I have never been able to get an answer from a reliable legal source on why we have to wait for someone to be arrested before making a challenge. Yes, the BATF has drawn a line in the sand, and it needs to be challenged in the courts. Heller and a group of others challenged the DC guns laws without any of them being arrested.

It’s expensive to train manufacturing employees you know you will have to lay off; most companies won’t do it. As has been pointed out; it’s a production machinery issue. Why spend the money to set-up more lines of injection molding machines for a product that may be banned?

I’m sorry, but unless the guy absolutely refused to leave, the arrest was for political and emotional reasons and out of line. The mall has the authority to tell him to cover it or leave. But they don’t have the authority to tell him to cover it and then have him arrested if he refuses. It would be interesting to hear a more detailed description of what took place. Was he warned that if he didn’t leave he would be arrested? I’m still laughing about arresting him for lying to the cops about how he got to the mall. None of this will be prosecuted. You start arresting people for being stupid and that’s all you would be doing. I don’t know, maybe this guy was on a mission and wanted to be arrested; if that’s the case he got want he wanted.

If the state of Tennessee (or any other state) wants to defy a gun ban, they will just do it. It wouldn’t matter how they did it. It could possibly happen. That is the reason (IMO) the SCOTUS ruled you have a right to keep arms but the state will control how you bear them. If they had ruled everyone could strap on a gun several states would have told them to go pound sand. There won’t be an outright ban on guns; the SCOTUS settled that already. But I doubt any states will defy an assault weapons ban if it passed. With the Tennessee Firearms Freedom Act we could try. But the Feds have already warned how that is going to go. So you are back to will the state stand against the Feds? I don’t think so on a ban. It is, that’s why the 2nd amendment can’t be enforced. The states will not stand for the Feds telling them when and where you can carry. The states are exercising states’ rights.

Anyone know? I’m supposed to be traveling tomorrow and I’m wondering how serious I should be about this packing.

Better. The fit and finish is better, the ergonomics are better, three different sizes of palm swells, options that you can choose instead of being told what you need and what you don’t (Safeties, Magazine disconnects, etc.), Stainless steel chassis, priced the same as the foreign competition, and should you ever need it their customer service is the crown jewel of the industry. What’s not to like? BTW…. Smith & Wesson was owned by the Brits when the Clinton non-sense took place. The Americans have it back. I would need to see some proof that Glock is out selling Smith & Wesson. But you don’t want to decide based on what you read here. I was just pointing because I think you were about to miss an opportunity if you don’t make the comparison.

It’s from another thread. A ranger disarmed an HCP holder during a traffic stop. Now we are going to get out that wide brush and start painting.

Do yourself a favor and quit fooling with that foreign stuff. Take a look at the M&P line. Better quality and made by Americans in America. Make the comparison. I know that’s not what you wanted to hear, but I couldn’t help it. You will thank me later.

M. Moore bodyguard arrested on gun charges at JFK Airport
DaveTN replied to R_Bert's topic in General Chat
I can't seem to find out what happened with the New York charges against Patrick Burke? -
Many of us here have been saying we are doing this to ourselves…. Quit it. But I guess if Yeager puts that in a video it might have more meaning to some? Are you kidding me James, the majority of people won’t protect their families and their futures with where they buy or who they buy from, what makes you think they will protect their rights? You are one of them.

M. Moore bodyguard arrested on gun charges at JFK Airport
DaveTN replied to R_Bert's topic in General Chat
It’s hard to feel sorry for someone that is supposed to be a professional or even have an HCP that carries in NY City and especially at the airport. Does he not watch television, listen to the radio, or check local laws? I guess not if he declared a weapon at JFK. -
How have you reacted personally? Bought guns? Mags? Ammo?
DaveTN replied to hipower's topic in General Chat
I haven’t bought anything and won’t while price gouging is going on. I don’t keep guns; my collection is constantly being rotated. So I don’t want to buy anything that I will lose a bunch on when I sell it. If I were buying I would be buying the things that might be outlawed or regulated, like AR’s and hi-cap magazines. Ammo isn’t going to be restricted or outlawed (IMO), the only shortage on that is the temporary one we are causing for ourselves. But it’s like gas, even when the emergency is over the price stays a little higher than it was before. This is the “Katrina†of the ammo world. Last time the gun manufactures didn’t raise prices, dealers did. We have a couple of proven forum dealers plus a couple of new ones that may not do that; time will tell. -
Why is he signing an affidavit for anything if he is just being arrested for trespass? Our requirements for filing a false report were that you lied about something pertinent to the case. How you got to the mall is a stretch, especially if you weren't being charged with any violations involving how you got to the mall. When I read the article I assumed this was the guys way of showing his disapproval for guns and not meant to be disrespectful to those that died. I agree that the mall had a duty to kick him out. Did he refuse to leave?

