  3. So you are saying that Police Departments should turn their backs on all those that made a choice to serve their country and did so honorably? And that you, after having been a Police Officer, believe there is an “Us vs. Them†mentality that was caused by Military service?
  4. There is no conclusive evidence of that. Zimmerman was not treated for injuries. A small cut on the back of his head equals “smashing his head against the concrete� Zimmerman couldn’t push Martin off him? I don’t buy it. What if the ballistic evidence shows that Martin had stopped defending himself against this man that was chasing him and was getting up when he was shot? Unreasonable fear of being followed? He was being chased by a man with a gun that shot him to death when he tried to defend himself, I don’t that is an unreasonable fear. If someone is following you in a truck and when you try to get away they get out and chase you, and you pull your gun and tell them to get back, would you expect to be arrested for aggravated assault and have the Police tell you that you have an unreasonable fear of being followed? Following an innocent person down the street and then getting out and chasing them is unreasonable, reckless and I personally believe even rises to the level of a crime. Fight or flight. You think Martin had a duty to retreat? He was the innocent party, how was he stripped of his right to stand his ground? Just because Zimmerman had a gun and was a permit holder doesn’t make me think he was in the right or the only one protected by Stand Your Ground. The victim was Martin, the aggressor was Zimmerman.

  6. Why is it okay that you support Zimmerman, but those of us that think he committed a reckless act that led to the death of an innocent kid not okay? Why can’t we have an intelligent discussion about this trial without the personal innuendoes that those of us that don’t believe what he did was right are supporting gutless politicians, racists, or are in some way fearful of what will happen if he is acquitted? Of course I am an arm chair quarterback; what else could any of us be? We are human beings that see this situation from different perspectives and different back grounds. I’m not trying to argue with or belittle anyone, and I’m not attacking anyone because of their background. Am I judging George Zimmerman? Of course I am; that’s what we do here. And my judgment means exactly the same as everyone else’s here…. Nothing. Most all of us have been spouting off our opinions, it’s a hot topic; should we quit?
  7. “Plain View†is just that. It does not require that it is during a legal search nor does it require you to be legally stopped or in custody. You don’t even have to be present.

  9. Nonsense, you have no expectation of privacy when you are out in public. If you commit a crime you are fair game. Cops can’t be everywhere…. But technology can…. And will. And Rand Paul wants to wake up a Judge to get a warrant to look for a rapist on the loose in a neighborhood? What a loser. Here in the Midstate we are covered with cameras everywhere we go. Want to know what the traffics doing in Nashville or Murfreesboro? Get on TV or online and look. Armed robbers and muggers caught on video and identified, hit and run accidents recorded to help catch the perps, millions of people with cell phones recording everything they see out of the ordinary. Technology is here to stay. When one of the drones is used to violate someone’s right to privacy; post the story here.
  10. I’ve long contended that there should be legislation and regulations involving forced entry by the Police. And it’s sad they should be required because only one person is accountable for the department’s policies; the Chief or Sherriff. First and foremost an Officer that has been to the house, or is involved in the investigation should be required to be with the entry team and identify the house. Subdued clothing and masks should be outlawed. The uniform that citizens are used to seeing needs to be what the entry team is wearing. If an Officer or a Chief thinks they should be dressed like a tactical Ninja for a common raid; they need step aside and let the real cops handle it. I was watching cops one night and they had cops in plain clothes wearing masks jumping out on cars because they had picked up hookers. I thought “Oh my God, how can a Chief allow this?†If there is Officer Safety concerns kill power and water to the house, make contact and order the people out of the house. If destroying drugs is a concern, pass legislation that allows for the maximum penalties if there evidence of drugs being flushed or destroyed. What Indiana is doing is non-sense and shows legislators disrespect for the Police and the Citizens. The uninformed that think the cops need a warrant to search their car are the same ones that will be threating the cops with force if they don’t think the entry is lawful. Shooting at cops or threatening them with deadly force is suicide. If the cops are there they must think are there lawfully, if someone shoots at them they will shoot back. Are laws like this necessary in Tennessee? If the guy in Lebanon that the cops killed (because he shot at them) when they had the wrong house would have shot a cop and survived, would he have been put on trial? The warrant was no good, the entry was unlawful, he had no idea what was going on.
  11. Her talking in code in the jail house conversation will be what hangs her. It shows she had knowledge of the funds and was trying to hide them. His attorneys have pretty much admitted to that. If they want to charge her with perjury; that’s fine. But I don’t think they should have revoked his bond. He is not a flight risk, but credible threats have been made on his life by hate groups. Keeping him in jail is reckless and unnecessary. They are putting him on trial because he shot a kid to death that it appears was only reacting to a situation Zimmerman sat in motion. If Zimmerman can justify his actions that’s fine, but he’s going to need to do it in front of a jury. I haven’t lived in Florida in a long time and haven’t kept up on their laws, and I am not a politician with political aspirations; but if I were the DA I would charge him. It only appears that they are “Going after him†because they have to make up for the first DA not doing his job.

