Being Pro-Gun won’t get you elected. If it would we would still have someone in the Governors race. The main thing working voters are looking at now is jobs and the economy. Politicians can make all the promises they want about that because in the end they don’t control the economy; the people do. The non-working and very poor class (The class I am afraid is going to decide the elections) is looking for what the government can do for them, handouts and government Healthcare. Politicians can’t help us; its up to the people. -

Brick & Mortar gun stores aren’t going anywhere. I buy a lot of guns and I buy new from forum dealers. I bought one gun (My PLR-16) from Buds because my local forum dealers didn’t have one and really didn’t seem interested in getting one. We see new guns stores pop up all the time and rarely do we see one go out of business. So the market must be here. I don’t think I pay anymore from the forum dealers than I would on-line. But I also ask for the “Forum Discountâ€.

You have two different laws being quoted here. United States Code (USC) and Code of Federal Regulations (CFR) TITLE 18 - CRIMES AND CRIMINAL PROCEDURE, PART I – CRIMES, CHAPTER 44 – FIREARMS, Sec 930. This is under Federal firearms laws and covers carrying in Federal building. If you were charged under it, it would require a posting. 39 CFR 232.1 This is specific to the Post Office and does not require posting if you are charged under it.

And that was a terrible miscarriage of justice. Steve McNair tried to take responsibility for what he did. He blew a .16 and admitted he was drunk. He even got on TV and admitted he made a mistake and that was not the example he wanted to set. The press tried to turn the public against the cop that stopped him. If you (or anyone else) think you have enough horsepower to get a Judge to watch a video of you swerving and then rule he didn’t think you were swerving “enoughâ€, and then have a DA that decides to not appeal that ruling; go for it. That just is not how it works. Also a Witness told that Officer that they saw McNair driving after he left a bar and it appeared drunk. That would have flown in any court anywhere. Of course the DA didn’t even try to use that. That Judge and the DA should be ashamed. And if that had been a cop getting off a DUI that he had admitted to instead of Steve McNair you and most others here would have been freaking out. That cop did his job and took a drunk off the street. It’s a shame his department stood by and did nothing.

I would guess those counties that have banned it have exclusions for limos and such. (But that’s just a guess since I can’t find the county laws) Here is how Illinois handles that situation.

In that case there probably wouldn’t be a problem. That scenario is not why the open container laws were passed. Yes. But it might be hard to breathe, especially if three or four of your friends get in there with you.

What would be more important? Real criminals? Like Robbers and rapists? I don’t know where you live or where you worked as a cop, but if the chances are higher that you or your family will be injured or killed by a “real criminal†as opposed to a traffic offender; you should think about moving. Open container laws are simply part of aggressive DUI enforcement. My confusion comes from you saying you were a Police Officer and then making statements like these laws are silly and those that enforce them are lazy or want easy arrests. DUI enforcement is not a game. The vast majority of states have decided that open container laws are a part of aggressive DUI enforcement. It appears that some county governments in this state also disagree with the legislator’s stamp of approval on drinking in a vehicle. I’m sorry your service left you so disillusioned; Police work can do that with some people.

I can assure you that no one made any laws based on my experiences. They didn’t check with me or even seek my input. I’m just basing my opinion on a chit load of traffic stops involving drunks and drunks that didn’t even know they were drunk until I made them aware of that little fact. I have also observed that if you have a mix of people consuming alcohol in vehicles or if you have a bunch of people drinking and handling firearms; chances are pretty high you will have an incident involving someone getting arrested or going to the hospital. Because you see “law abiding citizens†and other people living at the foot of the cross don’t usually find themselves in these situations.

If I was the instructor I would ask my county DA’s office to supply someone from their office as a public service. Since they would be the ones deciding if you go to trial or not for a shooting. I would do the safety and shooting instruction and leave the law to them. How many hundreds of posts have we seen on this very forum where people are clueless about the law governing a shooting? How many posts have we seen by people that think the Castle Doctrine is a law that was passed by this state to let them execute anyone that unlawfully enters their home?

See… everyone has their own ideas on what laws to keep based on their personal experience. I think the HCP carry class is a joke. It’s a day of smokin’ and jokin’ at the range and the state gets a payday. I’m sure there are probably some good instructors but I’ve seen some post here that are clueless. Unless a person is an Attorney licensed to practice law in the state of Tennessee and specializing in criminal law and the use of deadly force; they have absolutely no business getting paid to explain it to people. I think you should have to take a test to vote, but the legislature does not agree. Therefore no test should be required to carry a gun.

