  1. I need a small trailer to haul building materials and take stuff to the dump. It only needs to be big enough to hold a stack of 4X8 plywood lying flat. I already have a nice 8X12 enclosed Haulmark Low Hauler so I don’t need anything fancy. But the back pull down ramp makes loading building materials and junk a hassle. Any recommendations on something cheap?
  2. Illinois doesn’t have a motorcycle helmet law. When I lived there every May we use to ride from all over the state, meet outside Springfield and then have an organized ride to the capitol to let them know we wanted it to stay that way. It was coordinated with local law enforcement and all the major intersections along the route were shut down to cross traffic during the ride. The lines of bikes were miles long and people would line the streets to watch. I don’t know if they still do it or not, but Illinois is one of only two states that are helmet optional. When the legislators look out their windows and see motorcycles as far as they can see; it seems to have some impact. Now, would that work for guns? Well, I think it depends on how the media would handle it. We would have a bunch of whack jobs show up that could really hurt our cause. If the media locked in on them and let them talk for the shock effect, it would end badly. If they talked to the average HCP holder it might help. It sure would be a roll of the dice.
  3. No you don’t, that was settled in the last two gun cases the SCOTUS heard. It’s up to Tennessee state law when and where you carry, and they say it’s a crime. We will never get the “right to bear arms†or “Constitutional Carry†if people think we already have it. There is no immunity unless it’s specified. Do a search on “Amanda Beech vs. Hercules Drilling Coâ€. She got 1.2 million dollars because an employee shot and killed her husband while showing him a gun at work. The company had signs and a written policy against guns and still had to pay.
  4. You do unless you are tax exempt. A C&R doesn’t make you tax exempt.
  5. I was a Police Officer in Illinois when we could kill fleeing forcible felons. They didn’t run as much as they do now. Now they have absolutely no reason to stop. They know the cops can’t shoot them and when they get caught they just cry and say they were scared of the Police. Of course when confronted by a homeowner they may not run because they aren’t sure if the homeowner knows the rules.
  6. Many companies require that you submit to a search of your person or vehicle as a condition of employment. Do I think that should be allowed? Certainly, they aren’t the government and they are simply protecting their company; employee theft is a big problem. Now, can they force you to submit to a search or forcibly enter your vehicle to search it? No, but they can fire you if you don’t allow it. Or, if it’s a criminal complaint (as in a theft case) they can call the Police and keep you from leaving or entering your vehicle until they get there. I just get pizzed when I hear the “rights†stuff thrown around. Citizens in Tennessee do not have a right to carry a loaded gun in their car; it is a crime. Most of us are happy with what we have, but it darn sure isn’t because of the United States Constitution and has nothing to do with rights. And therefore it isn’t right that you are going to drive that down the throat of a business owner simply because you have the money to buy a privilege. What about the people that can’t afford to buy what you are calling “rights� Trying to strong arm business owners and not give them absolute immunity from civil action will not fly and even if it is passed it will not stand up to scrutiny by the courts. In my humble opinion of course. Yes, I believe you and I should be able to carry anywhere we please. But the state of Tennessee does not recognize the Right to Bear Arms. When all Tennesseans can carry; then the state can tell them they have to allow it in their parking lots.

I would guess if they wanted to charge you it wouldn’t matter if you pointed it or not, committing an assault and “uses or displays a deadly weapon†is all that is required for aggravated assault. Like you, I’m not convicting anyone of committing a criminal act for simply protecting their property by displaying a firearm. Especially when I have done it countless times as a cop. A Police Officer would not have approached three guys burglarizing a car without their guns drawn. But unless the threat level escalated they couldn’t shoot them and neither can we. Maybe one of our legislators could ask for an AG opinion on this. I realize it will still boil down to the DA in your County.
  8. You absolutely should have the privilege of carrying since you have bought it. And the property owner should absolutely not be responsible for your actions if you do something stupid on his property. If the legislature is going to force your privilege down the throat of a business owner then they must also him absolute immunity for a lawsuit even being filed. Police aren’t going to search vehicles when no crime has been committed and there is no PC for a search. Employers are not bound by those requirements. You don’t have to let them search your vehicle; and they don’t have to keep you as an employee. Let’s be real here, if your employer wants to search your vehicle; your job is probably going to be gone anyway.

  10. That has been debated at great length here. I contend that although you can’t use deadly force, you can threaten it to make an arrest on someone committing a burglary. You can use force, just not deadly force to protect property, but I can’t believe our legislators would allow you to use force and not allow the threat of deadly force when engaging a person committing a felony. Had the cops got there in time they would have had their guns out and taken these guys at gun point. However, I am not an attorney and don’t play one on TV. It’s possible you could be charged with Aggravated Assault and have some pretty high defense costs. The responding Officers did the right thing, the Chief did the right thing, let’s just hope the DA has the same opinion.
  11. When you are having millions of dollars wired from the Middle East for cars to be shipped to West Africa you better know WTF you are doing. If they suspect terrorist activity I wonder why they are filing civil charges instead of criminal charges? Maybe it’s easier to take all the money that way and then they can arrest them on criminal charges later.
  12. They better make time or hand the phone to someone that will. I live in Murfreesboro and have never been able to buy a gun at the Outpost or On-Target. I have to travel 60 miles North to G&L at Greenbrier to buy “locally”. But I’m not a “looker”, I’m a buyer and already have my mind made up before I get there. I wouldn’t think of making the drive without calling to make sure they have what I want, and they have always checked to see. I’ve about given up on buying locally and the last few I have bought from Buds or CDNN. Based on the way they do business; they must really be selling a lot, so I don’t guess we need to worry about losing local shops.