What do you guys think of this???
DaveTN replied to timcalhoun's topic in 2A Legislation and Politics
You want to go through convening a panel of Doctors to hear the case and then present it to a Judge for approval after a Doctor has determined a person is a danger to themselves or others just to keep them from being able to purchase a gun? -

This is not a gun issue; this is a mental health issue. A lunatic decided to kill a classroom full of babies. I doubt very much you are going to get any liberals to agree with putting mental cases on a list anywhere. Sign a piece of paper? This guy killed his mother. I don’t know how or if the guns were secured but I’m pretty sure if I’m willing to kill someone getting their safe combination would be pretty easy. We need to do something, but the only thing I know to do right now is to send letters to our legislators (not only emails, but stamped letters) that we do not support gun control and won’t vote for those that do. -
.380 is a terrible self-defense round. No need to drop below .40S&W, most everything is available in that round. My Kahr MK40 is all stainless steel. But I probably wouldn’t have bought it had the M&P Shield been out at the time. The Shield is a sweet sub compact. In Ruger I would look at the SR40 and SR40C. It might help if we knew what your LGS was trying to sell you that you don’t want, and why? I get the feeling that you like many of us older guys; have some negative feelings about Tupperware guns. I don’t buy foreign guns, so I didn’t really get into them much until S&W came out with the full size M&P40. I now have the Full-size M&P40, M&P40 Compact, M&P Shield, M&P15T and M&P15-22, the handguns are every bit as high of quality as the heavy all steel models I carried in the past. The full size M&P has become very popular as a duty weapon in law enforcement without a lot of issues. It’s also near the top of the list of guns I would pick if I could only have one. 15 rounds of 40S&W in a package that is reliable and even somewhat concealable (although not designed for that) is pretty nice. Everything is application driven. That’s why some of us have many handguns, just depends on your application at the time.

A .45ACP double action revolver…. S&W 625. But it’s an N frame; it’s too big to carry. The M&P 45 is a great semi-auto. Its double action only, but striker fired is a better term. The plastic on it is over a stainless chassis.

Why is this a good law, or something we want here?
-
I did, exactly the same thing. The owner of our company started this morning with “Dave, what are we going to do?†and “No one needs that kind of firepowerâ€. He cut me off when I tried to discuss; he had his mind made up. He said he cried when he watched the news. I didn’t pursue it, it was emotional and no one was really open for discussion. I don’t feel like a leper though. The country will have to morn. But taking away my freedoms won’t help.

Firearms confiscation. How would it go down?
DaveTN replied to timcar86's topic in 2A Legislation and Politics
What are you talking about? Why is the Military going to be used for Law Enforcement and who is going to “wipe out†law enforcement? -
I want to know what happened. When people start using this incident to take away my freedoms, you damn right I want to know what happened. If that makes me sick or a moron; so be it. It absolutely doesn't help these kids or their parents to black this out or sweep it under the rug. Censorship will not be good for any of us.

There are a few Patriots left, but they aren’t discussing how to overthrow our government. Those trying to overthrow or destroy our government would know who we were because we would be the ones they would be facing when they decided to take up arms against Americans. “We†are our “Government†and any unlawful acts against us would not end well for the enemy combatants. Because of our “government†(our Constitution and the Legislative, Judicial, and Executive branches) someone like Hussein or Hitler can’t gain power. If our “government†collapses we will lose everything including our freedom. I don’t like Obama being in office any better than anyone else, but it isn’t the end of our country. I have no doubt that he will pull out all the stops on gun control. I think he was going to do it anyway, but he will certainly manipulate this tragedy for his political gain. We have to put our trust in our elected officials to do what’s right. Our Supreme Court has recently ruled that you have a right to own arms under the 2nd amendment. They have left the bearing of arms laws up to the states. Obama can’t change that. Yes, he will try to ban hi-capacity magazines and he will probably get that done. He will try to ban AR’s; I doubt he will get that done. We will be going through some though gun legislation, but no one can ignore the Heller and McDonald decisions. Legislation may be passed that will have to make its way through the courts; but that is what we will have to do.
