  1. Then you need to find out. You want to carry on about public officials being fired or jailed, yet you don’t care enough to find out under what authority they take these actions. Why don’t you make it your goal to get to the bottom of this and let us know?
  2. I’m a collector. If it’s not factory perfect (and very few are) it’s priced accordingly. If it’s a model 29 go ahead and put me down for first dibs at $300….. sight unseen. However… we have no idea what it is yet.
  3. I wondered the same thing. Most S&W’s break like glass in single action with a very light pull. Really doesn’t matter anyway to an S&W collector. The parts are readily available and easy to replace.
  4. If you find a Smith & Wesson .44MAG, or almost any S&W revolver for $300 and it hasn’t been drug on a rope behind car; buy it. If it’s a .44Mag it’s probably going to be worth at least $600 probably more like $800-900. Get us some more info and we can give you a better idea. It’s an N-frame (unless it’s a .44 Special), it’s already too big for a carry gun, so barrel length won’t be a big deal.
  5. They banned carry into the downtown area when the Nazi’s had their rally. They were searching people. I haven’t heard of anyone challenging that.

  7. I’m saying that you are taking something out of context, highlighting it and then addressing it. I don’t think it is your intent to take it out of context, but the way I read that entire section they are saying that they are not addressing whether or not exigent circumstances exist. The SCOTUS was not asked to decide if exigent circumstances existed. They were asked if exigent circumstances make a warrantless search reasonable.

  9. Where do youdraw the line? Unless you are suggesting that under all circumstances the cops call a time out and call a Judge; there will be cases where a warrant is not required. They are called “exigent circumstances” and they will always exist. They are not “too much” for a Police Officer to make a decision on. There is no one more qualified to make that decision; unless there happens to be a Judge withthe Officer. But even then there may not be time to break out the lawn chairs and have a discussion about whether or not there is cause.
  10. That entire case was about exigent circumstances and whether or not the Police created them. Now get me to the part where you think (or fear) that a cop can somehow simply stop his car and kick down your door while you are in bed sleeping. I’m at a loss of how anything you read in those 27 pages would lead you to that conclusion. I will admit that I did not read all 27 pages; I could see where it was headed and I already know what happens. Nothing can protect you from a cop with a “hateful grudge†if he is willing to commit a criminal act to get you… nothing. Life’s tough; wear a helmet.
  11. I am missing the facts… I’m missing the fact of how this expands cause for a search. I’m missing the fact of how you came to the conclusion I think the cops won’t get shot. I have no facts to back it up, but I would bet they get shot at a much higher rate than innocent citizens. I’m missing the fact of how this has anything to do with a “Cop driving down the streetâ€. I see nothing that indicates the entry or search can’t be ruled unlawful later; only that you can’t resist. Same as resisting arrest, you may be innocent, but you can’t resist arrest.

  13. This is Tennessee. You can’t sue your employer when you get hurt even if they caused it.
  14. Leroy, If someone comes through your door at night yelling they are the Police, you have a decision to make. A decision that will decide whether you or someone else lives or dies. This is exactly the situation that happened in Lebanon when the cops had the wrong house. The home owner fired on the Police and they killed him. He was innocent and he is dead. A terrible tragedy. The Police had a warrant and it was signed by a Judge. How often do you think that happens and what would you do to make sure that doesn’t happen again? If I needed to arrest you and I knew that you were armed and had said you would kill cops that tried to arrest you; I would want a no knock arrest warrant and I would like to take you while you are asleep, with extreme prejudice, and I would like make sure if anyone dies; it’s you. Or… I could have SWAT surround your house, giving you plenty of time to arm yourself and create a hostage situation. How would you work that? Just call them up and see if they would like to surrender? As I’ve said before I don’t support subdued uniforms or masks; it should be a crime for a cop to wear a mask on a raid. The entry Officers should be uniformed Officers that wear the same uniform Patrol Officers wear. I did it, I didn’t feel the need for a mask or subdued uniform. But then,I’ve been known to run with scissors.

  16. That’s the way it was when I started as a cop in 1978, and to the best of my knowledge that’s the way it is today (with the exception of Homeland Security). What do you think has changed, or what do this this decision will change? You can’t resist the cops… period. It’s always been that way and it will always be that way. You can’t resist an arrest just because you think it’s unlawful…. Period. Now… if you think the cop’s entry into your home or your arrest is a criminal act by the Police, or someone pretending to be the Police; you have to do whatever you think is right. But there’s a whole hell of a lot of difference in a Judge ruling later that a cop didn’t have probable cause; and a cop committing a home invasion. You can’t stop a cop because you don’t think they have probable cause; we have courts to deal with that. Court is not held on the street. Ya know, I’ve had plenty of people, usually that are drunk, decide that they aren’t going to jail because I didn’t have cause, or I didn’tread them their Miranda rights, or any number of things they saw on a TV show. The ones that resisted ended up with more charges, the ones that fought ended up with felony charges; it just isn’t worth it.

What part of the Constitution do think guarantees you the right to beat the piss out of your wife, leave her bleeding to death in the other room, and then tell the cops they are no longer needed and try to block their entry? As has been pointed out to you several times; nothing has changed here. But you seem to think that simply putting a door between a criminal and the Police protects him from capture. That word was put in there for this very reason. Was entering the home is this case unreasonable? Of course it wasn’t. Were the Officers justified in lighting him up with a taser? Of course they were.
  18. That’s pretty much the standard for any business. They couldn’t care less about the money or drugs; they are happy if in an armed robbery the perp leaves and no one gets shot. Can you blame them?
  19. It looks to me like whoever is holding the gun is busting the guy in the flag T-shirt in the mouth with a two hand grip while Buford yells at him. Is that not what’s happening? Is there a story about this picture some where?
  20. I don’t think I arrested a lot of burglars and thieves that were doing it because of a drug or alcohol habit. It was my experience that most of them did it because that was their job; it’s how they live. They were brought up without any work ethics, religion or morals and so they lead a life of crime. Of course you get the shoulder of the liberals to cry on if you blame drugs or alcohol. Who wants to admit to everyone they are just a low life thief? We need jobs. And we need our kids educated. They need to know that they can get an education and get a job and not have to steal. But that is not a realistic goal for many of them. And there is something we can do about that.

  23. Leroy… it’s good to know that you will be there when someone needs help, but some of us are mere mortals and can’t respond as fast as the cops. I have been a Police Officer and have responded to domestic violence calls more times than I can count. Let’s not forget that is what this case was about; not a drug dealer flushing drugs. I have had to, more than once, force my way past an abusive husband that has beaten his wife. Who knows, I may have kept him from killing her. But I was there, I had the information that the Judge couldn’t have, and I acted exactly as our founding Fathers would have wanted. That’s why they used the word “unreasonable†in ruling out searches instead of just requiring a warrant for any search. Yes you and I will just have to disagree. It’s bad enough for the victims and their families that the Police did not get there in time; but it would be much worse it the victims were beaten or murdered while the cops stood by wringing their hands so you can feel good about tying the hands of the cops. But I base that opinion on my experience of having been the responding Officer on these calls. As far as the drug thing goes… I have said here many times that I do not support cops using military tactics and wearing subdued clothing (wearing black face masks… give me a break) to enter house on drugs raids. I am amazed at both the number of Officers that will participate in it and the number of Police Chiefs that will allow it. That’s not an innocent mistake; its cops that never got to play “SWATâ€. It’s reckless and irresponsible; any Officer involved in it and any Chief that allows it should be held accountable. Food for thought
