I agree. They know the laws and they aren’t posted; leave them alone. But when someone is open carrying, or as in this case someone sees the gun and complains; they need to act accordingly. Leaving those of us who carry concealed alone is better than posting.

Heck with that citizen’s arrest stuff. Citizens don’t have qualified immunity; cops do. Do Tennessee Police Officers have no duty to act outside their local jurisdiction? I just find this very interesting; I come from a whole different set of rules. -

Thanks. So if a THP Trooper and Metro cop are together visiting Memphis and they see a crime, the Trooper has full Police Powers and all the protections that go with that, and the Metro Cop has no authority? Can I assume “hot pursuit†applies? If a guy busts their radar at 100 near the city line and it takes 2 miles outside the city line to get him stopped; they just let him go? -
Have you checked with them or your dealer? This last time mine still showed “Processing†on-line the day after it was at my dealers.

I’ve ordered from Buds twice and CDNN once. All three were at my dealers in 3 days. They were guns none of the local or forum dealers had, and “didn’t know†if they could or how long it would take to get them.

Everyone has to take responsibility for what they do. There is no special law to charge you with some kind of “deadly Force†charge for pointing a gun at someone; its aggravated assault. And it’s only aggravated assault if the following people, in the following order, don’t think you were justified in what you did… responding Officers, the DA, a Judge or jury. Being a willing participant in a rage road incident will not end well for you if you shoot an unarmed man. Roll your window up, lock your doors, and drive away. If someone smashes out your windows while they see you pointing a gun at them; shoot. If you see a person that is in immediate danger of death or great bodily harm; you can act. But if you pull a gun and get involved in something you better be sure of what you are seeing. Those could have been good Samaritans chasing down an armed robber, or they could have been cops, too many ways for that situation to go sideways.

I haven’t got to check out the Ruger compact yet, but will probably at some point try the SR40c. I have the M&P in both full-size and compact. I’d recommend you check those out before buying an XD.

I wouldn’t say that holding teens at gunpoint for looking for ghosts in a cemetery that isn’t on your property is anywhere close to holding someone at gunpoint that is burglarizing your shed or vehicle. He got arrested for agg assault and false imprisonment. He was lucky the Grand Jury didn’t’ indict. I would say that’s a case of someone that overreacted and I’m sure it cost him a lot. -

Mike, don’t confuse what I say I know with my beliefs on how things should be. I believe that I have a right to keep and bear arms. I do not believe that right comes from the 2nd amendment. I believe it comes from my very basic right of self-protection (inalienable rights). If you think your gun rights now, or every will, come from the 2nd amendment; you are beat before you ever get started. I know for a fact that I do not have the right to bear arms. If I did I wouldn’t need to be buying the privilege from the state. The 2nd amendment is in direct conflict with states’ rights. States are charged with Policing and protecting themselves. Unless the Federal government wants to take on that task they will never be allowed to determine who can and can’t carry a gun. All the 2nd amendment does anymore is to keep the government from disarming Police departments and National Guard units (as in England). I also believe that an apartment owner should be able to rent or not rent to anyone he chooses. And that’s pretty much the way it is now unless the owner is getting some kind of Federal money. However, as has been noted time and time again; there are specific laws that deal with that. No races or religions are outlawed or controlled in this country; guns are. Apples & Oranges. I have no problem with the state telling a business owner he must allow people to carry guns on his property; as long as they give him absolute immunity from liability. But that’s not going to happen; the business owner is the “deep pocketsâ€, he will be the target no matter what happens because generally the other players don’t have enough money to mess with. As you see here Drew has an attorney telling him that the landlord is liable if something happens to him because he can’t carry. I think that’s ridiculous, but so be it; he wants to threaten the owner with a lawsuit. On the other hand, the parents of the kids that are living with him in that apartment may have some real concerns. When Drew kills one of those kids while playing around with his new handgun, who are the parents going to sue? Not Drew… he ain’t got chit. They are going to sue the property owner because they signed a contract that said firearms were not allowed on the premises. Not only that; they have now had a complaint about a gun in the apartment. It’s catch 22 for the business owners. And if that’s going to be the case; they get to decide how things are going to be. Tennessee does not now nor have they ever in recent history allowed their citizens the right to keep and bear arms. Until they acknowledge that all citizens of the state have that right; it’s just a permit for a “special group†and no constitution rights are involved. -

