Sometimes you can’t plan for things like that. My point is that they shouldn’t need to buy a privilege from the state; the state should recognize it as an unalienable right. Until they get this new legislation passed (addressing “Intent to go armedâ€) it can be a felony in this state. I went through this when I was turned down for a purchase because of a gun charge over 20 years ago in Illinois. I told TBI that the charges were dismissed, and even if they weren’t it was a misdemeanor and would not keep me from purchasing a gun. They told me “It could be a felony in Tennessee, so we have to look at it.â€

Those thousands of dollars number are preposterous. However, the realistic $250 number is very high if you are poor or are a mother with children fleeing an abusive husband/boyfriend that is trying to kill you. Some people just can’t afford the price the state of Tennessee has put on their life.

Making that argument in court will cost a lot more than an HCP. Court and lawyers are very expensive.

That wasn’t true 30 years ago; I don’t know why it would be true today with much more advanced technology. I could run a plate and get back info on the RO including their driver’s license info. It’s how we caught a lot of Suspended/Revoked drivers. Many times I would know the RO was Suspended/Revoked before I stopped the vehicle, I don’t know why today they wouldn’t get back HCP info.

I have gun money and haven’t been able to find anything and I’m having withdrawals from not buying any guns. I’m thinking about buying a new Ruger SR40C. I already have an M&P40C and this appears to be about the same size. Any comments on fit, form, or function from those that have one?

Carrying a gun in Tennessee is a crime…. Period. And until that changes it’s an Officer Safety issue and he can do what he likes. Your legislators don’t recognize the 2nd amendment as a right for you to carry and that’s all the cops can go on. You are not required to notify an Officer in this state if you are carrying a gun. Many times it has been asked here for peoples opinions on what they should do. You now have the opinion first hand from a cop that stopped you. I’m a former cop and I’m notifying. I can also tell you that cops make the decisions they make based on the situation that is in front of them. I don’t care how many HCP’s you have or what the cop thinks about HCP holders, the best cops out there are going to disarm you if their senses tell them something isn’t right. As far as your friend’s story… If I was the Officers Command Officer I would want to know what in the world was going through his head when he put him in his car. If he thought he was a potential danger the last place he needs to be is sitting behind the Officer in his car, unless he has been searched and handcuffed. As far as your paranoia about being on list. Yes, you are on a list. You paid a lot of money and signed a bunch of paperwork to be part of our small club “the chosenâ€. No rights were involved and you did it because you wanted to buy the privilege of carrying. There is no record of what guns you have so give us a hint of what you think the scenario would be where someone would be persecuting you for owning guns and who do you think it would be. Don’t get me wrong, paying to buy the privilege is better than not being able to be armed. But don’t fool yourself for one second that Tennessee is a pro-gun state or that any rights are involved. Had you "notified" your story might have ended with “He was cool, I was fine, and I didn’t get a ticketâ€.

Legally eligible to own a firearm. (They will run you through NICS) I have been to the store and handpicked mine three times; Garand, M1 Carbine, and 1903 Springfield. If you want to go pick one out at the store, get all your paperworked submitted a few weeks before you are going, and then call them to check on it. If it shoots brass fine after you clean the lacquer and carbon out, I wouldn’t worry about it. The tighter machining tolerances of most AR’s are designed around using clean brass, not coated steel. I wouldn’t have the chamber modified to run coated steel unless it’s just a plinker dedicated for that purpose. Lacquer and polymer coated steel was made to run in AK’s and SKS’s. Somewhere along the line they found that people will buy it in .223 simply because it’s cheap. Yes, but do you really want to do that to a Colt AR?

There is no upside to this. States control where and when you carry, period. The SCOTUS had an opportunity to acknowledge the right to bear arms for all citizens, and they refused to do it because they knew the Federal government couldn’t enforce it. If a state wanted to let you carry they would have reciprocity with us. If they don’t I doubt most of them would go along with this because the Feds told them they had to. Short of the SCOTUS acknowledging the right to bear arms for all citizens, no good can come from the Feds getting involved in carry laws.

They don’t need to prove intent, just negligence. But I don't think it will go that far.

I suspect the charges will be dropped against the shooter. They will need him to testify in the Attempted First Degree murder/Kidnapping trial of the other guy.

Yes. He’s an American soldier in a war zone. He gets a fair trial the same as if he did this in the states. We don’t turn soldiers over to foreign governments. These accusations have been made before and warrants for arrest have even been issued by foreign governments. We don’t honor them; and it’s a sad day if we ever start. He may be guilty. But turning over an American to the Taliban and having him skinned and set on fire in the town square is something that our government better never be involved in. Of course we now have a President that cares nothing about our troops; so I guess anything could happen.

I’m not a Doctor and I have never played one on TV, but I think that saying there is an increased risk of injury or death when you mix suicidal people or those with mental disorders and guns is stating the obvious. I feel sorry for people that are going through these problems. But they are problems that need to be dealt with. I think most responsible family members remove access to guns and don’t need any help from the outside. On the other hand, you have the nut cases that have absolutely no business being around firearms making YouTube videos.

I have a 6 foot black vinyl coated chain link fence and I’ve never had anyone (that I know of) try to cross it. The 100lb Doberman on my side of it probably has more to do with it than the fence though.

Correct, no bearing on the Officers case. The Officers lied about how they got information that there were drugs in the guy’s house. If they had said they saw it in pictures while searching his cell phone, the Judge they were requesting the warrant from for the house would have had to make a decision based on that. They choose to lie and say he told them there were drugs there. The search of the house was unlawful because they perjured themselves to get the warrant. I don’t see anything addressing them looking through the phone. I’m not saying you shouldn’t have posted the link, that’s what we do here… discuss. I’m saying that if you think the court made any ruling that a cell phone can’t be searched, you need to help me out because I just don’t see it in the case you posted.

That trial was for perjury and filing false Police reports. I don’t see anywhere that the court addressed whether or not their search of the cell phone was legal; it has no bearing on this case. Charges were dismissed against the criminal and the Officer was convicted and faces 7 years in jail. Other than the criminal walking free; the system worked.