  13. That’s not a fact that’s an accusation. But we don’t know what they said or if they have been interviewed. I predict we will find out shortly.
  14. Security of the Interstates is the responsibility of THP. Are they not capable of doing that job without the help of a bunch of Airport Security Guards? Does TSA or DHS not share information regarding possible threats with local law enforcement? In a failing economy this is an arrogant waste of taxpayer’s money.
  15. This really surprised me. Do you really think that when the Tennessee legislature created the HCP program it was done as a part of some grand scheme to confiscate weapons? 5% of Tennesseans have an HCP. If that was their intent don’t you think they may have been able to come up with a plan that would involve more gun owners? The SCOTUS for the first time in history has ruled that we have a right to own guns. The Tennessee legislature has passed legislation that prevents local government from passing gun laws, and passed legislation that prevents the confiscation of guns during an emergency. The Feds did the same with the Disaster Recovery Personal Protection Act. So, who is going to kick down our doors and take our guns? Hitler could not have done what he did without the support of the German people. Neither an out of control government nor the crazies that are suggesting a takeover of the government have the support of the American people. The American people will not take up arms against each other.
  16. Is this a Tennessee law? Departmentments may have Department Policies on handling the arrest or ticketing of Officers on duty, but we didn’t have any law prohibiting it, especially if they were committing a felony. We couldn’t detain Officers for minor violations like traffic offenses without the approval of a Command Officer. But that was a Department Policy; not state law. I have seen on-duty Officers arrested for criminal offenses and I have had to ticket an on-duty officer in a traffic accident. I just handled the accident and had a Command Officer co-sign the ticket. Our Chief was in a traffic accident and co-signed his own ticket. The only people I remember not being able to detain were members of congress going to a congressional session or people with diplomatic immunity. Never ran into either one of those though. As far as we know these guys weren’t on-duty and were in another city. If the DA decides to charge them he will probably just ask them to turn themselves in at his office or at KPD.
  17. We had a Lieutenant that used to say you shouldn’t be able to be a cop until you are 40.
  18. If it happened the way the victim said it happened, the Officer that pulled a gun committed aggravated assault and should be charged. If it happened the way the victim said it happened these Officers jumped out first and attacked a citizen that had done nothing more than flipped them off. If it happened the way the victim said it happened I think everyone on this forum is in agreement. If it happened the way the victim said it happened the DA needs to give them the same consideration he would give you if it were presented to him. If this happened in the middle of the day in traffic; he needs evidence to get a criminal conviction. However. The Chief doesn’t need “Beyond reasonable doubtâ€; even if no criminal charges are filed he can take any action up to including firing them both. One Officer is on modified duty and the other Officer isn’t. That tells me one of two things may be going on. Either they both gave statements that cleared one Officer, but left the other Officers actions in question, or one Officer gave a statement and the other Officer has invoked the fifth.
  19. I pull a car over for speeding I walk up and point a gun at a driver that has committed no crime and is cooperating? Is that what you are asking… Seriously? That is aggravated Assault and it is a crime. Why would I do that? What did I give for a reason? Why am I doing a "Felony Stop"?
  20. Maybe he was asking if it was registered to you with the manufacturer. The serial number or mistakes in reporting the serial number correctly use to be a problem. This also helps if the gun is ever returned to the manufacturer for work. Or he may just be new. Well at least you are an optimist.
  21. Maybe we will try using examples. A cop stops a car on a routine speeding violation. The occupant steps out of the car and belligerently yells at the Officer “WTF do you want?†He appears to be intoxicated but does not approach the Officer. The Officer draws his weapon and orders the driver to the ground. He holds him there at gunpoint until his backup arrives. Is the Officer justified in the use of deadly force? No, not at that point. Is he going to be arrested for aggravated assault or some “use of deadly force†statute; no. Now, you are driving down the road and get in a road rage incident. The other driver get out of his vehicle and yells, “WTF you going to do?†He appears to be intoxicated but does not approach you. Are you justified in threatening him with a gun? No. No difference between you and the cop you say? Certainly there is. You have the option of simply driving off; he does not. Now in the first scenario I would suspect you would claim excessive force and try to find a lawyer that would sue the Department and the Officer. That is your right. They happen all the time, they are called “nuisance suits†and we as citizens pay the bill for them all the time because the city will make a small settlement rather than having the expense of going through a trial. But you would never get anything like that past a jury.
  22. Its 39-13-102 Aggravated Assault. Why are you arguing what law it is? Aggravated Assault is a serious felony offence that can send you to prison. Do think some law in the description for the use of “deadly force†carries more time? If you think so tell me what statute you think it is. The point is whether you are a cop or not pointing a gun at someone without justification in a threatening manner is aggravated Assault. The DA is going to decide if he thinks were justified and if he charges them a Judge or jury will make the final decision. I’m not standing up for them or saying they were acting as Police officers, but you keep claiming that the threat of deadly force for a cop is the same as it is for an HCP holder. That just isn’t true, that’s why there are two separate statutes. However, I don’t think anyone is claiming these guys were on-duty, they were in another city and they were in one of the Officers private vehicle. If they claim this guy was doing something wrong and they intervened as Police Officers they should have called KPD right then. They had to know that Officers were going to be dispatched when two guys get out of a car and guns are pulled. I would guess the DA will make a decision by Wednesday.
  23. Why is this surprising? You can say whatever you like on social media; you just can’t do it with immunity or secrecy. I’m sure the ATF has monitored gun forums. What freedoms are we losing?
