Then read it. Do you really think an attorney is going to get on here and tell you that telling a cop its none of his business if you are armed, or where your guns are is going to happen (unless it’s your attorney looking for another payday)? There are a couple of Tennessee Police Officers responding to your questions, or are their opinions baseless also? If you want to know what’s going to happen in a courtroom; ask a criminal defense attorney. If you want to know what’s going to happen on the street; ask a cop. -
Does your wife not have an attorney? Does Sumner County not have a child support enforcement division? If he has any money to recover, has a driver’s license, or holds any professional licenses; those people are usually on it like a fat kid on cake.

No need for concern. The ATF has about as much chance of being disbanded as the IRS. I’m tired of the whining from Mexican officials and their bad mouthing of the U.S. Screw them; they allow the cartels and corrupt Police agencies the freedom to do whatever they like. Apologies? You have got to be kidding me. Has the Mexican government apologized, or more importantly done anything to stop criminals who “walk†across the border that present a danger to the American people? No they haven’t; because they just don’t care. Maybe I’m alone on this, but drugs are lost on undercover operations, I just don’t care that some guns got lost. I feel bad that a Border Patrol Agent got killed. But I am not naïve enough to believe that the gunman would not have had a gun if it had not been for this OP. And we still don’t know that the weapon was one that was allowed to be illegally purchased. It’s a good opportunity for some folks to attack a government agency, and some politicians can get up and make some noise. It’ll grab some headlines for a while, and maybe cause some people to be replaced; but other than that it’s a non-issue.

The court case wasn’t about the 2nd amendment; it was about the 1st. The Judge’s ruling was proper to protect our rights. A Doctor has the right to ask and you have the right to answer in any way you see fit, or not answer at all. If you refuse to answer him; he has the right to not treat you. Unless it’s an emergency; Doctors aren’t required to treat anyone (that I know of). Two people that get straight answers to anything they ask; my Doctor and my Attorney.

If you want to know what’s going on read the law. Then let us know if you see anything in the letter or sprit of the law that would lead a reasonable person to believe that the law requires an HCP holder to display his permit when asked, but does not require him to surrender or disclose the location of a firearm. If you want to have an intelligent discussion on this issue; lets do so. Oh, so because I don’t agree with you I have utter contempt for your rights; what about my rights? I am supposed to back off a potentially deadly situation because you threaten a lawsuit? You have an HCP and you are going to refuse to answer when asked where your gun is and you think a jury is going to side with you? Good luck with that. Carrying a gun in Tennessee is a crime. The fact that state sold you a permit doesn’t mean I would have to play games with you on a traffic stop. It’s a legal game to you; its life and death for cops. RAS and PC is argued in court; not on the street. I wouldn’t have a problem with articulating my concerns in court. -

When you refuse to answer my questions about deadly weapons; I am now in fear for my safety. You have just moved into the category of a reasonable threat. I would remove you from the vehicle and pat you down. If you physically resisted I would arrest you. Would I have a fear of you suing me? No, or I wouldn’t have been a cop. I don’t have to put my life at risk because you are trying to act like a thug. If you didn’t resist I would ticket you or whatever I was going to do and send you on your way. I would then file an information report with the DOS and try to have your HCP pulled. I would let them sort that out. What damages? -

39-17-1351 (n) (1) Except as provided in subdivision (n)(2), a permit issued pursuant to this section shall be good for four (4) years and shall entitle the permit holder to carry any handgun or handguns that the permit holder legally owns or possesses. The permit holder shall have the permit in the holder's immediate possession at all times when carrying a handgun and shall display the permit on demand of a law enforcement officer. (t) Any law enforcement officer of this state or of any county or municipality may, within the realm of the officer's lawful jurisdiction and when the officer is acting in the lawful discharge of the officer's official duties, disarm a permit holder at any time when the officer reasonably believes it is necessary for the protection of the permit holder, officer or other individual or individuals. The officer shall return the handgun to the permit holder before discharging the permit holder from the scene when the officer has determined that the permit holder is not a threat to the officer, to the permit holder, or other individual or individuals provided that the permit holder has not violated any provision of this section and provided the permit holder has not committed any other violation that results in the arrest of the permit holder. -

Tennessee is one of the hardest states to get gun rights restored according to John Harris. A friend of mine retained him to get an expungement to get his guns rights back after a drug conviction in the 80’s; he has never been in trouble since. Harris told him that it didn’t matter if it was expunged; Tennessee would not restore his gun rights. An expungement or even a pardon doesn’t mean the slate is wiped clean. There are some jobs that you are not going to get no matter what; no one can make an arrest disappear.

Only if they are material facts that could change the outcome of the case. Whether he called an escort and voluntarily let her in, or whether she knocked on the door, asked to use the phone, and he voluntarily let her in is not a material fact to the charge of robbery. You drive into an area to score a bag of weed and get car jacked. Most people make up some story about looking for a friend or just driving around; they don’t tell the cops they were trying to buy weed. The cops know what’s going on, but it’s not material to the carjacking. I’m not saying that not being totally truthful with the cops is a good idea, it goes to credibility, but it may not always be a crime. Also, if you charge the victim with a crime you might as well let the robbers go. You don’t have a victim to testify in court and even if he did the defense will destroy his credibility as a witness. They will try that anyway in this case.

Yes Because people with permits have shot cops on traffic stops. I don’t know how anyone else feels about this but I fully understand that I do not have a right to carry a gun in this state. I bought the privilege from the state. I’m glad my legislators allow me to do that. They can take that privilege way. Were you not paying attention when goof ball had his permit revoke for carrying in the park? He was not violating the law. They revoked his permit because he was a nut case. I hope they do the same to you if you tell a cop its none of his business where your gun is on a traffic stop. Then we will have two examples of how you can lose your permit. Maybe on initial contact he thinks you have been drinking, maybe you match the description of a wanted person; he doesn’t need to explain those things to you prior to disarming you. It’s absolutely their business; there is nothing in the Tennessee state law or any state or federal Constitution that requires a Police Officer to put his life in danger playing games with you on a traffic stop. -
I figured it was something like that; three women pulling home invasions would probably not be a single random act. However, he was the victim of a robbery. He obviously gave enough information to lead investigators to the arrest. If someone calls an escort service that doesn’t justify home invasion and battery. Not to mention that if he (as a victim) was charged some people on here heads would explode before they could get their ranting about the Police out.

One gun, no. Several guns, TV’s, laptops, or whatever… yes. It’s how burglars get caught and is just good Police work. Check a bunch of electronics and no one cares…. Check a gun and all of a sudden some folks have their panties in a wad. -
I have a 2 ½†Model 66. It and the Model 65 are K-frame's. That’s a pretty big, heavy revolver. Its worth more than the Glock, but have you thought about how you are going to carry it? The Model 60 “Lady Smith†is a J-frame .357Mag. It’s much easier to conceal, just one less round.

I wouldn’t try to make arguments for carry; you won’t change anyone’s mind and there’s no point wasting a card on them. Give a link to here or to the Tennessee State HCP web page to those people that want information on obtaining an HCP. Once they start getting the information and some training they can make an informed decision on whether or not they want to open carry. I don’t open carry, so I won’t need any cards, but I think I’ve seen some ideas posted here a long time ago about this topic.