No he can’t; there are both Federal and state laws against that. Due to the recent SCOTUS rulings he has a right to own a gun, and had he not knowingly signed a lease with a firearms clause he might have a case. However, the question would be, does the right to own a gun trump the rights of a property owner? There is also the issue of three other people living in the apartment; this is not a single owner issue. They will claim a right to safety. IMO, if it weren’t for the three other tenants, this would be a good test of the recent ruling by the SCOTUS that you have a right to own a gun, but it’s a state right to determine how, when, and where you carry it. There are a couple of attorneys on here that handle gun cases; maybe they will weigh in on this. -

If someone is breaking into my car, shed, or whatever, they are committing a forcible felony…. I’m not making an arrest (that’s up to the cops when they arrive). I’m taking them a gun point. Pointing a gun at someone if you are not justified is aggravated assault. However, I believe that I would be justified. I can’t believe a cop would show up and arrest you for pointing a gun at a burglar. They wouldn’t arrest you in Illinois, they would give you a good citizens award; Tennessee may be different….but I doubt it. Everyone has to do what they are ready to take responsibility for. -

The government isn’t banning firearms; the property owner is. He read it, understood it, and signed it. You do not have right to bear arms, you have a right to own arms, but not on someone else’s property. Carrying a crucifix in Tennessee is legal; carrying a gun is a crime. -
Tennessee law allows the justified use of deadly force whether you have a permit or not. The way I read the law you are okay in a self defense shooting even if you are carrying illegally. But I’m not a lawyer.

Yes, you need an HCP. It is a crime to carry a loaded firearm in this state whether it is a long gun or handgun.

I’m not clear on how this went down. You saw a copy of the lease prior to signing. You called this guy and said he would give you an exemption on the firearms clause. Instead of just crossing out the firearms exemption and him initialing it; you signed a contract that banned firearms in the apartment? Or was this conversation after the lease was signed? -
Of course he can ask you to leave; and he can call the cops if you refuse. If the cops come he can then ban you from the mall permanently. He can make up whatever rules he likes; if you don’t like what he has to say you can contact Mall Management later. I can legally carry in Stones River Mall; and I do. Make sure you all write letters to the mall management explaining the law to them, so they make sure I can’t. My weapon is concealed so it’s a non-issue for both them and me. If it becomes exposed and someone complains to Mall Security; they can legally ask me leave. It sounds as if someone complained and they acted on that complaint in a way they thought was appropriate for the incident. How would you know, have you experienced it in the two weeks you have owned a handgun? Or are you going to reference internet stories?

The effect of clothing on a .45ACP would be minuscule. However, the difference in .45 FMJ and JHP is substantial. Velocity means nothing by itself; you need mass and surface area also. Ideally you would have a large surface area with jagged sharp edges, with a lot of mass, moving at a speed that would cause it to expel all its energy in the body without passing through. The idea is to stop the threat by making your attacker unable or unwilling to return fire with a hit to center body mass. The other school of thought is shot placement. There are those who during a gunfight are going to place their shots so that they turn the bad guys off like a switch. Caliber, physics nor ballistics is as important in this case. The drawback to this approach is finding out whether or not you have the ability and control to accomplish the task. Short version: Stick with your JHP’s for carry and use the FMJ at the range.

Last month it was a Kahr MK40. After not being able to find a used one I ordered new. This month it’s a .223 heavy barrel bolt. But since it’s just going to be a range toy I can wait for a good deal on used for it. After 40 years of going through guns; I don’t become attached anymore. It’s always something.

I tried to buy a used 617 for a long time. I finally sent PM’s to the forum dealers and got a new one from Guns & Leather for less than most wanted for used, and far below what other dealers wanted for new. Try PMing the supporting vendors; sometimes it works; sometimes it doesn’t.

Colonel Trott how do you and Metro Chief Anderson feel about the Feds stepping in and letting you know you know they think you are incompetent? TSA Officers are there because they couldn’t get jobs as real cops. Now you let them order our State and Metro Officers around? You should be ashamed. Now grow a set, and tell them to go back to feeling up people at the airport where they belong. Otherwise, we won’t need you. (That’s probably the plan anyway.) -
In tough economic times we just gave away more American jobs and made the pipeline for drugs and illegals a little less restrictive.
