7 year old boy shot dead outside gun store.

I got stepped on; I'm not allowed to do that anymore. Obviously though; the same thing didn't happen to you. -
Disarmed in a traffic stop
DaveTN replied to tennessee01tacoma's topic in Handgun Carry and Self Defense
Is that the video where the kids drive off with their bag of weed high fiving each other? If it is you should apologize for making your kids watch that. If a good cop was making that stop your kids would be in jail and your car would be impounded. You are doing an injustice to your kids to not properly teach them the law. They expect you to know what you are talking about and not give them bad info that could impact them the rest of their life. That video is a terrible example of how to handle a traffic stop. -
Disarmed in a traffic stop

Now you know better than that Greg. I have always acknowledged there are bad cops out there and have even went into great detail many times on how to handle a citizens complaint. If you are accusing me of giving the cop the benefit of the doubt; absolutely I make no bones about that either. I support our cops and they have my respect unless they do something to not deserve it. If a cop needs to explain to a Judge, or jury why they disarmed someone; I'm sure they will have no problem doing that. Try to find a legislator that is going to tell a cop he can't disarm someone that he thinks is a threat. The only ones that are going to do that are the ones that want to see HCP abolished. -

You can always find a reason, I’m not saying that it wouldn’t be lack of maintenance or caused by Bubba deciding he’s qualified to do a trigger job or modify the FCG. I’m not saying that is what happened in this case, I’m just saying my experience with mechanical devices doesn’t allow me the same absolute certainty that a gun can’t fire without a negligent act that you have. I’m not arguing with you; you may well be right. I hope this Xmas season this serves as a reminder that you just can’t be careful enough. It’s a shame this young boy had to die. And I can’t even imagine what his family; especially his Father is going through. Please clear those weapons after removing a magazine and use extreme care handling a loaded firearm. -
Disarmed in a traffic stop

Then why do any of you carry a gun? The chances are you will never need it. Most citizens are law abiding and not going to bother you. I can’t believe this “HCP holders live at the foot of the cross BS.†The state of Tennessee does not recognize your right to carry a gun in your car; it is a crime in this state. I doubt the courts will ever rule against a cop disarming someone on a traffic stop. Sue??? For disarming someone on traffic stop….. Let us know how that works for you. I support our Police Officers and they job and they do. If they feel the need to disarm someone on a traffic stop our legislature has given them the green light to do that. I thank our legislature for that and hope that our courts would never turn their backs on our Police Officers safety. -

My background in machining, manufacturing, and guns tells me that any mechanical device can fail. You think it’s absolutely impossible for a striker fired pistol to discharge without someone pulling the trigger and anyone that questions that is a loon? -
Heller expanded: right to carry outside the home
DaveTN replied to Stegall Law Firm's topic in 2A Legislation and Politics
I don’t believe it will ever happen. As I said this is a good thing for the people of Illinois that want the ability to carry, but I don’t think Illinois, New York , California, or even Tennessee are going to let the Feds drive it down their throat. The SCOTUS will either not hear this case, or will rule the state has the right to control carry outside the home. They have no other choice, they aren’t going to make a ruling that can’t be enforced; and this couldn’t be enforced. But hey…. I could be wrong. -

This is "earth shattering" because its coming from the 7th. The Illinois legislature is already considering carry laws; this could help it along. I don't have time to read all 47 pages right now, but it looks promising for Illinois and possibly a case to go to the SCOTUS. -
Looks good, but I don’t expect a pinned and welded compensator on a $2K rifle just to lose 1.5â€.

.08 is just a legal presumption you are intoxicated; it doesn’t mean anything below it is okay. What is the level in Tennessee for a person driving a commercial vehicle? I believe it is .04. If I was a prosecutor I would make a case that if you aren’t okay to drive a truck you aren’t okay to carry a gun. Here’s the other thing… there is no “implied consent†for carrying while intoxicated. You submit to a test because you are carrying and you may be looking at an additional charge of DUI. You refuse and you will probably lose your carry permit, and still may get arrested for DUI. If you are driving of course. My first question anytime someone asks about the Police finding a gun is always, “How did this become an issue?†If you are standing on the side of the road during a traffic stop with the smell of an alcoholic beverage on your breath and carrying a gun; your night be ruined.