  14. You are correct. The problem is there is just no way to enforce it. It’s a civil matter; you would have to go to civil court. Who wants to do that? The old man should just buy it. He shouldn’t have been picking it up and messing with it if he didn’t intend on buying it.
  15. I don’t see anything to indicate this was because of phone calls or emails from anti-gun people. I also don’t see anything to make me think this was any kind of an NRA “Workshopâ€. Unless “Workshop†is the buzzword for Political rally. These were Political rallies for Governor Walker. Does stopping that mean they are anti-gun in Wisconsin? Thats a question.... I have no idea.
  16. By botched investigation I was talking about the DA’s handling of it; not the PD’s investigation. The DA did not seek an arrest warrant or file charges against Zimmerman. The DA recused himself the same day the Chief stepped aside. Rumor is because he and the Chief met the night of the shooting and decided to override the investigators request and cut Zimmerman loose. The rest may be all politics, or it may be damage control for bad decisions.
  17. I can understand the racial tension in Florida. When this first came out it was being posted that the cops and the DA weren’t interested in this case and it was a cover up. Nothing could be farther from the truth. The cops wanted to arrest him, but the DA said no. I have no idea if racism was involved in the DA’s decision; unless someone that knows him personally came forward, we would have no way to know that. What I do know is that he made a bad decision; a homicide was committed against a person that was not involved in a crime, and a self-defense argument was being made. Based on the evidence and opinions of the investigating Officers a trial was warranted. Now I am fully aware that he is not required to file charges if he doesn’t want to. But it certainly makes no sense to me why he would do that unless he thought this kid was a thug that deserved killing. However… he answers to the Attorney General of the state (who apparently was asleep somewhere while all this was going on), who answers to the Governor. The Governor gave him a no confidence vote and sent someone else in to do the job. For the Governor (or the Attorney General) to stand by and watch while this botched investigation unfolded would have been criminal. They did the right thing. Did they do it for the right reasons? Who knows, I would like to think they did? Was racial unrest a factor in his making his decision? Of course it was. Anyone that remembers what happened when the cops that beat Rodney King were acquitted has reason to make that a factor. Those cops were guilty. 53 people died and 2000 were injured because of those Officers and those trying to protect them. The Feds had to step in and try to make it right. Contrary to anyone’s belief that double jeopardy protects you from being charged twice in this country… that is exactly what happened. Two of those Officers were sent to prison. Is this going to be the 92 LA Riots all over again? Well, the stage is certainly set. Will it be a factor in the juror’s decisions? In a perfect world it shouldn’t be, but I don’t see how it couldn’t be. I don’t think it would have gotten out of hand if it had been handled properly from the beginning. But then hindsight is 20/20. This non-sense that SYG allows a person to commit murder because they are scared and that they have no responsibility or accountability as to why and how it started is going to be put on trial.

  19. I don’t get what you mean? I saw some racist comments and some people being jerks, but I don’t see much information one way or the other in the story. They named a suspect, say they have a warrant for Capitol Murder, and are refusing to discuss motive. I’m not sure, but best I can tell everyone involved is black. So I'm not sure how the KKK and Southern Racist Rednecks remarks apply.... but whatever. You had to laugh a little bit at the scrabble and “Mexicant†comment. Is it racist for me to laugh at that? 3 dead 3 wounded at a party, I’m pretty sure this isn’t going to turn into a SYG case. But you never know. That story is the first, and only info I have seen about this.
  20. I have asked for the same thing before and never saw it and have never heard of it in a criminal trial. Not saying it hasn’t been brought up, anything can be thrown against the wall to see if it sticks. In a criminal trial you will be judged on whether or not deadly force was justified. Now a civil case is a different matter. You have an ND/AD or shoot an innocent bystander and end up in civil court and everything is up for grabs. You using some crazy hot load or reload can impact the punitive damages the jury awards against you. I also don’t buy into his “Since the court will likely not let the remaining ammunition in the gun be shot (that would be destruction of evidence), they'll need to get exemplar rounds (rounds which match exactly the ammunition used) to make those tests.†If they want to shoot it for test purposes I would think they would do it. Other ammo would not be a good choice.

  22. Zimmerman was charged with resisting arrest with violence and battery on a Police Officer. The two felony charges were dismissed when he agreed to enter an alcohol treatment program. His girlfriend accused him of Domestic Violence and had an order of protection against him. Is the jury going to be allowed to hear that? If the defense starts attacking the victim for past bad acts they will.

Do you not agree that Zimmerman screwed up when he got out of his truck and started chasing this kid, saying “They always get away� Do you agree that that was more than stopping him on the street and asking what he was doing? Do you think it’s possible that Martin was scared crapless? Do you think that it’s possible he saw the gun? Do you think it’s possible he was simply defending himself in the only way he had available to him? I don’t think the state will get a conviction on murder charges, what he did was manslaughter, but I don’t know if they will have that option available to them. He acted in a reckless manner with willful disregard for the safety of others. How many jurors will be used in the Zimmerman case? It is my understanding that because it is not a capital case it will be six? Six might reach a verdict, but I don’t see how as polarized as the two sides of this case are twelve jurors being able to reach a verdict. But who knows…. When they get to see all the evidence and listen to the witnesses in person, they may be able to reach a decision in an hour.
  24. Other than the fact that the guy videoed what happened, I think that’s why it’s getting the media attention it is. If Zimmerman had videoed what happened we might all be in agreement. I think the Texas case will test if SYG is absolute or if a reasonable person would believe he was in fear of death or great bodily harm will come into play. He was obviously standing his ground, now we will see if not retreating from a situation you started and had the ability to end is accepted by the jurors.
  25. Nope, I wasn’t there anymore than anyone else. Like everyone else I have made decisions based on what I have read in media accounts that were biased both ways. I think Zimmerman deserves a fair trial, I don’t agree that the state revoked his bail, I think the state is responsible for his safety while in custody, and I am appalled that both the state and the Feds refused to act when outright criminal threats were made against his life. However… the cops wanted to arrest him when they first had him, they ask for an arrest warrant and it was refused by the DA. The Governor has seen fit to sit that DA in the corner and call one in that can handle the case. A crime was committed and the victim and his family deserve a trial. I know very well we don’t have a justice system, but I hold out hope that justice is served in this case. I know my opinion on this case is not popular on this forum, but I can’t help from join in on the discussion. I am simply discussing the case as I see it; I respect the opinions of others and hope no one takes my comments as a personal attack, they certainly are not meant that way.
