I’ve never checked the Tennessee criminal code about it because I don’t have children in my house, but you might want to check that to see if there are any laws addressing access to firearms in the home. Child endangerment laws…. If the kids do their hands on a gun.

I haven’t read through this whole thread yet and the suggestions, but the storage was an issue I had had questions about. I was thinking I could use a wireless hard drive in hidden location for storage. Wow… You are being awful hard on yourself. It’s the criminals fault not yours. I think it’s sad that you schedule your life around fear of someone breaking into your home.

That shows you haven’t changed a bit. Because the victim stood up to your racist ramblings and threats; no crime was committed? That’s rich. Now you have the audacity to suggest that your attorney would attack the credibility of the victim, and that the victim somehow had an agenda. How in the world could the victim have possibly known that some little man trying to hide behind a keyboard would commit such a criminal act over the hours of a race track? Well, I guess since you are blaming the victim that answers my question about whether or not you have apologized to him. As far as your record not being available to anyone, you are clueless; but you will find that out on your own.

Nonsense, there was no ruling by a Judge.Charges are never gone…. Never. And if him or anyone else wants to think that a dismissal of charges is the same as “Not Guilty†or that an employer can never ask about, or take action because of the arrest; they are living in a dream world. Just like in his PM to me, he claims to not want to discuss this and then says he will call me a liar if I repeat anything he says, but yet he wants to quote law and try to get people to believe his BS. I told him that if he was wrongly accused or he wants to discuss the legal garbage he would like you to believe; step out in the open and do it. He shows no remorse for anything he did. He sent a racist hate filled email to a Pastor and then threatened him over something as silly as race track hours. That’s a crime. Hey WayttEarp, have you apologized to the victim?

You don’t usually offer a reward if you have someone in custody. Once you have identified a suspect it isn’t usually hard to determine if they did it or rule them out. Sounds like they don’t have a case; if they have someone in custody. $5K might help, but more than likely they will get information when someone needs a pass on a lesser crime.

They won’t hear it; they have spoken. Taking it out on the residents of NY because New York City has an idiot for a mayor doesn’t do any good. And making ridiculous threats that good cops won’t back up doesn’t help this woman’s case any. As a resident of Tennessee I would ask that NY show mercy to this woman and I apologize for any mindless threats that came from our legislature. -
You have been given a platform, a platform that you built I might add, to give the facts. So if the media got it wrong, or you were wrongly accused; you now have an opportunity to set the record straight. You are free to fill us in all the legal intricacies you seem to think we can’t understand. That’s exactly what you are doing. We are judging you as a person; you are not in court and hiding behind “my attorney told me not to say anything†is ridiculous. Your case is over, your charges have been dismissed. You are now being tried in the court of public opinion. Just like you do everyone else; how does it feel? We have one side of the story. What the victim said he received and the fact that TBI traced it to you. Now let’s hear the other side first hand. Own it or deny it, but don’t hide behind the legal system you attack so often.

So far he hasn’t denied it was him. He just hasn’t owned or denied what he was accused of. He just claims he is legally “Not Guiltyâ€.

That was my point in my “Goes to credibility†statement. He sent me an unsolicited PM wanting to discuss “Nolle Prosequi†“Fine lines and extenuating circumstances that the public doesn’t know and probably wouldn’t understand anywayâ€, how a dismissal means he is not guilty, and how an employer can’t even ask him about his arrest. I’m more than willing to discuss just how wrong he is on some of his assumptions, but sine he told me that he would discuss them with me “but anything said during this conversation shall be denied by me as false and without merit.†I doubt there is much point. I may say some things here that certain people don’t agree with or they might take issue with, but I don’t think anyone here has any reason to believe me to be a liar. And I’m not going to be accused of it by him.

I’ve said that all along. The liberal Democrats are united in the “What free handouts do you have for us?†form of big government. Conservative Republicans tend to get split over the minor issues like the Economy, Jobs, Abortion, Gun Control, etc. I think Republicans tend to not go vote if “Their Candidate†is not left in the running. They don’t see it as impacting their job or lifestyle the way the Dems do. I have talked to many people that say because of their jobs they can’t get to the polls to vote. I know that’s a lame excuse, but when you don’t work and a bus is going to show up to take you to the polls; it makes a difference. -

WyattEarp, Quit sending me PM’s. If you want to debate this issue or you would like to offer an explanation for what you Did/Didn’t do; let’s do it on the open forum. I didn’t post that link in the article about you being arrested and indicted on felony charges, and wouldn’t have even known about it if it wasn’t for a link you posted. Own it, or deny it, but if you want to argue the legal technicalities with me, we are going to do it in the open, not hidden in PM's.

