I don’t think it is. But years ago (70’s or 80’s?) California outlawed the use of radar. They said that randomly checking the speed of everyone that came by was an “unreasonable search†because there was no cause to be checking them. I think CA uses radar now, so maybe their was a SCOTUS decision on it; I don’t know. I know we were trained that “radar is an aid to what we visually observeâ€.

He is probably caught up in jurisdictional problems. I would guess that the cops in KY are not charging them with the theft that occurred in TN, just the DUI. If the rebar is not being held as evidence, the towing company probably won’t release it to anyone without getting paid for the tow. If they are charged with the theft; the rebar should be recovered property and the cops can release it to the owner no matter what the tow company says about it. But thats just a WAG.

No other public servant would get their pension after being fired for misconduct; why does a Judge get to keep his? -

Of course it’s going to happen. Black gangs have declared war on whites and are using the Zimmerman incident to justify it. Obama and Holder have failed to act when a black gang openly put out a hit on Zimmerman; they were afraid to act and so the radicals think they can do whatever they want. Eventually, these black gangs will pull this where they have targeted the wrong people and there will be nothing but dead bodies of thugs lying around. It will ignite riots. The problem with that is that when whites start dropping bodies of thugs; they will be prosecuted to the fullest extent of the law. They will be made examples of, and we will all stand by and watch it happen and do nothing. Because he doesn’t care about your vote. He will get elected without your vote or mine. Anyone that thinks they are going to get a handout from the government or free heath care, anyone that wants to vote for him because he is a minority and anyone that doesn’t want a republican in office will vote for him. Those groups have people making sure they vote and busing people to the polls. Too many people that are still making a good living are complacent and either don’t care, or don’t think their vote will make a difference. -
Do the blacks want a reason to riot? I’m sure some do. I’m also sure Jesse and Al need a reason for a payday. But is this about race? I think the only reason race is a factor in this is that the black community was appalled at the fact that an innocent kid walking down the street could be murdered and his killer was not charged, even though the cops wanted to charge him. A DA decided not to even have him stand trial. A jury will decide if what happened was right. Anything less will be unacceptable to many blacks and whites alike. I carry a gun to protect myself from criminals that may attack me. Not so I can engage in a reckless confrontation and then kill someone because I get scared in a situation I created.

I don’t understand this. You can’t afford a lawyer, but you are going to invoke your right to remain silent, and demand a lawyer? If you shoot a dirt bag breaking into your house, the cops want to clear it and get out of there as much as you want them out. But you have to understand that they can’t leave until you make a statement. A homicide has been committed and it has to be determined if it was justified or not. They aren’t going to look at the scene and decide it looks like you shot a burglar, and let you be, only to find out later that it was a friend or neighbor you were having an argument with and it was murder. Why would you want them to take you downtown and set a phone in front of you and tell you to call an attorney? They have to hear you say it was a burglary/home invasion whatever, and that you don’t know the dead guy. Unless there is evidence at the scene to the contrary, what do you think is going to happen? Do you believe that Officers of your local Police Department would do this? If so, do you have anything other than an internet video to make you think that? Since we are watching videos and basing our decisions on them… Watch the one where the lawyer made a video recreation of a traffic stop where 3 kids were on their way to a concert and got stopped with pot in the car. Watch as the lawyer tells them to get out of the car, lock the car doors and refuse to answer questions. It’s laughable. Maybe someone here has a link to it. But if you have kids, don’t let them watch it; they will end up in jail following the advice of what this attorney says to do on a traffic stop. But whatever… everyone is going to do what they want and no one is going to experience the consequences but them. I’m just suggesting that if your plan involves refusing to talk to the cops until you talk to a lawyer; make sure your plan involves making the lawyer part happen as fast as you can.

Because the owners don’t want to walk up to someone openly carry a gun and tell them to get out. What’s the big deal with giving property owners absolute immunity for a shooting that takes place on their property? Well….. the attorneys are never going to go for that. Therefore the state doesn’t have the authority to tell them anything. The state can pass all the laws they want about carry and private property. But the fact still remains it’s a crime to carry a gun in this state, and having a permit is a privilege not a right. Until that changes, the only one with any rights in this debate is the property owners. -
If the DA had the final word Zimmerman would not be on trial. The cops ask that Zimmerman be charged from the beginning. The DA refused. It wasn’t until the public outcry got so loud that the Governor got involved and put in a DA that could deal with the situation. That was the Governors way of telling the DA (and the State Attorney General) that they should have been doing their job; it’s a "no confidence" vote.

The only law I’m aware of that has to do with drawing a weapon is aggravated assault. I’m not aware of any law that says I can’t have a weapon in my hand. We would find out because if it escalates to the point of me unholstering a weapon, whether I point it or threaten anyone with it or not, I’m calling the Police and waiting for them to arrive. Martin was being chased by a man with a gun, we don’t know if he saw it or not, but short of someone shooting at you, you just don’t get much more justified than that. It’s a little tough to make a justification argument in a case where the unarmed victim was shot to death and the perp is on trial for murder.

Exactly. And that’s what’s driving my opinion. The difference is if it was you or I a gun would have been in our hand and Zimmerman would have backed away or went for his gun and got shot. Martin used the only thing he had available to him; and it cost him his life.

If they ask if you know why they stopped you reply with “Because you smelled this box of donuts I have in here?†Most cops like a little humor also and may laugh and let you go. DISCLAIMER: If this turns into a Rodney King type incident; don’t blame me.

