Firearms Freedom Act - Court Challenge Underway
DaveTN replied to MacGyver's topic in 2A Legislation and Politics
Takes a lot of guts, he could very easily end up in prison manufacturing firearms without a license. (I assume he doesn’t have a license.) -
I’m not responsible for what a criminal does. The Police will already have the serial number, so they will know where he stole it from.
-
As long as they can’t see it from the outside I don’t worry about it; throw it in the center console. I want it accessible. I’d rather they steal my $500 gun than my $1100 Laptop. Also, I can replace a gun a lot easier than a laptop.

alcohol...carry, but not on person
DaveTN replied to 93civEJ1's topic in Handgun Carry and Self Defense
Are you kidding me? It would take a pitiful lack of judgment on the part of a LEO if he was somehow made aware that you were drinking and carrying and didn’t ask you to submit to a breath test. You now have a dilemma. Take a breath test that will be used against you on a carrying while intoxicated charge or refuse and lose your driver’s license on complied consent. I just don’t believe a responsible person would be drinking while carrying. That includes going out of the restaurant and putting it on. If you feel the need that strongly to protect yourself and your family with a gun; don’t drink. I don’t want anyone making life and death decisions that may impact me or my family while their mind is clouded with alcohol. -
Thumb break leather holsters are King. You must always consider weapon retention.

Yeah… I don’t think they are going to say ….â€At .04 you are too drunk to drive a big rig; but you are probably okay to carry a gun.†And if they are forced into legislating a limit you can bet it will have implied consent attached to it. -

We are where we are now on DUI and domestic violence because discretion was taken away from Officers. You sure you want to remove Officers discretion on this? I can assure you it will be below .04% BAC. Everyone is pretty much in agreement that the effects of alcohol on the mind and body start at around .04. Legislators are not going to want to wait until you are legally impaired to say you shouldn’t be carrying. .08% BAC is not a standard measure and it is not a limit. .08% is a legal presumption of impairment. As a Cop I could charge people down to .05% with DUI if I had evidence to substantiate it in court. The law isn’t fair and it isn’t just; and everyone certainly is not treated equally. -
Is ‘Project Gunwalker’ about to bust wide open?

If there is a settlement (or a case dismissal); no one testifies about anything. </SPAN> -
Store Owner Shoots Robber In the Butt; Doesnt Get Charged...
DaveTN replied to a topic in Handgun Carry and Self Defense
I disagree. He wasn’t just a robber; he was an armed robber that had hit this man and threatened his life with a gun. He deserved to die. Many years ago states had “Fleeing Forcible Felony†statutes; this guy would have been bought and paid for if someone killed him. Unfortunately, most of them have been done away with. So now instead of killing armed robbers we are sending people like Jerome Ersland to prison for life. There is nothing right or just about it. Thankfully this States Attorney is doing what he can to protect the citizens instead of the violent criminals. If by “Old School†you mean we aren’t liberal criminal huggers; you would be right. -
No one in the Georgia office had an answer for this issue?

DaveTN replied to 93civEJ1's topic in Handgun Carry and Self Defense
It’s not an issue if the cop doesn’t think you are drinking. If he does he will ask you to blow. The effects of alcohol start with impaired judgment around .04%. I certainly wouldn’t want to play that game. Lawyers are expensive. I guess I got off track because of how many times I have heard “Officer I have had one beer.†-

No, the cop makes the stop and the arrest, the DA decides if charges are filed, a Judge or jury determines if you are guilty based on the evidence and testimony of you and the Officer. Who wants to go through all that and have a DUI or a weapons charge on their record? Chances are if the cop thinks you are too intoxicated to be carrying you are going to be arrested for DUI. At that point you have the opportunity to have your BAC level documented. Drinking and driving/carrying; it’s a no brainer. -
You will be bound by Georgia law; not Tennessee. So you might want to post that question here… Firearm Discussion • Index page

You want us to believe that any gun dealer sold her a $250 POS without trying to get her into a quality gun? Why was your Mom at a gun shop without any help? No one in your family knew enough to help her? Tell your Mom not to ever buy a new car without letting you know; your head may explode. Polishing the feed ramp doesn’t cost anything…. It’s free. Maybe Deerslayer can do it when you give that gun to him.

Store Owner Shoots Robber In the Butt; Doesnt Get Charged...
DaveTN replied to a topic in Handgun Carry and Self Defense
This man is not having his life ruined by a murder trial because of the States Attorney’s office decision not to prosecute and not to take it to a grand jury. I hope the people of that county understand that the States Attorney made a decision based on justice and not on the law….. And reelect him. -
I guess the Officer that stops you will be the one deciding. That is unless you can take a day off work and go to court for free. It’s not a “must appear†is it?

For years the people that would make a good president; don’t want the job. I would like to see someone that will be open and honest and see what would happen. Probably couldn’t get elected, but it would be interesting.

Bernard Goetz is the poster child for jury nullification. The fact that he was acquitted doesn’t mean what he did was legal. Steve McNair was drunk driving while carrying a gun, admitted it on TV, and apologized for what he had done. A Judge then decided he wasn’t “weaving enough†and the DA refused to appeal his decision. Sometimes in high profile cases certain people are above the law. The sad part is that the message was immediately sent that you can be guilty and still get the probable cause for a stop kicked. But none of us could have pulled that off. Sometimes the courts are just wrong; doesn’t mean what the person did wasn’t illegal.

He is shooting paper and needs to be practicing a lot. So unless you are independently wealthy I would suggest going with a 200 yard paper punching round, that is readily available at a reasonable cost. That would be the .223. Beyond 200 yards I would go with .308 and get him a Past shoulder pad.

I truly don’t think Obama cares about any issue other than getting elected again so he can have four years of doing what he likes without his decisions having consequences. He can make a lot of noise about background checks without getting either side upset. I don’t look for him to do anything until after the election. I just hope he doesn’t get reelected so we don’t have to go through another jump in gun/ammo prices because of overreaction by gun owners. He has to be laughing at the fact that he created turmoil in the gun community and cost gun owners millions of dollars just by being elected; and then did nothing.

alcohol...carry, but not on person
DaveTN replied to 93civEJ1's topic in Handgun Carry and Self Defense
It would basically be the same as if you were a regular citizen that hadn’t bought any special privileges; you would be arrested. I keep a gun in the car, but like last night when we went out for dinner I took it out. I like to drink and I know full well what a .08 is; so I don’t drive or have a gun in the vehicle. -
Yes…. But that’s because of alcohol not gambling.