Newt’s personal life has killed him. I don’t think he will get the Republican nod, but if he does; Obama has won the next election. He needs to step out and let those that have a chance of winning against Obama go at it; he’s just damaging the party right now. -
This. There are two sides to every story and I am sure we are not going to get the other side here. I have trouble believing a chain like Kroger would allow anyone to be fired because they have cancer. If it matters, I have been diagnosed with cancer and know what that feels like. So far I have been doing well as a survivor; I hope your son is doing the same.

Well as I implied before calling this a “Gun Show Loophole†is BS. It is an attack on private sales. The anti-gun groups want to stop forums like this one from listing private sales and they want to stop private sales period without a background check. So quit calling it a “Gun Show Loophole†and call it what it is “Ban on private sales without a government background checkâ€. A background check won’t keep guns out of the hands of criminals. We have outlawed the use possession, and manufacture of Meth. We even have laws regulating the sale of legal items that are used in the manufacture of meth. Has it helped? No, the problem continues to get worse. Most states (if not all) have strict penalties about felons purchasing guns. I think Tennessee has mandatory prison time for felons in possession. Has it helped? No felons can still buy guns. If anyone believes that merely requiring a background check for a gun purchase will help; why hasn’t the government offered to allow us to do our own background checks on-line? Why hasn’t the Feds offered free FFL transfers instead of allowing FFL’s to bend us over for whatever they feel like charging? If the anti-gun folks want a warm fuzzy feeling on transfers let them help with the cost of it. The SCOTUS has ruled that gun ownership is a right under the 2nd amendment. They have however allowed reasonable restrictions by the states. If one of those “reasonable restrictions†is requiring Federal Firearm License holders to do a background check; then let all taxpayers slit the cost equally and either set-up facilities to handle walk-in transfers with background checks or make them free at any FFL shop. I know that many people oppose the government knowing they have a gun in any way shape or form. I would guess a lot of them are convicted felons, have a history of mental health issues they fear may come up, and some just fear the government in general. Some fear that a gun they sell may come up stolen in a check and they will lose it. That is a very real possibility for many of those of us who do a lot of private buying a selling. I personally don’t care if the government knows when I buy or sell a gun, but I don’t want to be required to pay for a transfer on a private sale. We should all have access to run a gun for stolen whether it goes through an FFL or not. To not have that ability in this day and age is ridiculous.

Tennessee Felon Gun Rights Case

States’ Rights trump the 2nd amendment. The SCOTUS has decided that recently…. Twice. States can make whatever guns laws they want, within reason. This case will have to go through the courts to determine if they feel it is reasonable. I hope you are right that this guy will win. If you are pardoned or a court expunges your charges; you should be able to own guns. However, in this time of the other side wanting tougher back-ground check laws I can’t really see getting a ruling that puts a gun in the hand of a convicted felon. Getting a pardon does not seal your record or wave a magic wand making you no longer a convicted felon. A pardon becomes part of your criminal record. You are still a convicted felon and the charges are still there for people to see, so is the pardon. -
So now it’s boiled down to two possible answers: 1. A Grand Jury indictment is required on all felony charges. I doubt this but I can’t find a definitive answer. I know that if a Grand Jury indictment is needed on every felony they are meeting more than one a month. 2. A grand Jury is not ever required. I suspect this is the case. I am guessing it’s a tool used by the DA for politics and investigations and is never required by law.

Be careful, I was just bragging last year that I hadn’t had a ticket it 18 years. Then I got one for 50 in a 40. I didn’t even try to talk my way out of it, I thought he had just used that to pull me over and check me out (out of state plates). Wrong. I wouldn’t have felt so bad if I deserved it; but I never wrote a ticket for 10 over…. It’s a ticket. Now I can say “I haven’t had a ticket since last year.†I paid $125 and moved on.

I thought part of the deal for the government allowing Comcast to become a monopoly was that they were going to give them free (or cheap) cable? And Microsoft was going to give them computers?
