there is nothing the state can do to change that.
