Have they done away with the code requirement yet? Good luck on your test.

Yes, any mechanical device can fail. The Walther PPK had a recall because the weapon may fire when the decocker was activated. Don’t fall into this “A gun can’t fire unless you pull trigger†non-sense. That’s why we always abide by safety rules. Guns have discharged when the slide was dropped, safeties have failed, they can blow up because they failed to completely go into battery, all kinds of things can happen. Yes, there are accidental discharges; they aren’t all negligent. Just make sure when you drop your slide, or activate your decocker, the weapon is pointed somewhere that it won’t do any damage if he goes off. And then you have Bubba…. If he’s been in your gun or you are buying from him anything could happen.

I'm thinking that a FN 5.7 round would have stopped the threat....
DaveTN replied to Links2k's topic in General Chat
Not if you shot him in the body armor, but you sure would have his attention. Any large caliber handgun round to the face would have stopped him. -
At Harry’s Food Mart. Sorry, it was a joke. They shot him in the neck….in the parking lot of Harry’s Food Mart.

Why would you ride the hammer down on a 1911, why wouldn’t you release the mag and pull the slide back?

I don’t know any more than what is in the news video, but appears there is nothing but a wire fence and a few yards between where the people are standing and the land where she took a picture of a Murfreesboro Police car on the other side of the fence. She says 3 cops got out and opened fire with rifles. They don’t show what they were shooting at. It’s an obviously one sided news report, that’s why I’m curious what the Sherriff and the Chief have to say about it. They must think it’s okay if they haven’t acted. They must also think the legal threats against someone making a citizens complaint against a Police Department is okay also. -
I’d 2nd checking out the Franklin gun shop if you are in the area. I’m not sure about the Tactical rifle selection but their handgun, shotgun, rifle, selection is bigger than the Outposts. Just depends on what you are looking for.

You would have to have Administrator Rights, none of us have that.

[Legal Discussion] Peremptory challenge vs. Stricken for cause?
DaveTN replied to DaveTN's topic in General Chat
Thanks Lester, As cops we didn’t see the jury selection process, the jury was picked and a trial was going on by the time we were called. I didn’t mean that all people that haven’t heard of this case were dumber than dirt, but if you kicked anyone that has, I wouldn’t think you would be left with much. I was called for jury duty on a large trial, I told them I was a former Police Officer, but they still wouldn’t let me out. I was more than willing to do my civic duty, but there was no way an ex-cop was going to be allowed to sit on a jury of a criminal trial; there were over 25 lawyers in the courtroom. I got kicked out on the second day, I think they had been through about 30 or 40 potential jurors and had picked 1. -
I’d have to say that the Outpost has biggest selection in the MidState. Price is a different matter.

At some point our economy will become a worldwide issue. If our government fails; it could be catastrophic for the entire world. We are nuclear superpower with ability to destroy any country on earth. The collapse of our government is not an option that will end well for anyone… especially us.

Good luck with your health problems.

This is just a WAG… but they (the cops) can’t act because the occupants have legal paperwork from “Arapahoe County Clerk and Recorder with an affidavit of "adverse possessionâ€. But I’m confused also because if they are months behind in payments the mortgage company still owns the house. How do you get an “adverse possession†on a house that a mortgage company owns? And where are they in all this? But then I don’t know what an “adverse possession†is or how it could be legal. Sounds like theft to me.

Yes, you have the information much faster than in the past. News agencies don’t care if they get it right or wrong as long as they get it out fast. Being fast and being controversial cause’s people to click on their stories; that is how they get paid. Yes, it is as bad as it appears; it’s worse than it appears. I keep thinking something will have to happen to open people’s eyes, but apparently it will have to get worse. It used to be that the people that didn’t have jobs were people that didn’t want to work, or they were just to messed up to keep a job. That is not the case anymore. Skilled trades and skilled tech people can’t find jobs or are working at wages far below where they were before. Unemployment figures don’t reflect underemployed or the shift to Rich/Poor. That’s the way the rich that don’t have to work want it.

Be careful some people won’t know you are kidding. -
I have some questions about jury selection, maybe some of the forum lawyers would step in but anyone is welcome to comment. I would ask that you please keep your opinions on the guilt or innocence of Zimmerman out of this if you can; there are several threads about that going on now. As I understand it both the Prosecution and the Defense has a set number of peremptory challenges that they can use to strike a potential juror without giving a reason. If that is true does anyone know how many that is in Tennessee and Florida? Stricken for cause is basically that there is a reason they believe a juror could not be impartial? Is there a limit? Can cause be that a person has seen or read media reports, or participated in a forum discussion? It seems to me that in the Zimmerman case it will be extremely difficult to find jurors that haven’t read about or discussed this case, and if you found them would you want them on a jury? Would that not be ruling out an entire class of educated people that keep up on current events? It’s also my understanding that in Florida 12 jurors are only required in capital cases. Since this is not a capital case will there only be 6? Can jurors and witnesses be asked under oath to disclose their emails addresses, screen names and forums they belong to? It just seems to me jury selection will be extremely hard in this case.

