I was arrested and jailed for no crime other than having a gun in my car. What would you like to discuss about the 2nd amendment?

Killer of Police Officer may have purchased a pistol at a gunshow.
DaveTN replied to Superposed's topic in General Chat
What if it was? I don’t have the ability to do a background check. It would suck knowing that I sold a gun to someone that committed murder; but I wouldn’t be worried about getting in trouble. Other than giving the anti-gun people something to whine about I don’t know why any of this matters. He could have bought off this forum. I know a lot of people get excited with talk of requiring background checks on private sales. I don’t care one way or the other if I don’t have to pay for it, but criminals will always be able to get guns. And shooting people is already against the law. -

Shocking Carry Permit Police harassment in Philidelphia, PA
DaveTN replied to ProjectDexter's topic in General Chat
As a former Police Officer I can assure you everyone is guilty until proven otherwise. If you were innocent until proven guilty they couldn’t handcuff you and take you to jail. If someone pulls a gun on you will you wait to see if it’s real or not? No, that would be ignorant. A cop assuming that everyone carrying a gun is a law abiding citizen with an HCP would be just as ignorant. A cop has every right to stop you and to ask to see your permit; you agreed to that when you bought the privilege of carrying a gun. It’s a crime for the average citizen to carry a gun in Tennessee. Until that changes it will be rare to see someone carrying a gun. It’s out of the norm and that coupled with your appearance will either cause the cops to stop you or let you walk on by. -

Citizens Arrest in SC allows "shoot to kill" ?!
DaveTN replied to BlackHawk93's topic in Handgun Carry and Self Defense
I don’t have a problem with killing criminals. But young kids do stupid things. I’m not sure they should have to pay for that stupidity with their lives. And that’s what happens when you allow the use of deadly force to protect property. I also think that is the reason it is not allowed in most states. -
Not regardless of the law, no. If there was a law or case law establishing some level of reasonable suspicion requirement; you might have a point. If you carrying a gun were recognized as a right by either the federal government or the state, you might have a point. But none of those things is the case. I am not aware of any law that requires a Police Officer to put his life at risk. I was expected to enforce the laws and protect your Constitutional rights. But that is all secondary to me staying alive and protecting the innocent people around me. If you want to hold the cops feet to the fire, that’s fine. But you can’t do it by implying they are violating rights that you do not have.

Are you suggesting that disarming you while they have you stopped is not within the bounds of the law? I wouldn’t trust someone just because they have an HCP. I would act based on what I see. If I think the person looks like a dirt bag; they would get disarmed. Assuming someone won’t shoot you because they have an HCP is ridiculous. Perhaps if you can’t deal with being disarmed during an encounter with Police; you need to not carry a gun.

Any expert advice on polishing a feed ramp?
DaveTN replied to maroonandwhite's topic in Gunsmithing & Troubleshooting
A Dremel tool is for repair work; not for polishing. Use something that will form to the shape that is already there. Like polishing compound on a rag wrapped around your little finger. I would trust almost any new, out of the box firearm over one that someone had taken a Dremel tool to. -
To know that every state that has a permit program in place would have to have a block on a police report to check if the suspect has a permit. Can Tennessee (or in your case NC) track crimes committed by HCP holders? Either side of any issue can claim whatever they like when you don’t have uniform solid practices for gathering data. I would bet neither side knows how many shootings permit holders commit. But that just a WAG.
-
I would suggest that you may not know how many Officers responded. We would send a bunch of Officers to a home invasion or armed robbery. But unless the dirt bags are in custody there is one place that we were pretty sure we would not find them; at the scene. A person is dead. It’s too bad that you feel he got too much attention. From personal experience I can assure you that if you were a Police officer you would give it more attention if a friend or family member was killed. That is human nature.

When I was a cop, the paramedics would give us the guns, or we would get them from the car (along with any other obvious valuables). We would take them to HQ and tag them as “Personal Propertyâ€. The owner or a family member of the owner (with permission) could come to HQ and get them. But as with everything, I’m sure it depends on the circumstances.

You mean living in this state, knowing the laws and having an HCP isn’t enough? We need an internet link?
-
It appears to me to be the same. All three states acknowledge the “right to keepâ€, but not the “right to bearâ€; just as the SCOTUS has ruled. States can allow you to carry a gun without it being a “rightâ€. I would guess that if you talk to a legislator from one of the four states that have what is commonly referred to as “Constitutional Carryâ€, they might explain that they still control the bearing of arms. They just allow more freedom than other states. Alaska, Vermont, Arizona and Wyoming are doing it right. I would like to see Tennessee added to this very short lis tof states that allow carry. That has been proposed and as a group we should be acting on it.
-
That map is not a credible source. It shows Tennessee as a green state implying we allow open carry. Open carrying a firearm is a crime in this state. Less than 10% of the population paying for the privilege of carrying a gun should not get us listed as an “Open Carry Stateâ€. How many others states are shown as green because a very small special group can open carry?

The media uses the word accused because it is proper; not because they fear a lawsuit. Many people that have TV or talk radio shows have called Jared Loughner (and all these other mass murderers) a killer. They are covered by the 1st amendment. Loughner would have legal recourse if he didn’t kill anyone and he suffered damages from the statements. Worrying that a mass murderer might sue you is as silly as saying “most†of those cases listed will be ruled self-defense.

I’m out of town and I can’t log in on my friends desktop. It shows my log-in name and says thanks for logging in, but I’m not logged in and can’t post. I can get on my laptop and just click on TGO (cookies saved) and be logged in. What am I doing wrong on the desktop?
-
He would need to prove that statement was false and that he suffered damages. I don't think we need to worry about Jared Lee Loughner proving he didn't kill anyone. Only people not in touch with reality would hold HCP holders to a higher standard than the average citizen. The average citizen is not a criminal and would be eligible for a carry permit if they wanted it and could afford it.

Open vs. concealed or what’s better from a tactical standpoint is common sense. You have it or you don’t. Sounds like CB is trying not to post; but they will have to do what is best for their business. I have been in Tennessee 11 years and have only seen a person open carrying one time and he turned out to be a cop. Maybe it’s different in other parts of the state, but I don’t see how this can be a common problem.

FN 5.7 pistol. Somebody tell me why its the best hangun in the world.
DaveTN replied to Will Carry's topic in Handguns
I apologize for assuming that when you said “hitting clay pigeons at 100 yards†they were flying through the air. Most people on here would be satisfied with hitting a 4†circle at 100 yards with a scoped rifle. -
Yep… and that’s exactly why businesses post.

We need 1K ranges. There aren’t any in the state you can walk onto and shoot. We have the 1K range at the base in the Mid State, but it’s my understanding the only time you can shoot there is during matches. I don’t know where you are supposed to practice. You are correct. I am a member of the Garand Collectors association. It’s only $25 a year, but there are many to choose from.
