State suspends gun carry permit for James Yeager
DaveTN replied to ironsniper1's topic in 2A Legislation and Politics
I think you are right that politics may play a role in this, but I doubt a “Rural DA†will be calling the shots. With the media attention this has I’m sure the “State Attorney General†is calling the shots and if need be will send in "the big guns" (pun intended). I think most “rural†voters that have seen the video are as appalled as most here. I doubt this will be impacting any elections. -
State suspends gun carry permit for James Yeager

I am a former cop, but in another state. I have tried to educate myself on Tennessee law, but that is simply from reading it. I know that the letter of the law can be different from the application. I went on many “threats’ calls. In some arrests were made in many they were not. If you read my posts you know that I said in my opinion his statements did not rise to a criminal level. However, that may yet to be seen. My opinion means nothing more than anyone else here, we are arm chair quarterbacking, guessing, and have no idea what is going on behind the scenes. This I know without a doubt to be fact; if Yeager went on a shooting rampage many here that are defending him would be blaming the Police for not acting. I think his victims would have very good civil case against the state for failure to act. I don’t know that they would win, but I’m pretty sure the case would be filed. I know very little of the authority the DOS has to revoke an HCP. That why in my post you are quoting I asked the question “What happens next, does he have a court date?†I would assume he does, he should. I think that given the current climate on gun control if he was to have a jury trial based on that video, he would have a tough time convincing them not to take his HCP. If a cop made that video would he lose his job? …… absolutely. The public would not stand for someone like that being a cop and they would use the excuse that he has no business carrying a gun. That is something very different than a criminal act though. As far as Yeager having to pay an attorney, I can’t feel sorry for him; he had to have known that was a possibility, he may have even wanted this. He can ask for donations to his legal defense. He will be a heck of a lot more popular than Zimmerman and look at all the money he raised. This could be very profitable. -

He didn't say that. How much deciphering in there time for? Too late you are dead. I think most Police Officers are smart enough to know that their Chief doesn’t have squat to say about the state laws on the justification of deadly force. Chicago Police shootings are reviewed by an independent citizen’s board as well as the States Attorney’s office. Illinois has less than six months to come up with a plan other than banning all carry. He’s saying anything he can to make a point. Here in Tennessee a couple of years ago a shop owner, after being robbed at gun point, ran outside and opened fired on the car the robbers were leaving in. Two cops walking out of a restaurant saw it and yelled at him to stop. We can only assume he didn’t hear them, and they killed him. They had no way of knowing he was the victim, he was in a parking lot shooting at people. He lost focus of his situational awareness and it cost him his life. That’s the point he was making, and I’m making the point that, yes, that is going to happen. But it doesn’t justify what he is suggesting. Whether you are in Chicago or Nashville having a gun in your hand at the scene of a shooting is probably the most danger a person will ever be in in their life. Training deals with what to do in that situation; for cops and citizens alike. As someone once said “Friendly fire isn’t very friendlyâ€. -
Criminals are some of the biggest animals you may need to encounter with a handgun. They may not go down easy or fast.

Until Yeager is arrested Free Speech is alive and well. You can say anything you are ready to take responsibility for. The question here is suspending or revoking an HCP. Anytime a threat of violence is made authorities have an obligation to investigate and determine if they need to act or not. When the Police are called they will respond…. Period. To do anything less is unacceptable. This applies whether it is a citizen calling in because they see you with a gun and think you may be a danger, see you without a gun and think you may be a danger, see you doing dumb azz stuff, or generally just think your actions are suspicious and want you checked out. We all get the details after the fact and decide whether or not the cops had any business stopping the person. This investigation appears to me to have been started with no contact with you accused. Therefore I assume his permit was pulled until he can go to court to respond to the accusations and have a final determination made. Is that not what is happening? What happens next, does he have a court date? -
The Garand is a remarkable weapon; I’m sure you will enjoy it. Go to the CMP forum for a wealth of info. Get some 30-06 snap caps and learn how to load a clip into the rifle without getting “Garand thumbâ€, and make sure the rifle goes fully into battery before trying to shoot. Make sure it is properly oiled and greased. Replace all the springs with new. Read up on ammo and make sure you don’t use any factory ammo that wasn’t loaded for it. Satisfy all the requirements so you can go to CPM to pick out your rifles and you won’t have to pay gun show prices. I’m sure many more will have advice to offer.