He has a dog. Didn’t you see that little set of stairs for the dog to get on the bed?
Legally speaking it's a bit free-er and less complicated than one might think.
Thanks for clearing up the legalities of that. I didn’t know that in Tennessee at .07% BAC they would just let me walk/drive away carrying my gun.
The reason why they were though up in the first place was to allow LE to drop the mag if they were struggling to keep their sidearm. In that case the gun would be rendered useless unless the bad guy inserted the magazine back into the gun. Dolomite
Exactly. It can free up your hands in a struggle over the weapon. Most HCP holders assume that will never happen to them; and it probably won’t. Everyone has to do what their experience tells them to do. I know of a case where it saved a cops life. And I had a case where I wish I had it to be able to free my hands, but unfortunately I had a revolver. Or you could just call it a “lawyer gun†or “feel good†feature and not get one. Some manufacturers offer their guns either way. It’s just an option.

The guy killed his son. I don’t think the courts could dish out any worse punishment. -
If you don't think it would be a problem legally, what are your reasons for not removing it? Every gun I have can fire a round without a magazine and it has never been a problem.
I like them; they are a feature that could save my life on the street. I know of it happening. I wanted them on my M&P’s but my LGS didn’t have them.

Veterans with no finance skills may lose gun rights

I know there is no answer for this, but I wonder if not being able to purchase a firearm has ever stopped a mentally ill person from killing someone or committing suicide. I have mixed feelings on this. I don’t want to see any military person denied having a gun because of their military service. But on the other hand I think we owe them the due diligence of trying to keep them from committing suicide or killing a bunch of people. -
Unless you or one of the next people that owns the gun negligently shoot someone with the magazine removed I doubt it would be a problem. But I wouldn’t remove a magazine disconnect anyway.
My mistake. It's silly that there's two different ages. You can join the Marines at 18 but can't buy beer or a handgun from a dealer? That's just dumb.
You can join any branch of the military at 17. But you still can’t drink, buy a handgun, get an HCP, rent a car, get reasonably priced insurance on a vette…………..
-
It’s pretty black and white to me. If a cop thinks your drinking is an issue and you are carrying a gun; it’s a problem. As Pain103 points out there is no BAC limit requirement. And even if there was a BAC limit most people have no idea what a .08 is. The OP asked a question and the answer is… No it’s not okay. Transport it the same as if you didn’t have a permit; unloaded and inaccessible.
A simple "death threat" is not a crime under TN law. It is only an assault under TN law if the threat of bodily harm is imminent. Basically you would have to be charging at, swinging at the victim for it to apply. ( Or some other sort of immediate threat of violence, like brandishing a gun.) Just saying "I'm going to kill you" is free speech unless it rises to the level of one of the harassment laws. Back to the original post, very few Vets are appointed a fiduciary. If you are appointed one, something is seriously wrong. All examples I am aware of are for people with serious mental health issues. Personally, I don't want someone suffering from paranoid, homocidal thoughts possessing a firearm. If the Vet still wants to purchase a firearm, they can always decline the VA benefits.
If I tell my wife “I’m going to kill youâ€; that’s domestic violence. I get arrested and upon conviction I lose my HCP. Yet according to you I can tell a Co-worker “I’m going to kill you tomorrow; I’m going to shoot you.â€, and no crime has been committed under Tennessee law because its free speech? -
TMF LEO's had ample evidence including two recorded messages from my voicemail. This message threatened individuals as well as a group. 4 others besides myself spoke to law enforcement about the message and the individual's mental state and history of violence. Each officer said they wish there was something they could do but their hands were tied because he hadn't acted on the threats.
Rev, I agree with TMF, and I have no idea why the cops didn’t deal with your problem to your satisfaction. I have never worked under Tennessee law, but threatening a person is a crime in most states. It is here the way I read the law. I’m making no judgments about what the cops told you because I have no idea of the circumstances, but you always have recourse. You can go either go to the Police Department (recommended for best results) or you can call and talk to a Command Officer. They may tell you the same thing, but it’s worth a try. -
That’s really kind of sad; the guy doesn’t seem to know much but has decided to do YouTube training videos. At least he’s attempted to be prepared. I’ve seen his videos before; he drives me nuts with the notes, and continually looking at his watch. He won’t be winning any video awards.
