A private company has no business providing security for government workers in another country or a war zone. Why should I as a tax payer be paying the high rates of a private security company when we have better trained personnel in the military we are already paying for? -

JayC, you don't have to accept what you believe to be a sad fact. Should you ever be in situation like we are talking about you can tell the cops to charge you or give you your gun back. You can make it tough for the guys handling the investigation in any way you like. However, most of us who have actually been though a shooting, the investigation of a shooting, or the trial in a shooting case, are offering advice to help the person not end up at trial. I tested the system on carrying a gun in Illinois; I lost. I now am absolutely sure that I don't have a 2nd amendment right to carry in Illinois and I don't have one in Tennessee either. I had two attorneys that were smart enough to get me out of it without a conviction, but it cost me a lot. A criminal trial where your freedom is at risk is not a good way to test the law, and even if you win you will still be paying the bills. Can the Police take a gun as evidence in a shooting if you have not yet been charged? Yes. Can you explain your interpretation of the law to them and ask to keep your gun? Yes, you can do and say anything you are ready to take responsibility for. But doing what you are suggesting would make you the poster child for why attorneys want you to keep your mouth shut until they arrive. -

The 4th amendment uses the word "Unreasonable". It doesn't require that someone sit down and make a list of everything that is reasonable; only that the courts will rule on what is unreasonable. No one is doing this because "that's the way it has always been done". They do it because they are good investigators that know how to do their job. This discussion reminds me of one have had with people many times... Jailhouse lawyer: This will never make it to court; you didn't read me my rights. Me: I'm not required to read you your rights. Jailhouse lawyer: Yes you are; it's the law. Me: If I read you your rights will you promise to remain silent? And you think that being uncooperative with the people that are deciding if you go to trial or not is a good idea? You have told us many times you don't have any money, that you are a poor college student. So you can't afford justice anyway. What do think is going to happen to you if you get charged? Why would someone want to pay off a trial the rest of their life (assuming they don't go to prison)? -
Good idea. You now have a chance to make a difference; do it.

I’m not too worried about going to prison; I don’t think that would happen. But even if acquitted, I would be paying off legal fees for the rest of my life. That’s why part of my plan involves not pizzing off the people that will be helping decide if I’m arrested or charged. -

Once again…. A homicide. Now the question is was it justifiable or not. Luckily for you the Officers at the scene don’t decide that. The coroner and the DA will make those decisions and they will make them after an autopsy and a complete investigation. All evidence will be secured and all reports and interviews will be forwarded for them to make that determination. That’s just my opinion from working crime scenes. -
If holder committed perjury he needs to be charged and fired. If he didn’t, both him and the head of the BATF need to tell Congress and the NRA to go pound sand. I don’t care if guns were lost in Mexico and even if they were its not any more a violation of the law than a DEA agent or a drug task force losing drugs in an undercover deal.

I wondered if this dirt bag would get any pension. If this true it needs to be challenged in court. If any other city or country employee lost their job for misconduct they wouldn’t get their pension. Who’s responsible for making a deal that allowed him to keep his pension?

We aren’t talking about you we are talking about evidence. The chain of custody can’t be broken…. Period. Unless the DA says he doesn’t need/want the gun; its evidence in a shooting and is taken. Court isn’t held at the scene. Those arguments will be made in front of a Judge. If that car was used in a crime and they want to process it; absolutely you will stand by and watch them take it. -

Do that. Point me to all these news articles where the DA had not yet ruled a homicide was justified and the shooter was left at the scene with the weapon used in the shooting. Even a Police Officers weapon is usually taken in a shooting. You may get a DA at the scene that can make that determination, but I would say that’s highly unlikely. You are probably going to get an assistant on call. We will just have to agree to disagree. Evidence is evidence and you are making an argument that because you have a HCP the investigating Officers need to decide right then if you are going to be charged. I guess that’s possible but I doubt anyone would force that situation. -

Part of the job of the first responding Officers is to make the scene safe, secure the scene, and protect any evidence. The investigators will then arrive and possibly even someone from the DA’s office. These peoples job is to find out what happened. I know you don’t believe this, but if you are justified these people are the best chance you have of not being charged. Becoming uncooperative with them could ruin your life; don’t become your own worst enemy. If you can’t control yourself from becoming uncooperative you need to keep your mouth shut and contact an attorney right then. Have you thought about that? Do you have an attorney that you can contact outside normal business hours? If you are going to refuse to make a statement this is the single most important issue you should address prior to needing one. If you have been in a justified shooting and they have taken your weapon, get on here and shoot me a PM. I will make a post and I am confident we will have the cash for you to buy a new gun that day. I have a 60D and many guns, you have a 7D and a 5D and 1 gun; your priorities are messed up. -

When they are satisfied the investigation is over and the gun is no longer needed as evidence. You are quoting law that has to do with disarming a permit holder; has nothing to do with securing evidence from a crime scene. -

Bonding and insurance isn’t corporate welfare. Do you think it is reasonable for someone that just got their HCP and bought their first gun a couple of months ago to hire themselves out as a hired gun? I needed a tree cut down in my front yard. I had a couple of people stop by. The first thing I ask was if they were bonded or insured. I don’t want someone that just bought a new chainsaw and wants to try it out to drop a tree on my house. If they do; I want to know that it will be covered by insurance. I doubt a good marketing plan would be “I have zero experience in security or personal protection, but for $20 bucks I’ll carry a gun around youâ€. A security firms training may not be much better, but at least they have insurance if something bad happens. -

We are on a gun forum so someone will always have a problem when guns are “seizedâ€. However a homicide has occurred and if the weapon was used it is evidence. Although their opinions carry a lot of weight; Officers at the scene don’t made the determination if the homicide was justified or not, nor do they determine if charges will be filed. Usually the responding Officer will secure the weapon as evidence. Once the investigation is complete it should be returned if no violations are found. If criminal charges are filed the weapon could be held for years. -
Illinois residents are working hard to get the same carry privileges Tennessee has. Just like Tennessee; no rights are involved. It’s a crime for Tennessee residents to carry guns. Acting as an armed security guard when you have absolutely no training is a recipe for disaster. I would guess that’s why we have laws and licensing addressing it.