State suspends gun carry permit for James Yeager

That’s why I don’t think he was arrested. But I’m surprised he hasn’t had a visit from the Secret Service. The President isn’t going to go out collecting guns; so I don’t think it was a threat against him. I assume that he was threatening anyone that would come to take his guns, as in confiscation. However, he was speculating on someone committing an act that at this point in time is illegal. This may not be over, and I assume that is why his attorney is trying to clarify what he meant. Don’t think that because the DA hasn’t acted in a couple of days that he will never act. He could be waiting on a Grand Jury; we would have no idea if that was the case. -
We are playing “What if†now, but if you can’t legally have it neither could the FFL. It probably wouldn’t be there when you went to get it; it would have been surrendered as an illegal weapon.

No, he made no threats. He was predicting that untrained citizens may point a gun at cops and get shot. It happens. I’m sure it has happened here. We have had many discussions on what to do when the cops show up or even what other HCP holders may do if they aren’t sure of what they are seeing. Cops have shot other cops, and civilians will get shot by other civilians. It doesn’t justify disarming everyone except cops and criminals. -

Members of the New Black Panthers publically put out a cash offer for anyone that would kill or deliver Zimmerman to them. That is clearly a crime. We know who they are, but as far as I know no one has been charged. Crimes aren’t always charged, and the fact they aren’t charged doesn’t make them legal. If I got on here and offered $10K for a specific person to be killed I doubt it would take more than a few hours for the cops to be at my door arrest warrant in hand. -

I doubt they are laughing. They know as well as anyone that no matter what the laws says guilty people are let go and innocent people are sent to prison every day. Nothing is set in stone; the elements of the offense and the facts of the case would be argued. -
The laws will be very specific. We would just be speculating at this time. If they are banned from ownership, an FFL would be required to do whatever the law prescribes. If you can legally have them; they would give them back.

Why would you want them to start there? Your avatar says “Come and take themâ€, is that letting them know you will voluntarily hand over your guns or should they start with you next because it means something quite different? -

I don’t consider him as representing me and only the most fanatical gun haters will see it that way. There is an element out there that sees this as an opportunity to overthrow our government. I am not part of that group and will protect my country at all costs. As I have said before these clowns picture themselves wandering around gun in hand living the good life with no government intervention. They are totally clueless as to what would happen with secession or an attack on the government. They get mad and they can’t think straight. I think that is what happened to Yeager. We have a set of checks and balances in place. We have three levels of government. Right now one (the Executive Branch) is out of control. We have a President that is more than willing to walk all over the Constitution and side step the other two branches any chance he gets. Our founding Fathers planned for exactly what is going on now. I expect the President to try to do something illegal. I think his Vice President is so stupid he won’t know the difference. I don’t expect the Legislative Branch to take a hard line and step in to stop him; although hopefully I will be wrong and they will. I do however expect the Judicial Branch to stop him cold. It will take time for them to do that; I am willing to give them a reasonable amount of time to do that. -
Son asked me a question to settle an argument
DaveTN replied to Chas.'s topic in Handgun Carry and Self Defense
I got arrested for carrying a gun in my car in Illinois. I was much younger and thought I could make a 2nd amendment argument if caught. I found out very quickly that contrary to what anyone thinks; I didn’t have that right. Tennessee has exactly the same laws as Illinois unless you buy the privilege. I don’t suggest anyone try this. The chances are much greater that you will get caught carrying than they are that you will need one. You live in a state where you can get a permit; there is no reason not to take advantage of that. Very good point. If you are at trial chances are very good you screwed up or are going to be convicted of screwing up; perceptions are as important as facts in a jury trial. -

Yes, all this gun control legislation was in the works prior to Sandy Hook, they were just waiting for the Obama reelection. He doesn’t have to worry about getting reelected now and can try anything he likes. I think there is a very good possibility the swift action on Yeager came from a phone call from higher ups out of state. The SCOTUS ruled he has a right to own guns, the state will determine where and when he can carry them. It would require civil action such as a mental competency hearing or a criminal conviction to take his guns, but to take his carry privileges is much easier. It has yet to be determined that what he said is covered as a 1st amendment right. That would be tested if he was arrested, or will be tested in his hearing on his permit. I expect you will see a whole different level of legal expertise and respect of the defense when this goes to the hearing as opposed to the last time we saw that. This is what I expected in the beginning. I should have known he was too stupid to do it. Obviously this is now in the hands of someone besides Yeager. The biggest problem they will have is keeping their clients mouth shut. -
They open the doors and run outside.(an alarm should sound) They can’t lock them to where they can’t be opened from the inside. Fire Code.