Absolutely. My views on this are emotional and personal. They are based on my experience as a Police Patrol Officer and as a Traffic Officer. Your experiences are obviously quite different that mine; I have no idea why that is. The legislature makes laws based on facts, personal experience and yes, even emotion. Most states (40) have seen fit to outlaw drinking by anyone in vehicles. Tennessee is one of the few that have seen fit to allow it. Some Counties on the other hand have seen fit to step in and outlaw it in their county. I can’t find any information on how many counties have outlawed it or even if it is outlawed in my own county. I don’t drink and drive and don’t allow open liquor in my vehicle, so that is a piece of information I have never needed until now. And I don’t find it anywhere… so I would guess this is not a big concern for Rutherford County and they allow it. So… the question seems to be does allowing open liquor in a vehicle mean the driver will be drinking. My experience says the driver will be drinking. But let me clarify that by saying I was in a state where open liquor is illegal, period. When I stopped a carload of people drinking was the driver sober and not drinking? Rarely… usually the driver was toasted and was arrested for DUI. Responsible sober drivers won’t generally allow open liquor in a vehicle they are responsible for and in control of. That’s just my experience yours may vary. So painting a picture of a sober non-drinking driver hauling around a bunch of drunks with open containers is just not realistic.

In your years of Policing can you think of an incident where you pulled a car over because you saw someone tip up a can of beer or a whiskey bottle and took a DUI off the street? I can; I’ve done it several times.

Exactly. I don’t wear a gun when I go out in the evening to dinner because I drink. My wife drives and I drink; I sometimes get drunk. Okay that isn’t true… I usually get drunk. On a lighter note.. does anyone here watch Ma’s Roadhouse? Remember when she was getting in the car with her driving instructor and the guy asked her “What do you have there?†She said “My beer.â€

I guess if you are a kid that has already made up your mind you will probably be going to prison; laws won’t matter. But kids that have a good head on their shoulders will be influenced by the laws. Like you, they may not agree with them; but no one really cares what their thoughts are about it. A DUI arrest use to not be a big deal; it is now. You can’t get a security clearance at many places if you have a conviction. And many employers won’t hire a person with a history of liquor problems.

Really??? Is that the stance you want to take? Overbearing government thugs are stopping innocent people from being able to drink in a car… is that how you see it? Do you have teenagers or ever been around them? They do stupid things and hopefully they will live through them. They need someone to make an attempt to help them live long enough to be able to make responsible decisions on their own. I wouldn’t care about the adult drunks and don’t care if they die, but unfortunately they usually don’t kill themselves; they kill us and our innocent family members. I’m always willing to explain to young people about DUI, BAC, and all the things involved that both them and their parents don’t understand. It’s the least I can do. My views are crystal clear. So if you are going to lobby for booze in cars, yes, we will have to disagree.

Make fun of it or dismiss it if you like; but I still have nightmares from it, and it’s been many years ago. You kinda get use to seeing adults killed; I don’t think anyone gets use to seeing the kids die. And make no mistake about it; we are talking about something as deadly as blindly firing a high powered rifle down the street. Open liquor has no place in a vehicle period (unless it’s a chauffeured vehicle like a bus or limo). Anymore than someone carrying has any business drinking… even one beer. Maybe I’m jaded by being the guy that got sent to the aftermath of those scenarios. But hey…. I fully understand that the tin foil hat “government intervention†stand will be more popular here than common sense. I support the groups like MADD for what they have done. I don’t see how that makes me like the anti-gun lobby; but if that makes you feel better go for it.

Helping cut screaming kids out of cars and then watching them die will cause you to have that opinion. So will puking at the roadside the first few fatals you work, or thinking how the dead kids on the pavement look to be about the same age as your kids. No… we shouldn’t need the government to tell us that alcohol and driving doesn’t mix; but we do. If the alcohol didn’t make it to the driver, it wouldn’t even be an issue. But that just isn’t what happens in real life. Of course I always gave the driver the benefit of the doubt. I asked him to blow; if he refused he went to jail. It’s that simple.