I hadn’t read all the stories, but I wondered how the he was taken into custody without the cops killing him. I know it was bad for the victims; that’s a given. But can you imagine what it was like for the EMS personnel that first arrived on the scene? 70 people down and them trying to decide who gets treatment and who doesn’t; must have been a nightmare. Many mental problems and nightmares in the future for those that survived and the first responders. Send a message….. Have a speedy trial, stick a needle in his arm and call it a day. I hope they don’t let this drag out for years or give this guy some opportunity to dodge the death penalty. -

This is terrible. I have seen a lot of messed up people and have been to a lot of crime scenes, but these types of people still surprise me. This may sound cold, but don’t they have anyone that messed them over? Why don’t they go after the people that they perceive as causing their problems instead of a bunch of innocent people? I know the answer… because they are mentally deranged… it’s just crazy. I think these crazy people are going after the “record†for body counts. Someday even the liberals will understand that the only thing that can stop an active shooter; is another active shooter. -
Well, so much for a “moral dilemmaâ€, there isn’t any on this forum. There are two sides, most are on one side or the other with very few in the middle.

Did Martin have a duty to retreat? We have no idea what happened between the times Zimmerman was chasing Martin and the time witnesses saw the fight. That’s why there is going to be a trial. Martin was an innocent citizen walking down the street until Zimmerman got out of his truck and went after him. Martin was then shot to death; he is the victim. And Zimmerman could have stayed in his truck until the Police got there and Martin would be alive and Zimmerman wouldn’t be facing many years in prison and death threats.

Channel 5 Nashville Story To Air Thursday
DaveTN replied to Jimbo100's topic in 2A Legislation and Politics
If I understand the story correctly there is absolutely no noise or danger issue with the RCSD range. The issue seems to be that it is not long enough for rifle training and they are using the private land of a Deputy. My experience in law enforcement tells me that this is an issue that should be handled by the Rutherford County Sherriff and the Murfreesboro Chief of Police, since these are the two agency’s participating. I didn’t see any statements from either of them. If what the woman was showing us about where they were shooting within yards of a residential area by a child swing set were accurate; that defies common sense. The Sherriff or the Chief shouldn’t need a news crew to get involved in stopping that; especially when the complaint is against them. Sometimes you shouldn’t need a court to tell you what to do. The spokesperson for the Sheriff’s office is correct; the deputy has a right to use his property as he sees fit. However, they are complaining about Sherriff deputies and Murfreesboro Police Officers. That means it not a private property issue anymore it’s a complaint against Police Officers and it’s up to the Sheriff or Chief to deal with it. I would be livid if I received a letter from an attorney telling me that complaining about the actions of a Sheriff’s department or city Police department was harassment and that I was interfering with the businesses practices of a deputy. I would be curious to know what the Sherriff or Chief had to say about that legal threat. I don’t know anything about the Sherriff of my county other than what I read in the papers, I don’t know anything about the Chief. But now that this news story is out I want to hear their responses. Neither the Rutherford County Sheriff’s Department nor the Murfreesboro PD is big enough for either of them not to personally address this news story. Of course the news story is biased. That’s why they took a cheap shot at Barrett when no 50 cals were even involved in this. But it sounds to me like this story only came about because the citizens’ complaints and noise complaints when unaddressed by both law enforcement agencies in the area, and then they were threatened with legal action. -
That simply isn’t true. The Police investigators asked for an arrest warrant from the beginning. The DA chose not to pursue that. A group of citizens got upset because he didn’t do his job; the Governor sat him on the sidelines and put someone else in. If the fact that the group of citizens was black, makes it a race issue for some people; so be it. I don’t see this being a race issue. I don’t know why the DA didn’t pursue an arrest warrant. I would be curious to know how many times the Police have asked for an arrest warrant in a homicide case and the DA refused. When you kill someone there is no guarantee you aren’t going to stand trial. Zimmerman created the situation, escalated it to a chase, and Martin stood his ground. I’ve seen it posited several times that Martin could have got away from Zimmerman. That is exactly what “No duty to retreat†is all about. Martin had no duty to flee what he perceived as an attacker, he had done nothing wrong. He can’t tell us what he felt, he can’t tell us if he saw Zimmerman’s gun and was fighting for his life. Martin was the victim. If a jury decides to their stamp of approval on Zimmerman killing Martin; so be it. As has been said many times, we don’t have a justice system; we have a legal system. Based on what I have seen and read justice would be a conviction. But that is simply my opinion and means nothing. If this goes to trial we all get to see what the jury sees. I will watch that with an open mind, but I still have an opinion, as does most everyone else.

I’m 58 years old and if I see someone stabbing another person to death, I’m doing the same thing I was trained as a Police Officer to do; I’m pointing my weapon at them and ordering them to stop. What happens after that is up to them. I’ll survive the legal fallout if there is any, but I couldn’t sleep at night if I stood by and watched someone be killed.