I took some heat from a few members on here when I said you can’t start threatening to shoot people. Now it has happened and some think it’s funny and he got what he deserved. I’m not laughing. I don’t like Yeager. He’s arrogant and if he was the badazz he claims to be he would not have had all the bad internet banter about what he did years ago. Maybe he thinks he has since become a badazz; I don’t know. But when this came up at work today I said what he said did not rise to the level of a criminal act; the elements of crime are not there. He was mad and he did something stupid. I saw red when I read about what Obama and Biden were threatening to do; it made my blood pressure rise. But I didn’t post anything stupid. This is exactly what I think the government means when they say they want more in-depth background checks. I think they want to be able to put people on a list that won’t allow them to buy guns. It has to be what they mean because they can already stop them if they have been convicted of crimes. I think this makes it clear that if you say stupid stuff; they can pull your HCP. I have never heard Yeager make threats before, I have heard him say plenty of stupid stuff. Is he mental enough to have his permit pulled? Well, as has been pointed out if he started shooting people the state would have without a doubt been sued if they failed to act. If they start pulling peoples permits for what they perceive as threats there are some people here that will be losing theirs when DHS or DOS start pouring over these threads. So much for freedom of speech. I thought that Yeager would be apologetic, humble and try to clear the air. I was wrong. By saying “If someone comes to take my guns I will shoot them†and “You’re right and I hope they are paying attention†he has made himself the poster boy for suspending HCP’s and potentially for being banned on a background check. He wants that roll so we will see where it goes, he has decided to bang heads with Obama and Biden; they will try to make an example of him. They can pull any licensees he has and kill his business. I have to assume he thought about that…. But maybe not. I have said and done stupid things that I knew were bad as soon as I said or did them. Reading what Obama and Biden are saying can make people make stupid threats. I wish this hadn’t happened. -
White House to bypass congress on gun control
DaveTN replied to ted's topic in 2A Legislation and Politics
The courts can stop him dead in his tracks. They are about the only hope we have if congress fails to act. The SCOTUS doesn't answer to him, Congress or the American people. -
Adding security doors is a good idea. But in most shootings the shooter would have access or someone would open the door. You need to be able to stop the threat of an active shooter. The only way I know of to do that is to shoot them.
-
I wouldn't do an NFA right now. Obama and Biden both have said they won't let the Constitution or the legislature get in their way. So to make any assumtions would be foolish.
-
You can’t do it. You can’t do it when you come right out and make the threats and you can’t do it when you imply violence. It’s not freedom of speech; its threats. I doubt Yeager will be charged with anything, but this is exactly what we don’t need, and posting those kinds of videos on the internet, he is exactly who the current administration wants to ban from being able to buy a gun. I have never agreed with Yeager on anything. But I feel the same level of frustration with the threats coming from the current administration. But you can’t counter with threats of violence.

Employers Requiring The Right to Search Your Vehicle
DaveTN replied to E4 No More's topic in 2A Legislation and Politics
They can search your person or cell phone. My wife works in food processing, they don’t allow jewelry, cell phones, etc. on the floor that can fall in the food. I’m sure places that handle sensitive data have polices against carry any kind of media, including a cell phone, that could be used for transporting data. I’m sure there are places that ban cameras. In those cases the company would search your person or your cell phone. If you refused they would simply fire you. We have Police to deal with crime; the Police are not going to be involved if a crime has not been committed or if the employer doesn’t want to press charges if one was committed. But that doesn’t mean you can carry anything you like onto a business owners property just because it isn’t against the law. This whole problem can be stopped by adding absolute immunity for the business if there is a shooting on their property. Of course no one wants to do that. If Bubba shoots Bill Bob in the parking lot while showing him his new handgun, Billy Bob of course deserves a payday, and since Bubba doesn’t have anything he needs to get his pay day from the business. Our founding fathers planned for this. The Executive branch is sidestepping the legislative branch. We can only hope that the judicial branch will stop Obama in his tracks.
