Yes, a crime. Don’t sugar coat that or we will never see it changed. The state of Tennessee does not recognize a right to carry off your property. The average citizen would be arrested for carrying a loaded gun in their car. As HCP holders we are a “Special Group†like Police Officers are a “Special Groupâ€. If the government is going to force a private business to allow something that the business banned in belief that it is for the safety of their employees, then it should at least be something that is recognized as a right and it should allow absolute protection from any civil liability. You don’t have any protection in this state (unless you are in a union) so you put your job in jeopardy when you go against the wishes of your employer; no matter what the issue, and no matter what happens with this law. I would guess that the percentage of places that even address guns in cars would be pretty small. Is this somewhere else we want to allow the government to strong arm business? -
I have read some ranges won’t let you shoot with a muzzle brake. I have a Past Recoil Shoulder Pad. It works great put I have to take it on and off when switching rifles. I have been looking at BlackHawk Axiom energy absorbing rifle stocks, but haven’t found anyone that has actually used one.

Nashville Gun Show Parking? (Nashville Fairgrounds)

Isn’t the intent to get vendors to leave? I haven’t been following this closely, but doesn’t fair commission (or whatever it is) want all the business to quit using the fairgrounds so they can sell it and put up condos? I think the sale has been blocked for now. -

Not in any law that I’m aware of. If I walk out in the mall parking lot and see a guy breaking into my car. I can draw down on him and order him to the ground; but I’m not justified in shooting him. If he runs away there isn’t much I can do. If you pull your gun and the responding Officer/DA doesn’t think you were justified you would probably be charged with Aggravated Assault. However… I didn’t work under Tennessee law; so I can’t be positively sure. -

You are describing an unprovoked attack. I don’t think the cops the DA or a Judge/Jury would have a problem with you pulling a gun. If you shoot the person is a whole other level. If you are a willing participant and you have let your mouth overload your azz, there would have to be one heck of a disparity of force for the Police not to arrest you for pulling a gun. And a punch in the face during an argument that you are a willful participant in would not justify pulling a gun. But that’s just my opinion. Take your azz whipping or whip his azz whatever… go home and lick your wounds. Here’s what I’m saying…. If I were the responding Officer to a road rage incident and two grown men, one of them that are supposedly responsible enough to carry a gun, were acting like children and got in a fight, and then they called the law because a gun came into play… I’m probably arresting the guy that brought a gun to a fist fight. Here’s another reason to walk away from a fight… My weapon is properly secured all the time, usually by a thumb break holster. That comes from working the streets as a Police Officer and seeing guns go sliding across the pavement too many times; good guys and bad guys both (Running/Fighting/jumping fences). There was a thread about that here and the popular opinion was that most didn’t need to secure their weapons because they were never going to participate in activity that would require it. Except now you have introduced a gun in the situation; a gun you may no longer be in control of. Based on what little information the press is giving us…. Two guys were actively engaged in a road rage incident. One pulled a gun on the opther and shot him twice. The guy that had been shot then took the shooters gun away from him and killed him with it. These guys should have had their fight and went home alive. But a gun was introduced and one is dead and one is going to trial. -

This discussion always ends the same. Tennessee is an “employment at will†state. Unless you have an employment contract you can be terminated at any time for anything; if I were an employer I wouldn’t even give a reason. The cops are not going to get involved in this. They are not going to search your car even if you agree to a search; it’s not a criminal case. It’s a crime to carry a gun in Tennessee. Until that changes I don’t see anyone forcing an employer to allow anyone to carry on their private property. -

Maybe we are all misunderstanding each other. I’m not saying you have to take a punch in the face and do nothing. I’m saying that short of an unprovoked attack I just can’t seem to think of a scenario where I would be getting punched in the face without being an active participant in some type of argument/road rage/ whatever. Are you saying that you think you can be an active participant in a road rage incident, pull off the road, get in an argument, get punched in the face, and then be justified in pulling a gun? -

No…. what I meant is that pulling a weapon does not require you be justified in using deadly force. And given the choice I would never wait until deadly force is justified. If you threaten someone with a gun and you are not justified; its aggravated assault (a felony) and not brandishing (usually a misdemeanor). At the moment he lifts his shirt to show me a weapon; I’m justified in drawing a weapon even though I’m not justified in killing him. The level of justifiable force is not on or off. You escalate and deescalate with the situation. If you cannot do that you may very well die or go to prison. -

Yes you can do it, as long as you are justified. It’s been argued to death here but threatening to use deadly force is not the same as using it. There is no such thing as brandishing. If you threaten someone with a gun and are not justified; you would be charged with aggravated assault; a felony. People need to know he law. You being scared and telling the Judge you were scared is not a good plan. If you are in front of a Judge or jury there is an 80% chance you are going to prison. -

Absolutely. You have just found yourself in the middle of an armed robbery. I would hope I am faster than him because I’m drawing my weapon and backing up. If he attempts to pull his I would shoot him. Once he displays it you don’t have to wait to see what he is going to do with it. Contrary to popular belief if someone is pointing a gun a you your chances of survival are zip. -

Because it’s the law. If someone bitch slaps you during an argument and you pull a gun, unless there is some great disparity of force; you are more than likely going to jail. An unprovoked attack from someone that you are not an active participant in an argument with is another story. (As in a robbery.) Pull a gun, display a gun or let someone see a gun, and you have just escalated the situation to you being a “man with a gun†to responding Officers. Having been the responding Officer on those calls many times I don’t want to be involved in that level of interaction with cops. You can argue all day long whether you threatened anyone or committed a crime, but chances are you are going to make that argument in a courtroom and you are going to have a big azz attorney bill to do it….. I’ll pass on all the drama. -
I have absolutely no experience, but I’m curious why you mention the city limits? The CLEO in Gallatin is the Sumner County Sheriff. Does the Chief of Gallatin PD have to sign off also?

Unless they gave me reason otherwise; I respected all Military Officers and still do. They earned that respect by getting the commission. But that’s just my opinion; some people don’t respect anything.

This will possibly be a case we can all learn from. I wish someone in the gun community could record the entire trial so we don’t have to rely on the statements the media chooses to print. Argue the law all you want, but the case law and the real life decisions created by these trials is what’s important. Sure, we all know you can’t chase someone down and kill them. But in my opinion this case is different. This guy had been shot twice. His mind, I’m sure, wasn’t thinking right. I also would argue that the threat was not over. If he passed out from his wounds the other guy could have finished him off. I’d buy that if I was on the jury. This is a case where this guy better have the best lawyer money can buy. Can we get Court TV to go there? -
Wow…. It’s pretty easy for some of you to arm chair quarterback the guys parenting skills. Hope you never have to eat your words. Cocking a pistol and pointing it at the kid shows that he doesn’t have any business owning or carrying firearms. I’d arrest him for felony aggravated assault, and hope the DA didn’t let him pled to a misdemeanor.