Zimmerman was arrested and charged with “resisting officer with violence†and “battery of law enforcement officer.†both charges were third-degree felonies. The charges were reduced to “resisting officer without violence†and then waived when he entered an alcohol education program. Zimmerman’s girlfriend got an order of protection alleging Domestic Violence. Domestic violence, felony battery, alcohol treatment, and he had a carry permit. Could that be because his Father was a retired Judge? Wouldn’t trace amounts of THC seems to pale in comparison if we are looking for factors that would have led to a violent encounter?

My comments about cooperating are based on a good shoot. If you think you need to lie or embellish what happened; don’t say anything until you talk to your lawyer. Lying has consequences; it can destroy your credibility if it is discovered, and your attorney can’t put you on the stand in a trial if he knows you are lying.

I love technology, but technology becomes cheap once it is out there. The Burris is loaded with it. But it’s still an optical scope and the technology is depenpendent on the optics quality. It is in the price range of NightForce or Leupold, is the optics in the quality range of those? I would love to play with this scope, but I wouldn’t spend $1500 on it. The Trijicon has no technology and is not a fair comparison. At $600 there are plenty of proven performers to choose from.

Those responding Officers, Detectives, and possibly even an on-call DA will be making decisions about my future. I will be involved in those decisions. Invoking Miranda is not a magic wand that stops the decision making process; it only removes you from it. If I’m going to invoke Miranda, I’m probably going to have a lawyer on the phone in minutes. If you have already made plans that you aren’t making a statement; that’s fine, but you better have a way to contact the lawyer you want.

It what we do; it’s all we can do. A jury will have all the information laid out in front of them. They will not only know what the witnesses have to say, but they will judge their credibility. They will get to see everything and have everything explained to them in detail. We only get whatever the media gives us. We aren’t going to be on this jury, and if someone from Florida develops an opinion based on what they read here, they would have to lie to make it through jury selection. We are just discussing; our opinions mean nothing. I don’t think the jury will have a problem determining what happened. I think the big question will be a legal one. Can you stalk, engage, and cause a citizen that is committing no crime to become fearful of you, and then kill him claiming self-defense when he protects himself? I say no. Unless someone can show me some evidence why Zimmerman thought he had a right to stop and interfere with Treyvon Martin’s peaceful journey through the neighborhood, other than it was a black kid he didn’t recognize; he should have stayed in that truck and waited on the cops. Treyvon Martin was in a place he had a lawful right to be. He was doing nothing wrong and was accosted by a stranger. He had no duty to run or retreat. He defended himself…. That is what stand your ground is all about. Unfortunately all he had to defend himself with was his hands, and his attacker pulled a gun a shot him to death.

The victim was being pursued by someone that was following him and then jumped out of a truck and came after him. His choice was fight or flight. So you are saying he had a duty to retreat? If he was scared because he was being stalked by a stranger; instead of engaging his pursuer and protecting himself he should have simply ran away?

Just like a weapon, the application drives the choice of a sighting system. A scope is generally a long range sighting device, target shooting, hunting etc. A reflex, holo sight or a laser is a combat or SD sighting device. For LE or Military the holo sight, reflex, or a laser has an advantage for clearing houses or quickly engaging a target at short distances. The higher end holographic sights like the Eotech are also parallax free. With your head up, both eyes open, weapon at the ready, this gives you the ability to quickly put rounds where you want them to be without shouldering the weapon and aligning your eye with a conventional sighting device. SD and SHTF are the same thing, for that I would choose a holo sight, for target shooting I want a high quality scope with a lot of power. Use a picatinny rail as your optic mounting platform and you can swap optics depending on your application.

They also want to change carrying without a permit from a misdemeanor to a felony. http://blog.al.com/b...lator_work.html If you want to use another state as an example of what we want our carry laws to be, I would pick one of the four so called “constitutional carry†states. Although I think they may have laws against carrying at schools also. -

So far that’s what happened to everyone I have heard of so far that was confronted by the Police after carrying past a sign at a business. (School’s a different story) So far no one on here has posted about being cited for carrying past a sign. Do you have a link to a story where it happened? I know I'm curious to know if its ever happened. -
I don’t have any experience with Savage, but I have a Remington 700 VLS in 308 with a Leupold 6.5-20X40 VX III. 308 is expensive to shoot, so I have been looking for a heavy barrel .223 for cheap trigger time. Every once in a while Dicks runs a special on a Remington 700 heavy barrel for $449. It’s a plastic camo stock and comes with a cheap scope, but it looks like the same action/heavy barrel used in the higher dollar guns. It comes in several calibers but .223 & .308 were on the list. A new comer to the market is the Mossberg MVP. It is a bolt action with a heavy fluted barrel and it uses standard AR magazines. I haven’t seen one except on the net yet, but as soon as my dealer gets one, I’ll have one. They are $499 or $590 with a scope and bipod. I hope to find just the rifle because I’ll want to put my own scope on it. If you want to shoot it a lot I would stay with .223 for a small caliber (400 yards) or .308 for a large caliber (1000 yards). You can find reasonable deals on both those calibers in quantity. Calibers like .243 and .270 I doubt you will find deals on. The scope and mounts are as import as the rifle. Plan on spending at least $200-300 for a starter scope. Get a high quality mounting system and you won’t have to change it when you change scopes as you move up. I prefer Leupold; you can start with a VX1 3X9X40 from Wal-Mart for $200. As you get into bench rest shooting you can try different scopes and decided for yourself who makes the best scopes.
