Although copper prices are going up due to China; that’s what got us in trouble the last time. We created the last ammo shortage. Running out and buying up all the ammo will only cause it again; no matter what the price of copper does. Everyone needs to not over react or get stupid. Remember the election? How you guys doing trying to sell off those $700 AR’s you paid $1500-$2000 for?

I’m still confused. 1. We never had to deal with arrest warrants or Judges signing anything on an arrest. That is neither here nor there, but I am making an assumption that the legality of this arrest was questioned by pre-trial motions when this guy went to court on the DUI??? He was either convicted or made a plea on the DUI. It makes me wonder did he go to court on this DUI with no representation, or was the arrest questioned and Judged ruled it lawful? 2. Jurisdictional disputes. Just because the person is claiming the Officer was out of her jurisdiction doesn’t mean that the arrest won’t stand. Kb4ns explained that it is pretty much the same way it was for us in Illinois; Police Officers jurisdictions are the state line. Many times I followed a vehicle out of our city limits and into smaller towns around us. Notifying them was a courtesy; not a requirement. We usually notified them if we were going into their town to arrest someone, but didn’t normally do it on vehicle stops. One of our Officers would come out and back us up. However….. unlike Illinois it is my understanding that Tennessee has “Law Enforcement Officers†(for lack of a better word) that are not state certified Police Officers. I even saw one member here say that he is a reserve or auxiliary Deputy and Patrols by himself. Could that be a factor in this case limiting jurisdiction? DISCLAMER: Before the azzhats start saying “This isn’t Illinois†I fully understand. I am using my experience in Illinois for comparison only. -

Department Policy isn’t law; it can’t trump state law. That’s just a very basic point of law that is not defined by state. Is there something in Tennessee state law that says a Chief or Sheriff can override the state legislature? That’s not Department Policy trumping or superseding state law. That is just state law giving a CLEO options. Anything can happen in civil court. I mean after all…. He found an attorney to take his case. We’ll just have to wait and see how it goes. -

Yes it does. However “City Police Policy†is not state law. I’m still not following why anyone thinks there is a jurisdictional dispute. Is she not a sworn Police Officer? Did no one question the legality of the arrest at this hearing? If they did a Judge has ruled it a lawful arrest and this is nothing but a nuisance suit that will get kicked. Calling your husband (from another department) for back-up sounds like a mess waiting to happen…But who knows. -

Lot of good ideas in this thread. I have a Doberman Pincher and a loaded gun within reach almost anywhere in my house. My Doberman is not there to engage bad guys; he is there to let me know that there is a possibility someone needs to be shot. I don’t get too carried away; I refuse to live in fear. -
I’ve never heard of polymer coated. But lacquer coated steel is okay in an AK. I wouldn’t run it in an AR.

I could only offer options in the MidState so I wasn’t going to respond. But I have to ask….. I see guns selling here at or above retail price all the time. Why would you not just do that and go to the gun store with cash? -
Don’t use steel case or lacquer coated ammo unless you like working on your gun.

Thanks for that info; I have asked before but never got a response from someone that knew. That’s pretty much the way it was for us in Illinois. The state lines were our jurisdiction. Of course we didn’t stop people in other jurisdictions for minor offenses (like traffic). But we had full Police powers no matter where in the state we were if we saw a crime. The only real limiting factor we had was that we had to take the arrested to the nearest jail. We couldn’t arrest them in Chicago and take them back downstate. Getting in a jurisdictional dispute with a Police officer usually won’t end well. -
Neither… drunks. I’ve seen them kill more people than dopers.

We have had this conversation before and nothing has changed. If Illinois has carry permits it will be because the state legislature decided that is what they wanted. The SCOTUS has not, and will not make any decision that says a state has to allow its citizens to carry. They haven’t ruled that because they don’t have the authority to do it. They also don’t have the authority to send Federal Troops in. It’s called “States Rightsâ€. I don’t understand why you seem to have such trouble grasping that concept; we fought the worst war of our nations history over it…. Remember? Tennessee does not recognize the right to bear arms any more than Illinois does. I haven’t been to the border lately but I’m willing to bet there are not large groups of troops being massed at the borders ready to lay seize on the state. -

Illinois is getting closer. Illinois has two pro-gun groups working against each other; the “Carry Group†and the “2nd Amendment Groupâ€. As soon as they understand that HCP isn’t 2nd amendment; I think they will get carry permits. Because of Chicago it will be tough, but they have a chance. Good for Iowa -

I’ve responded to many “man with a gun” calls. The person is usually disarmed, the scene is secured and then I found out who called and why. (Doing that backwards can get you killed) It is generally one of two things. 1. A person is carrying or moving firearms and someone is scared or concerned. 2. (Most common) A drunk is making a scene or is involved in a family fight or neighborhood situation and has either displayed or threatened that he has a gun. Really??? Are you really going to let this thread be reduced to cop bashing and get locked? Does this wealth of experience come from all your personal experience of how cops respond to these calls?

I am fully aware that we are not going to see eye to eye or agree on this. But I guess I would need to hear a scenario where you think someone’s rights are being violated. But as you said, if someone is concerned enough to call the law on you; that isn’t it. I’m addressing the question that was posed from a real life responding Officers viewpoint on a man with a gun call. Not some random stopping of someone because they are armed.

Police Officers believe in that also. They call it “Going home alive at the end of your shiftâ€. There is nothing in the Constitution, or anything implied by our founding fathers that suggest a Police Officer needs to put his life or the lives of innocent people at risk to keep from infringing on your rights. It’s called situational awareness. If you are going to be in the open where someone is going to call the law on you, or if you are just playing around with a firearm; you better have it. You are moving towards painting a scenario where the cops don’t have any choice but to shoot you. That can certainly happen. As everyone else has said the only way to “Tip Toe†out of that situation is to pay attention and do exactly what you are being told to do.

They do it because of ND’s. Most gun shops I have seen don’t allow loaded guns that you plan on handling or are bringing in for Sale/Trade/Work. Cracker Barrel doesn’t let you bring in your own biscuits.
