Boo freaking hoo. Your brother was breaking into the home of an 82 year old senior citizen, probably because he thought the guy could not put up a fight. He was wrong and it cost him his miserable crime ridden life. Good riddance, and yes, he was the scum of the earth. -
I’ve said it before and I’ll say it again. I think this a Brady Bunch guy. He has more potential to harm gun owners and cause anti-gun legislation to be enacted than most any of them.

Depends on what you put on the form for your address and state of residence. If you put Tennessee you shouldn’t have a problem. If you put IN I would bet it gets kicked, if the FFL will even accept it.

It’s rare to see someone as set on going to prison as he is. They won’t give him an FFL after having his HCP pulled. With all the drama about background checks the Feds just aren’t going to go there. Look at the bright side though; if he can get an FFL we will have someone stupid enough to test the Tennessee Firearms Freedom Act.

If I was being diverted to NYC; I don’t think I would tell anyone. I’m sure they would have some requirement that they notify TSA if someone told them they have a gun. TSA would actually have something to do, and probably be worse than dealing with real cops. I only flew with a gun once, everything was properly declared. When I got to Orange County, CA my bag came down the carousel with a big red tag on it that said “GUNâ€. There were cops there with drug sniffing dogs going over the bags. They saw it and didn’t say a thing. However, with that tag on it I’m surprised the gun was still in it. I won’t do that anymore. (That was prior to 911, I wouldn’t even try to check a gun through on a flight now. If I want to take a gun I’ll have it shipped to my hotel.) -

Are you talking about an HCP application or a gun purchase? I don’t think TBI “passes†or “fails†on an HCP application; they just supply the info to the DOS. Is the problem that your criminal history is being reported wrong, or is it that you think something they say is a disqualifier, you don’t think should be? -

JG55, Sorry to hear what you went through. I went through something similar in Illinois (Although I wasn’t facing a felony there, and I was in fact carrying a gun in my car illegally). I was contacted by the Police Department that credible threats had been made to my life because of some people I had arrested as a cop. After three years, thousands of dollars, and my case being kicked backed to the local court from the appeals court, I made a plea deal for court supervision that showed as “Dismissed†after a year. I lost both guns, the one I was carrying illegally and a shotgun that was legally cased in the trunk. If I didn’t agree to the guns being destroyed they said we were going back to trial. I was young and dumb and wanted to take the case “All the way to the Supreme Court!†I knew criminal law, but obviously didn’t have a clue about Constitutional law back then. Now before you jump on me to hard saying that I was knowingly committing a crime and you weren’t; I understand that. Mine was 25 years ago; let me offer some insight that might helpful…. Don’t let this eat you up like I did for years. We have a legal system, not a justice system, and our legal system is not gun friendly…. Even in the state of Tennessee. I have to laugh anymore when I see the young hot heads talking about what you can and can’t do, and how they would fight it all the way to the SCOTUS. Like you, I was handcuffed taken to jail, booked and held for 18 hours even though I had bond money on me. Do you still feel you are innocent until proven guilty? I knew better than that from being a cop, but being thrown in jail really makes that clear. Do you still believe you have any 2nd amendment rights? You are now a convicted criminal for doing more than having a gun, and yours wasn’t even loaded. Did you contact the NRA? I did and they told me they don’t help people charged with criminal offenses, even when that offense is nothing more than exercising what you believe your 2nd amendment rights to be. The NRA can kiss my … well you know the rest. Anyway… don’t let it eat you up. If you have the financial resources to try to do something… do it. But don’t expect to get much for you money. Four states recognize the 2nd amendment…. Four… and Tennessee isn’t one of them anymore than New York is. I’ve shared my story and views here before to try to help those that think they have any rights under the 2nd amendment as far as carry or transportation; thanks for sharing yours. Having 2nd amendment rights is like being pregnant; you are or aren’t, there is no middle of the road. -

That’s why I say it may not be over with the DA’s decision. The DA said there wasn’t sufficient evidence to charge the Canton, OH cop, but he was still fired. -

Well of course we don’t know the whole story; we have one side. Our decisions would be easy if we based them on the story the guy told. I want to know what the evidence supports. The DA can make the decision that the evidence in the case doesn’t warrant taking to trial. But unlike civilians, that doesn’t mean it is over for the Officers; they still have their department to deal with. I really only have two questions. Who jumped out of the vehicle first, and if a gun was pulled did the Officers report it? One thing I don’t understand is why this is taking so long. Unless a witness is out of town or something I can’t see the problem; this is not a big case. -
They ruled that you have a right to own guns but the state can put reasonable restrictions on requirements; like requiring a handgun permit and training. What gun did you use to take your carry permit class?

I used a Smith & Wesson 686 shooting .38’s. We didn’t have any 100% in our class because the instructor quit counting holes at the minimum required to pass. He didn’t stop at my target, just walked by, laughed, and said “I can’t score your target; it’s just one big hole…. Pass.†I think the farthest we shot was 15 yards, with most being at 7. At 7 yards you shouldn’t have anything outside the 10 ring, but you can and still pass. -
Let’s say your employer has evidence that you have stolen their property. Tennessee law allows “Arrest by a private Personâ€. Read Title 40 Chapter 7 “Arrest†also read the part about detention of a suspect by a Merchant or Police Officer. I doubt many employers would even try to use force to stop you. They simply call the Police and have you arrested. Tennessee law allows (as do most states) for the detention of a criminal. Citizens just don’t have the civil liability protections a Police Officer has.

It wouldn’t have been a crime in Illinois either. Illinois and Tennessee gun laws for the average citizen are about the same. Illinois doesn’t sell the privilege yet, but they are working on it. -

Oh I know something is going to happen. As soon as the DA makes his decision the ORPD Chief will make his. But one is not bound by the other. The DA will decide if he has evidence to get a criminal conviction; he does or he doesn’t. The ORPD Chief has to decide if the Officers did anything wrong; but he is not bound by criminal law. I also know this thread is going to go wild when a decision is made; no matter which way it goes. Has anyone from the press contacted the DA’s office to see if they have made a decision? Either they haven’t or he hasn’t made a decision yet.
